Abstract

Pengadaan barang/jasa bagi keperluan Pemerintah yang menyerap dana APBN/APBD hampir sebesar 60 % akan menciptakan lapangan pekerjaan yang direbut oleh para pengusaha baik pengusaha dalam negeri maupun pengusaha luar negeri karena bangsa Indonesia telah memasuki era globalisasi dan leberalisme perdagangan. Untuk mengantisipasi hal tersebut dengan menerbitkan Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah. Pengadaan barang/jasa pada dasarnya melibatkan dua pihak, yaitu pihak pengguna barang/jasa (pemerintah) dan pihak penyedia barang/jasa (pengusaha), dengan kepentingan yang berbeda yang sulit dipertemukan kalau tidak ada saling pengertian dan kemauan untuk mencapai kesepakatan. Pengadaan barang/jasa dilakukan dengan melalui tahapan proses pengadaan, yang akhirnya penyedia barang/jasa yang terpilih akan menandatangani kontrak dengan pengguna barang/jasa. Kontrak tersebut memuat kesepakatan antara pengguna barang/jasa sebagai Pihak Pertama dan penyedia barang/jasa sebagai Pihak Kedua. Dalam pembuatan suatu kontrak, para pihak seharusnya memiliki kedudukan yang seimbang, karena apabila tidak memiliki kedudukan yang seimbang, maka dimungkinkan terjadinya salah satu pihak akan mendominasi pihak lain. Bagaimana prinsip keseimbangan diimplementasikan dalam kontrak yang telah ditandatangani kedua belah pihak dibidang pengadaan barang/jasa bagi keperluan Pemerintah di Kabupaten Badung ? Dari hasil penelitian diketahui bahwa; pada kontrak pengadaan barang / jasa bagi keperluan pemerintah di Kabupaten Badung, pada awal kontrak (pra kontrak) memang terlihat bahwa posisi tawar para pihak adalah seimbang. Tetapi jika dicermati pada isi kontrak terlihat ada ketidakseimbangan kedudukan. Asas keseimbangan belum diimplementasikan secara baik di Kabupaten Badung. Procurement of goods / services for the needs of the Government that absorb funds APBN / APBD almost 60% will create employment seized by entrepreneurs both domestic entrepreneurs and foreign businessmen because the nation of Indonesia has entered the era of globalization and trade leberalisme. To anticipate this by issuing Presidential Regulation (Perpres) No. 16 of 2018 on Procurement of Government Goods / Services. Procurement of goods / services basically involves two parties, namely the user of goods / services (government) and the provider of goods / services (entrepreneurs), with different interests that are difficult to meet if there is no mutual understanding and willingness to reach an agreement. Procurement of goods / services is done by going through the stages of the procurement process, which ultimately providers of goods / services selected will sign a contract with the user goods / services. The contract contains an agreement between the user of the goods / services as the First Party and the provider of goods / services as the Second Party. In making a contract, the parties should have a balanced position, because if it does not have a balanced position, then it is possible that one party will dominate the other. How is the principle of balance implemented in contracts signed by both parties in the field of procurement of goods / services for the purposes of the Government in Badung regency? From result of research known that; in the contract of procurement of goods / services for government purposes in Badung regency, at the beginning of the contract (pre contract) it is seen that the bargaining position of the parties is balanced. But if you look at the content of the contract there is an unbalanced position. The principle of balance has not been well implemented in Badung regency.

