Abstract

The function of judicial power is to enforce law and justice in the framework of protecting society through justice system based on law in a democratic state of law. One of the important principles of state of law is the existing guarantee of judicial power implementation which is independent, free from the influence of other power to implement justice for law and justice enforcement. Accountability of judge’s performance and Supreme Court institution which is a control form for justice institution becomes an idea concerning the dilema of judicial power independence concept. The supervision of judge’s behaviour by Judicial Commission can hopefully cover the weakness intern supervision by Supreme Court. The judge supervision which can be realised by Judicial Commission includes judicial technic supervision, performance assessment, and judge’s behaviour supervision. This research concerned to the reinforcement of judicial supervision function by judicial commission and Supreme Court as a form of shared responsibility system. The research method used in this research is normative law research method with statute approach, conceptual approach and case approach. Sources of legal materials used are legislation and cases. The results of this study are: the supervision on the judge’s behavior by the Judicial Commission can hopefully cover the weakness of internal supervision by the Supreme Court. It becomes so appropriate that the suprevision on judge is also performed by the Judicial Commission, not only by the Supreme Court. The supervision on judge that can be performed by the Judicial Commission includes the suprevision of judicial technique, performance assessment, and supervision on the judge’s behavior.

Abstract

Public participation is intended the idea of forming laws and regulations does not always have to come from the power holders only, but can emerge from the society. This paper aims to determine the impact of the Constitutional Court’s decision Number 91 PUU XVIII 2020 on the formation of laws in Indonesia, especially in accommodating public participation which is limited to two main issues. First, how is the form of expanding the meaning of public participation in the Constitutional Court’s decision Number 91 PUU XVIII 2020. Second, what is the impact of expanding the meaning of public participation in the formation of laws. This doctrinal legal research uses secondary data. The results of the study show that the form of expanding the meaning of public participation in the Constitutional Court’s decision Number 91 PUU XVIII 2020 is carried out in a meaningful way, by providing guarantees of participation for affected communities and the impact of expanding the meaning of public participation in the formation of laws, namely changing the paradigm of law formation, improvement of regulations and strengthening of public participation as a basis for formal testing.

Abstract

Abstract

Abstract As President whose own the prerogative rights in order to doing governmental affairs, besides Vice President, President also assisted by Minister, it is regulated on Article Number 17 of Constitution of the Republic of Indonesia year 1945. Nor, the authority of appoint the ministers in the cabinet, President also has the authority to appoint the Vice Minister but this authority only can applied on particular circumstances which regulated on Article Number 10 of Law No. 39 Year 2008 about Ministry of State. As the history told, that seat of Vice Minister is has existed since the first year of Presidency of Soekarno, after the Independent Day. Yet, by the time goes the issues about Prime Ministry has regulated in Law No. 39 Year 2008 about Ministry of State and also in Presidential Decree No. 47 Year 2009 about Formation and Organizations of State Ministries. As the factual in reality practical, the appoint of Vice Minister gain the Pros and Contras for the society, because it impress the public the imagination of being political appointee as a gift for support coalition of the cabinet. The existences of Vice Minister is to assisted the Minister with the urgency situation, supposed to assisted in particular circumstances. This article aims to understanding and explain the main issues by using normative constitutional research method and legal approach method. Abstrak Dalam hak prerogatifnya sebagai Presiden dalam menjalankan tugasnya, selain Wakil Presiden, Presiden juga dibantu oleh Menteri. Hal ini diatur dalam Pasal 17 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Selain kewenangannya dalam mengangkat Menteri, Presiden juga memiliki kewenangan dalam mengangkat Wakil Menteri, hal ini diatur dalam Pasal 10 Undang-Undang No. 39 Tahun 2008 Tentang Kementerian Negara. Dalam penerapannya dengan sesuai fakta terjadinya pengangkatan Wakil Menteri menuai Pro dan Kontra bagi para rakyat karena dalam pengangkatannya terkesan bahwa jabatan Wakil Menteri merupakan hadiah politik yang dimanfaatkan dan diberikan hanya untuk para koalisi pendukung kabinet. Dalam menyelesaikan permasalahan-permasalahan tersebut penelitian ini memberikan gagasan melalui rumusan masalah berupa pengkajian hukum mengenai urgensi dan fungsi pengangkatan jabatan Wakil Menteri, serta pertimbangan upaya hukum dalam memberikan batasan dalam pengangkatan Wakil Menteri melalui pengaturan hukum mengenai persyaratan dalam pengangkatannya. Artikel ini bertujuan untuk memahami dan menjelaskan permasalahan-permasalahan yang menjadi pokok utama pembahasan dengan menggunakan metode penelitian hukum normatif dan pendekatan undang-undang, pendekatan konseptual, serta pendekatan kasus. Dengan adanya pengaturan mengenai pengangkatan wakil menteri diharapkan untuk tidak dijadikan sebagai jabatan yang digunakan untuk mengakomodasi koalisi pendukung kabinet alias menjadikan posisi wakil menteri sebagai hadiah politik. Selain itu, dalam penerapannya Presiden selaku kepala pemerintahan semestinya mempertimbangkan syarat yang telah dijelaskan oleh Mahkamah Konstitusi supaya tidak terjadi rangkap jabatan yang dilakukan oleh Wakil Menteri. Maka dengan kesimpulan dalam penelitian ini membuahkan saran yaitu, seharusnya meskipun dalam kewenangannya Presiden mengangkat Wakil Menteri perlu adanya penilaian yang mempertimbangkan kefektivitasan dan keefisiensi keadaan suatu Kementerian dan seharusnya posisi Wakil Menteri harus memiliki syarat yang diatur secara tertulis dalam Peraturan Perundang-undangan. Guna menghindari terjadinya rangkap jabatan bagi Wakil Menteri, seharusnya pemberlakuan syarat Menteri juga berlaku bagi Wakil Menteri. Abstract

