Abstract

The phenomenon of student disturb should be paid fully attention from all parties and society . Students will be the next generationto decide the nation’s future. The students are in the education process which their mind set should contain morality and knowledge.The purpose of this paper is to find out: (1) the students disturb causes, (2) the law effect, (3) the perspective of education. The methodused library research and the data analyzed descriptively. It is concluded that: (1) the violence was caused of direct effect from disturbs,with the subject and certain motive which the target subject are students and the certain motive is the admission. (2) The student’scase is applied to “Pasal 170 KUHP”, (3) It is needed to work on the process of education from all parties and society to make aconducive situation. (4) The student’s case must be handles comprehensively from the sociology, psychology and cultural point ofview.

Abstract

Sometimes man, as social creatures, in interacting with others create conflict either in the way or the goal, resulting violence. At the end of 2012 and beginning of 2013, there was an increase of violence in Indonesian society which occurs in education institution, and also between the state apparatus. The purpose of this writing are: (1) to discuss the violence as a form of crime from the point of the view of the Indonesian legal system (2) to analyze the causes of violence as a form of crime from anthropological, sociological and psychological approaches. The method applied is library research with the descriptive and explorative approach and the data were analyzed with qualitative methods. It can be concluded that: (1) Violence is a form of crime. In the Indonesian legal system can be punished by the Penal Code and Special Offens. (2) Causative factor is heterogeneous culture, different acculturation, social jealousy (antropology); deviant behaviour and the process of stigmatization (sosiology);imitation and mental disorders (pshicology). It recommended for law enforcement needs to be improved through the application of strict sanction and change the mind set towards non-violence.

Abstract

In fact the victim is an integral part of the criminal justice system. Normatively victim has not been recognized position as an integral part of the criminal justice system. Reparation of victims of crime can not be directly implemented. In order to be able to implemented through other mechanisms, so that the implementation is very minimal. The purpose of this paper are: (1) to investigate the crime victims reparation setting and (2) to analyze its implementation. The approach used is the legislation and case-based approach, the analysis is done by applying qualitative analysis with the data collection through literature. It can be concluded that: (1) the crime victim’s reparation arrangements scattered in various laws, and (2) its implementation is still very low due to various constraints. The suggestions are that (1) it’s necessary to increase the awareness reparation rights, (2) to the synchronization rights regulations reparation, and Integration reparation rights of victims in the criminal justice system.

Abstract

Criminal punishment is the most important part of the criminal justice process . Application of capital punishment by the state through the state court decision means taking the right convict life . The right to life is a human right that is non derogable . Therefore, its application should pay attention to the Human Rights convicted . The objective of this paper is to know: (1). whether the imposition of the death penalty for offenders is contrary to the Human Rights (2). The criteria for the imposition of the death penalty for crimes that do not conflict with the Human Rights. The method used is a normative juridical approach using secondary data. The conclusions that: (1) the imposition of the death penalty is contrary to human rights, but its application can be justified by reason of defending human rights, (2) only applied to crimes that are beyond the limits of humanity and the destruction of human civilization. Suggestions author implementation of the criminal justice process is transparent and fair.

Abstract

The corporation is the subject of a criminal act. As the subject of criminal law corporation does not have an inner attitude. As for the criminal charges can accountability their required mens rea / Schuld. Crimes committed so damaging to the corporation and the state. While conventional accountability system that is individualized, direct and based on Schuld, difficult to apply to the corporation. The purpose of writing is to analyze the system of corporate accountability in order to convict the corporation, and constraints convict against the corporation. The method used is the statute approach (approach legislation) and case approach (case approach), methods of analysis using qualitative analysis to interpretation, and the data collection method using a literature study (library research). It can be concluded that the corporation can be justified by using a system of absolute liability and replacement; and the problem is the application of conventional criminal liability system and the difficulty of proving fault corporation. It is suggested that there is a shared understanding among law enforcement about corporations can be punished.

Abstract

Official crime is a crime committed by civil servants using the power, facilities and infrastructure of his position. Officials as bearers of the state's mandate, are not allowed to use their positions to commit crimes. The Criminal Code aggravates officials who use their positions to commit crimes under Article 52. The practice of ransom under Article 52 of the Criminal Code is rarely applied to public servants committing crimes. The purpose of writing in this paper is: to describe the setting of crime of office in Indonesian criminal law, and to analyze the application of Article 52 of the Criminal Code against crime of office in the perspective of Pancasila law state. The research method is normative juridical with approach of legislation and case approach. Data used secondary data with qualitative descriptive analysis and systematic interpretation. The conclusion is that the crime of office is regulated in Book II and Book III of the Criminal Code and the penalty for offenses based on Article 52 of the Criminal Code and the objections under Article 52 of the Criminal Code against offenses in line with the implementation of the balance of rights and obligations in the Pancasila state law.