Abstract

The existence of customary rule sanctions in the resolution of the issues of bad credits within village credit institutions in the customary village of Kerobokan has been included as one of banking laws that is legally entitled to receive legal. This research aimed to the positioning of customary law sanctions in resolving bad loans at VCI Kerobokan Customary Village and to know the forms of legal protection for VCI and how are the bad loans of customers from outside the traditional villages in Kerobokan. The method used in this research is normative legal research, namely to conduct library research by reviewing literature and analyzing statutory regulations relating to applicable provisions on VCI. This research found the settlement of the bad credit at the customary village of Kerobokan is manifested into ways. The first through preventive legal efforts, that is to say, the very moment of signing the contracts, the customers are sure to have all their incumbencies. The second is through repressive efforts that must be made on the basis of good faith. The implementation of the civil law is that the form of retribution and customary law from the customary village. Abstract

Pentingnya suatu pembahasan mengenai perlindungan anak pada Kabupaten Gianyar sebagai contoh wilayah layak anak tingkat nasional didasarkan atas pemenuhan hak tumbuh kembang anak sebagaimana diatur dalam UU Perlindungan Anak. Tujuan penelitian ini guna mengungkap efektifitas implementasi Undang-undang Nomor 35 Tahun 2014 Tentang Perlindungan anak dalam pemenuhan hak tumbuh kembang anak di Kabupaten Gianyar serta upaya Dinas Pemberdayaan Perempuan Perlindungan Anak Pengendalian Penduduk dan Keluarga Berencana Kabupaten Gianyar dalam melaksanakan program pemenuhan hak tumbuh kembang pada anak. Penelitian ini merupakan jenis penelitian empiris dengan pendekatan perundang-undangan. Sumber data yang digunakan berupa sumber hukum primer dan sekunder. Teknik pengumpulan data yang digunakan dalam penelitian ini dengan teknik wawancara dan teknik studi dokumen hukum. Dalam mengangkat permasalahannya data dianalisis secara kualitatif yang disajikan dalam bentuk diskriptif. Hasil temuan mengungkapkan efektifitas implementasi Undang-undang Nomor 35 Tahun 2014 Tentang Perlindungan anak dalam pemenuhan hak tumbuh kembang anak di Kabupaten Gianyar, telah berjalan dengan efektif dan memberikan dampak yang baik bagi anak-anak di Kabupaten Gianyar. Upaya Dinas Pemberdayaan Perempuan Perlindungan Anak Pengendalian Penduduk dan Keluarga Berencana Kabupaten Gianyar dengan menyiapkan program-program yang diutamakan untuk meningkatkan perlindungan atas hak anak.

Abstract

Due to the development of law, legal assistance activities especially for the people that were not able to lay in law as well as the more widely in the community, which is now already so developed in Indonesia. As for the laws that regulate clearly about legal aid is law number 16 of the year 2011. Therefore, the formulation of the problem of this thesis are: 1) how the post position of legal aid (Posbakum) in providing service in PTUN Denpasar, 2) is the function of granting legal aid service in Denpasar PTUN. Research methods used to answer the problems is the normative method, a method that uses a variety of legal research legal materials of primary and secondary legal materials such as legislation, legal theory, and can be either the opinions of scholars. Based on the above research, it is very helpful to every person to obtain legal aid in legal proceedings to obtain justice. In this study the authors raised the existence of legal aid Post title (Posbakum) in the courts of the country of Denpasar.

Abstract

This journal is titled Diversion Against Actors Disposing Baby Orok by Children Like adults, children as perpetrators of crimes will also experience a legal process that is identical to adults who commit criminal acts, the meaning of identical words here means almost the same, different only time period and how to handle it. Diversion is the transfer or transfer of the judicial process into an alternative process of settlement of cases, namely through deliberations of recovery or mediation. The problem 1 what is the Judge's consideration for deciding Diversion on Children as Actors? And 2 what is the criminal sanction inflicted on children as perpetrators of criminal offenses by babies? The approach to the problem used in this study, this study uses a type of normative legal research called doctrinal legal research. The problem approach in this research is carried out by using the legislative approach method by examining all laws and regulations relating to the relevant legal events, conceptual approaches that move from the views and doctrines that develop in law, and case approach. Judge's consideration in determining the diversity of perpetrators of childbirth disposal by children, this case is found in case No. 18/Pid.SusAnak/2016/PN.Dps, children are given the opportunity to correct mistakes and be returned to their parents to be guarded and guided and to be fostered so that the child does not do the deed again.