Sertipikat hak atas tanah merupakan alat bukti yang kuat sebagaimana dimuat dalam peraturan perundang-undangan, dan sertipikat tersebut sah sebagai alat pembuktian mutlak serta tidak dapat diganggu gugat di kemudian hari. Kalimat “tidak dapat diganggu gugat” tersebut yang kemudian berpotensi melahirkan ketidakadilan bagi pihak ketiga apabila ia merupakan pemilik sah atas bidang tanah yang dijadikan objek pengadaan tanah. Penelitian ini bertujuan untuk mengetahui kesesuaian undang-undang tentang pengadaan tanah untuk pembangunan guna kepentingan umum dengan sistem pendaftaran tanah di Indonesia dan akibat hukum jika ada pihak yang berkeberatan terhadap bukti kepemilikan benda pengadaan tanah untuk pembangunan untuk kepentingan umum. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Metode pengumpulan bahan hukum melalui studi literatur dengan analisis deduktif. Dari hasil penelitian dapat disimpulkan bahwa undang-undang tentang pengadaan tanah untuk pembangunan untuk kepentingan umum tidak sesuai dengan sistem pendaftaran tanah di Indonesia yang menyebabkan jika ada pihak yang berkeberatan dengan sertifikat sebagai bukti kepemilikan. objek pengadaan tanah, maka pihak tersebut akan kehilangan hak atas tanah beserta ganti kerugiannya. kerugian atas pelaksanaan pengadaan tanah apabila pihak yang berkeberatan dapat memberikan bukti-bukti lain yang dapat melemahkan kekuatan pembuktian sertifikat.Kata Kunci: Sertifikat; Pendaftaran Tanah; Pembebasan Tanah.A land title certificate is a strong piece of evidence as stated in statutory regulations, and the certificate is valid as absolute evidence and cannot be contested in the future. The sentence "cannot be contested" then has the potential to give rise to injustice for third parties if they are the legal owners of the plot of land that is the object of land acquisition. This research aims to determine the compatibility of the law regarding land acquisition for development for public purposes with the land registration system in Indonesia and the legal consequences if there are parties who object to proof of ownership of land procurement objects for development for public purposes. The method used in this research is normative juridical using a statutory approach and a conceptual approach. Method of collecting legal materials through literature study with deductive analysis. From the research results, it can be concluded that the law regarding land acquisition for development for the public interest is not in accordance with the land registration system in Indonesia, which causes parties to object to the certificate as proof of ownership. the object of land acquisition, then the party will lose rights to the land along with compensation. losses due to the implementation of land acquisition if the objecting party can provide other evidence that can weaken the evidentiary strength of the certificate.Keywords: Certificate; Land Registration; Land Acquisition.

Abstract

Seiring meningkatnya kasus kekerasan terhadap anak di Kabupaten Demak pada tahun 2020, peran Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak sebagai lembaga yang melindungi anak sangat diperlukan untuk memperkecil kasus anak korban kekerasan. Penelitian ini menggunakan tipe penelitian yuridis sosiologis dengan menggunakan pendekatan undang-undang. Namun, setelah dilakukan penelitian, peran Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak masih kurang maksimal karena keterbatasan fasilitas dan penerapan peraturan yang masih kurang, sehingga menyebabkan belum maksimalnya peran dari Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak. Hasil dari penelitian ini dilihat melalui kewenangan dari Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kaupaten Demak, yaitu melalui upaya preventif dan represif bagi anak untuk mencegah dan menangani anak korban kekerasan dengan meningkatkan sumber daya manusia dan sarana prasarana untuk mendukung fasilitas agar memudahkan masyarakat mendapatkan edukasi dan melakukan pelaporan dengan tujuan pencegahan dini terhadap kekerasan terhadap anak. Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak telah bekerja sama dengan Forum Anak Demak (FADEM) sebagai pelopor kegiatan positif bagi anak di Kabupaten Demak yang didukung oleh kegiatan edukasi mengenai kekerasan oleh Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak agar memberikan pemahaman terhadap anak.Kata Kunci: Anak; Kekerasan; Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak; Forum Anak Demak.As cases of violence against children increase in Demak Regency in 2020, the role of the Demak Regency Women's Empowerment and Child Protection Social Service as an institution that protects children is very necessary to reduce cases of child victims of violence. This research uses a sociological juridical research type using a statutory approach. However, after research was conducted, the role of the Demak Regency Women's Empowerment and Child Protection Social Service was still not optimal due to limited facilities and inadequate implementation of regulations, resulting in the role of the Demak Regency Women's Empowerment and Child Protection Social Service not being optimal. The results of this research are seen through the authority of the Social Service for Women's Empowerment and Child Protection, Demak Regency, namely through preventive and repressive efforts for children to prevent and handle children who are victims of violence by increasing human resources and infrastructure to support facilities to make it easier for people to get education and carry out reporting with the aim of early prevention of violence against children. The Demak Regency Women's Empowerment and Child Protection Social Service has collaborated with the Demak Children's Forum (FADEM) as a pioneer of positive activities for children in Demak Regency which is supported by educational activities regarding violence by the Demak Regency Women's Empowerment and Child Protection Social Service to provide understanding to children.Keywords: Children; Violence; Social Service for Women's Empowerment and Child Protection Demak Regency; the Demak Children's Forum.
