Abstract

In both Islamic law and International Humanitarian Law, war is an ultimum remedium (last resort) used to solve a problem after both parties cannot resolve their dispute or problem in a peaceful manner. This research was conducted using the normative legal research method. Based on the results of the research, it is known that international humanitarian law and Islamic law both provide protection for people who are involved in armed conflict, including people who have disappeared and died as a result of war. Persons involved in armed conflicts receive protection from international humanitarian law, as stipulated in Article 13 of the Geneva Convention 1949. Protected persons include combatants, militia and levee en maase members and civilians, but their protection has not been properly implemented, because there is still violence in every conflict. In Islam it is found in the Koran, Surat Al-Baqarah, verse 190; "And fight in the way of Allah those who fight against you, (but) do not cross the line, for verily Allah does not like those who transgress". Islam also prohibits attacks on non-combatants, Rasulullah SAW said: "Do not kill your parents, children and women" (H.R Abu Dawud)

Abstract

Sebagai negara dengan penduduk Islam terbesar di dunia, Indonesia sebenarnya memiliki potensi yang besar terhadap perkembangan industri halal dan syariah. Namun sayangnya, potensi tersebut belum diimbangi dengan prestasi yang baik di tingkat global. Kehalalan suatu produk menjadi kebutuhan wajib bagi setiap konsumen, terutama konsumen muslim. Baik itu produk berupa makanan, obat-obatan maupun barang-barang konsumsi lainnya. Industri produk halal, saat ini mengalami perkembangan tidak hanya sekedar produk halal tapi juga menjadi gaya hidup halal. Penelitian ini merupakan penelitian hukum normative dengan metode penelitiannya adalah penlitian kepustakaan. Berdasarkan hasil penelitian diketahui bahwa dengan lahirnya Undang-Undang Nomor 33 tahun 2014 tentang Jaminan Produk Halal maka ada penjamin dan kepastian hukum tentang penjaminan produk halal. Untuk menjadi pemain utama industri halal dunia, perlu dukungan penuh dari pemerintah. Roadmap industri halal perlu dibuat secepat mungkin agar tujuan dan perkembangan industri halal di Indonesia lebih terarah. Keberadaan Komite Nasional Keuangan Syariah (KNKS) diharapkan juga dapat membantu perkembangan industri halal di Indonesia

Abstract

War is an instinct for self-defense that applies both in association between humans and relationships between nations. Therefore the history of war is as old as the history of mankind. In armed conflict there are a lot of cultural objects which are destroyed by bombs or bullets used to attack enemy targets by parties in conflict. Although protection of cultural heritage objects has been regulated in an International Convention, there are still behaviors that cause damage to even the destruction of cultural objects. The procedure for collecting data is in the form of documentation of notes or quotes, search of legal literature, books and others related to the identification of problems both offline and online which are then analyzed through the content analysis method (centent analysis method) with a focus on the issue of how effective the law is international humanitarian in protecting cultural heritage in conflict countries. The results of the study it is known that cultural objects are the cultural identity of the community, so that attacks on them often increase conflict escalation. Air and remote bombing attacks increase damage to cultural objects resulting from armed conflict.

Abstract

Tujuan dari penelitian ini adalah untuk mengkaji kebijakan insentif yang berkelanjutan dalam perlindungan lahan pertanian pangan di masa mendatang. Untuk menahan laju konversi lahan pertanian menjadi lahan non-pertanian, Pemerintah bersama dengan Dewan Perwakilan Rakyat mengesahkan lahirnya Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan. Undang-Undang ini diharapkan dapat menahan laju konversi lahan pertanian menjadi non-pertanian. Salah satu hal yang diatur dalam undang-undang tersebut adalah terkait dengan kebijakan pemberian insentif, akan tetapi kebijakan tersebutmasih berbasis lahan, sehingga insentif hanya diberikan kepada pemilik lahan pertanian yang tidak mengalihfungsikan lahan pertanian pangan. Di mana dengan perkembangan teknologi sekarang ini serta untuk menjaga ketahanan pangan, maka pengembangan varietas unggul pertanian tidak harus dikembangkan berbasis lahan. Oleh karena itu, untuk menjaga ketahanan pangan, diperlukan suatu upaya untuk mengembangkan kebijakan yang tidak hanya berbasis lahan. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach). Analisis data dilakukan dengan menggunakan metode kualitatif berdasarkan logika berpikir deduktif. Berdasarkan penelitian yang dilakukan diperoleh bahwa kebijakan pemberian insentif kepada petani masih berbasis luas lahan, di mana salah satu pertimbangan pemberian insentif adalah memiliki luas tanam paling sedikit 25 (dua puluh lima) hektar dan kebijakan pemberian insentif kepada petani dalam rangka perlindungan lahan pertanian dinilai kurang tepat, karena insentif yang diberikan masih berupa program reguler yang dilaksanakan oleh pemerintah.