Abstract

Abstrak:    Program pemberantasan kemiskinan di Indonesia diimplementasikan ke dalam kegiatan yang bertujuan meningkatkan kemampuan masyarakat secara mandiri ke dalam bentuk pemberdayaan. Salah satu program yang dahulunya menjadi program unggulan pemberdayaan masyarakat ekonomi Indonesia adalah koperasi. Namun sekarang program koperasi ini sedikit sekali mendapatkan prioritas untuk terus ditumbuhkembangkan seperti pada masa pemerintahan sebelumnya. Tujuan penelitian ini adalah untuk: (1) mengetahui cara nelayan memahami perubahan iklim, (2) mengetahui cara nelayan membentuk koperasi. Metode yang digunakan adalah survei lapangan dan focus discussion group (FGD). Hasil penelitian menunjukkan bahwa:  (1) Kelompok nelayan 1 dan 2 telah mengetahui tentang perubahan iklim, sehingga dapat mengantisipasi tindakan apa yang harus dilakukan untuk menghadapi perubahan iklim yang terjadi, (2) Kelompok nelayan 1 dan 2 telah mengetahui fungsi koperasi sebagai alternatif dan cara untuk menyelesaikan kesulitan dalam memenuhi kebutuhan hidup sehari-hari dan untuk menambah modal usaha mereka.Kata Kunci: pembentukan, koperasi, nelayanAbstract:      Indonesia’s poverty eradication programs implemented into activities aimed at improving people's ability to independently into a form of empowerment. One of the programs that formerly become a flagship program of community empowerment Indonesian economy is cooperative. But now this little cooperative program get priority to continue is grown as during the previous admistration. The purpose of study were to know: (1). How fisherman understand  climate change, (2). How fishermen form cooperative. The methods used are fields surveys and  focus discussion group (FGD). The results of the  research show that: (1). Fishermen group 1 and  group 2, alreday know about the existence of climate change. So  that they  can anticipate what action should be taken to deal with climate, (2). The fishermen group 1 and group 2, have to know the function of fishermen cooperatives as an alternative and a way to resolve  the difficulties in meeting the daily needs, and to increase their business capital. Keywords: formation, cooperatives, fishermen

Abstract

Korupsi musuh bersama yang harus diberantas sampai dengan akarnya. Putusan MK No. 003/PUU-IV/2006 dan No. 025/PUU-XIV/2016 mempengaruhi pemberantasan korupsi, karena dengan kedua putusan tersebut tindak pidana korupsi sulit dibuktikan. Terjadi perbedaan penerapan asas legalitas berdasarkan putusan mahkamah konstitusi dan yurisprudensi. Putusan mahkamah konstitusi menerapkan asas legalitas formil sedangkan yurisprudensi mengembangkan asas legalitas materiil. Legalitas formil mencegah perlakuan kesewenang-wenangan penguasa, sedangkan legalitas materiil mengakomodir hukum tidak tertulis yang tumbuh dan berkembang dari bangsa Indonesia sendiri. Putusan mahkamah konstitusi berperan sebagai pengontrol penerapan hukum kebiasaan sebagai dasar pemidanaan. Rumusan masalah dalam tulisan ini adalah: pertama, bagaimanakah kedudukan asas legalitas pasca putusan MK Nomor 003/PUU-IV/2006 dan Nomor 025/PUU-XIV/2016? Kedua, bagaimanakah model asas legalitas yang dapat mengakomodir pemidanaan berdasarkan hukum kebiasaan? Metode penelitiannya menggunakan metode penelitian yuridis normatif. Kesimpulannya adalah: putusan MK Nomor 003/PUU-IV/2006 dan Nomor 025/PUU-XIV/2016 memperkuat kedudukan asas legalitas secara formal, sedangkan perkembangan yurisprudensi mengarah pada penerapan asas legalitas materiil. Model asas legalitas untuk hukum pidana materiil Indonesia adalah asas legalitas formil-materiil. Penerapan legalitas materiil dengan syarat, yaitu: 1. Bersifat kasuistis; 2. Berlaku untuk orang tertentu; 3. Secara substansi masih diakui oleh masyarakat adat dengan ditunjukkan adanya masyarakat dan lembaga adat; 4. Hakim harus bersifat hati-hati karena tujuannya mencapai keadilan substantif; 5. Pengadilan negara bersifat ultimum remidium.Corruption of common enemies that must be eradicated up to their roots. MK decisions No.003/PUU-IV/2006 and No.025/PUU-XIV/2016 affect the eradication of corruption, because with these two decisions corruption is difficult to prove. There has been a difference in the application of the legality principle based on the decision of the constitutional court and jurisprudence. The constitutional court ruling applies the principle of formal legality while jurisprudence develops the principle of material legality. Formal legality prevents treatment of arbitrariness of rulers, while material legality accommodates unwritten law that grows and develops from the Indonesian nation itself. The constitutional court verdict acts as the controller of the application of customary law as a basis for punishment. The formulation of the problem in this paper is: first, what is the position of the legality principle after the Constitutional Court decision Number 003/PUU-IV/2006 and Number 025/PUU-XIV/2016? Second, what is the model of the legality principle that can accommodate punishment based on customary law? The research method uses normative juridical research methods. The conclusion is: MK’s decision Number 003/PUU-IV/2006 and Number 025/PUU-XIV/2016 strengthen the position of the principle of legality formally, while the development of jurisprudence leads to the application of principles of material legality. The legality model for Indonesian material criminal law is the principle of formal-material legality. Application of material legality with conditions, namely: 1. Caseistic; 2. Valid for certain people; 3. Substantially still recognized by indigenous peoples as indicated by the existence of indigenous peoples and institutions; 4. Judges must be careful because the objective is to achieve substantive justice; 5. The state court is ultimum remidium

Abstract

Pemberantasan korupsi menjadi salah satu tujuan dalam pembangunan Indonesia. Sebagai kejahatan yang bersifat luar biasa maka penegakannya dapat bersifat luar biasa pula. Namun penegakan tersebut tidak boleh menimbulkan pelanggaran dan korban bagi narapidana. Salah satunya adalah pemberian hak remisi kepada narapidana korupsi. Tujuan penulisan ini adalah untuk: menganalisis pemberian hak remisi terpidana korupsi dikaitkan dengan hak-hak Narapidana, dan menganalisis pelaksanaan hak remisi terpidana korupsi yang tidak melanggar hak terpidana dalam perspektif pemidanaan integratif berdasarkan Pancasila. Metode yang digunakan adalah metode penelitiannya yuridis normatif dengan pendekatan perundang-undangan. Data yang digunakan data sekunder dengan analisis deskriptif kualitatif dan penafsiran sistematis. Dapat disimpulkan bahwa hak remisi bukan hak asasi manusia tetapi persyaratan remisi yang diatur dalam Pasal 34 A ayat (1) PP Nomor 99 Tahun 2012 mengakibatkan perlakuan yang berbeda antara narapidana korupsi dengan narapidana lainya. Hal ini melanggar Pasal 27 ayat (1) dan Pasal 28 I ayat (2) UUD 1945. Pencabutan hak remisi terpidana korupsi diintegrasikan dalam pidana tambahan.

Abstract

Anak merupakan generasi penerus bagi suatu bangsa. Oleh karena itu harus mendapatkan perlindungan  agar dapat melangsungkan tumbuhkembang secara maksimal.  Di masa pandemi Covid 19, perlindungan bidang kesehatan sangat dibutuhkan oleh anak. Salah satunya melakukan pembelajaran on line. Pengabdian kepada  masyarakat dilaksanakan di SDN Ciketing Udik 3  telah melakukan pembelajaran online. Hal dilakukan oleh sekolah dan siswa karena menghindari penularan Covid 19. SDN Ciketing Udik 3 merupakan alah satu sekolah dasar di wilayah Bantar Gebang Kota Bekasi. Sekolah ini berdekatan dengan TPA Sumur Batu Bantar Gebang, sehingga  masyarakat dan para siswa rentan terhadap dampak dari pembuangan akhir tersebut. Metode yang digunakan dalam melaksanakan pengabdian adalah secara on line, untuk melaksanakan pre test, presentasi materi penyuluhan, konsultasi dan post test. Hasil yang diperoleh adalah adanya peningkatan pengetahuan tentang pandemik covid 19 dari cukup memahami ke arah memahami dari siswa-siswi SDN Ciketing Udik 3. Sarannya adalah pemahaman tentang pandemic covod 19 tetap harus ditingkatkan untuk melindungi anak di bidang Kesehatan.Kata Kunci: perlindungan anak pandemi covid 19