Abstract

A corporation is a body consisting of a group of people and its members have their respective rights and obligations, which are separate from the rights and obligations of each member. Corporations have deviant behavior and high authority in a corporation and use their position as a tool to violate the law, so it is often also called economic crime as a corporate crime. In tackling and eradicating corporate crime, Indonesia as a state of law provides a way out in resolving various corporate criminal cases in a more responsible manner. Eradication of corporate crime in Indonesia initially emphasized a repressive and preventive approach, but in its development several changes were seen, namely using a repressive and preventive approach together, both in material and formal criminal law provisions. This study uses library research methods or library research. The data source used is secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials

Abstract

When there is an armed conflict between one country and another, the civilian population is a group of people who are always victims and therefore must receive protection. In this condition, sometimes they have to cross their national borders to get protection. Sometimes they are accommodated in a refugee camp provided by a neighboring country and there are also those who seek asylum individually to other countries. Several international bodies were then formed and during the United Nations era the International Refugee Organization (IRO) was formed with the mandate to protect refugee groups, which was later replaced by UNHCR (United Nations High Commissioner for Refugees). It is also tasked with leading and harmonizing international actions to protect refugees and solve refugee-related problems around the world. Islam grants asylum to anyone who requests it, regardless of religion, nationality or economic status. Islam protects the human rights of every human being without any discrimination. Islam views humans as equal, both in terms of rights, obligations and responsibilities. The difference in human degrees according to Islam is measured by one's piety. Islamic Shari'ah treats the principle of equality in the application of laws and regulations.Keywords: International Law, Islamic Law, Refugees, Asylum

Abstract

This study aims to examine the death penalty in the crime of narcotics abuse according to the views of human rights and Islamic law.The research method is descriptive analysis which leads to juridical normative research. Sources of data used are primary secondary legal matrials, namely the Koran and laws and secondary lawa namely in the form of book, scientific journals. The results of the study show that the death penalty for convicted persons in the criminal case of narcotics abuse in the view of human rights refers to article 1 paragraph 2 of Law No.39 of 1999 concerning Human Rights that narcotics convicts cannot fulfill their obligations as stated in article 1 paragraph 1 the law, namely violating the right to life of the general public which is protected by law.So that convicted narcotics can be sentenced to death because they are deemed not entitled to their human rights, namely the right to life. In Islamic law, convicted of narcotics abuse crime can be categorized as having committed destruction and injustice in this world.Keywords: Death Penalty, Narcotics, Human Rights, Islamic Law

Abstract

The meaning of free trade is actually the reduction or elimination of trade barriers, both tariffs (exports and imports) and non-tariffs. Free trade activities carried out by a country with other countries bring benefits, namely being able to enjoy products not only from products made in the country itself, but also being able to consume products made abroad easily because with the free trade, imported goods can enter freely. into the country. In addition, there is an increasingly open international relationship between countries. In the view of Islam, free trade is not trade that is as free as possible, but trade that tries to optimize trade relations with foreign countries on the one hand and prohibits trade in certain commodities that interfere with the benefit of the Muslims on the other. save mankind. In reality, these activities occur between two parties, namely the seller and the buyer for certain commodities. Thus, the pillars of trade are traders, not commodities. The criteria for free trade according to the Islamic view are responsible, ethical, right, fair and balanced. Islam stipulates regarding trade the benchmarks are honesty, trust and sincerity. These trading principles have been regulated in the Qur'an and Sunnah. This research is descriptive-analytic with the approach used is normative juridical. The collected data is then processed and analyzed qualitatively, using the inductive method to draw a conclusion.