Abstract

Online gambling is a phenomenon that cannot be denied and is found in the community. In promoting online gambling, site owners usually advertise their online gambling sites to internet. Because this is the dissemination and development of online gambling sites is growing rapidly. From the above background, the problem can be formulated as follows: How is the regulation of criminal sanctions against the installer and promotion of online gambling advertisements and What are the criminal sanctions against the installer and promotion of online gambling advertisements The research method used is the type of normative research that is the type of research by conducting its assessment based on legal materials from the prevailing literature and legislation. The legal arrangements for advertisers and promotions of online gambling are regulated in Law Number 11 of 2008 concerning Electronic Information and Transactions in article 27 paragraph 2 which reads: "Everyone intentionally and without rights distributes and or electronic documents containing gambling "Criminal sanctions against advertising and promotion of online gambling advertisements are regulated in article 45 paragraph 1 of Act Number 11 of 2008 concerning Information and Electronic Transactions, namely criminal penalties with a maximum of 6 (six) years and or a maximum fine of Rp.1,000,000,000.00 . (one billion rupiah).

Abstract

This research aims to find out how implementation of the diversion of the perpetrators of the abuse of narcotic drugs by using the method of the approach of restorative justice by involving the perpetrator, the victim, the family of the offender or the victim, community counselors and professionals. The research method used is the normative legal research with approach of legislation, articles as well as the doctrine or the views from experts associated with the diversion and narcotic in children. With regard to the handling of child abuse of narcotic drugs, the problems in this thesis is the arrangement of diversion by law about the criminal justice system of the child and the application of diversion through approach restorative justice in the criminal offence of child perpetrator of abuse of narcotic. The settings regarding diversion here is actually a settling criminal acts with children outside of the criminal justice process. Where the diversion can be carried out against the perpetrator of the crime that the threat of punishment of less than 7 (seven) years and is not a repetition of the crime. Against the application of the abuse of narcotics diversion for children conducted through deliberation in accordance whit the provisions of article 8 of law about the criminal justice system so that children can make a deal with diversion consider the child’s interests, in this case intended to avoid and keep children from the judicial process. In terms of the results of the diversion agreement already agreed upon with the parties where the implementation of the outcome of the diversion agreement would of course also have to be monitored both from the elderly, the environment, and investigators also rehabilitation center to ascertain if the result of the diversion deal was already done by the child and reported to the Chairman of the District Court where the implementation of such diversion is implemented.

Abstract

This study aims to obtain empirical evidence regarding the effect of profitability, good corporate governance, and disclosure of corporate social responsibility on firm value. The research was conducted on oil palm plantation companies listed on the Indonesia Stock Exchange for the 2016-2020 period. Purposive sampling is the technique of determining the sample chosen in this study and obtained a sample of 13 companies with a sample of 65 observations. The data analysis technique used is multiple linear regression analysis. Based on the research results obtained evidence, profitability has a positive and significant effect on firm value, good corporate governance has a positive but not significant effect on firm value, and disclosure of corporate social responsibility has a negative and insignificant effect on firm value. Abstract

Putusan Mahkamah Konstitusi No. 18/PUU-XVII/2019 tanggal 06 Januari 2020, merupakan sebuah putusan fenomenal yang menghapus kelembagaan parate eksekusi sebagaimana tercantum dalam Pasal 15 Ayat (2) dan (3) Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Terhadap putusan ini diajukan kembali oleh pihak ketiga dan diputus oleh Mahkamah Konstitusi dengan putusan No. 2/PUU-XIX/2021 tanggal 31 Agustus 2021. Kedua putusan tersebut mengeliminasi kedudukan parate eksekusi dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Parate eksekusi merupakan legalitas yang dimiliki lessor dalam upaya melakukan eksekusi bila lessee wanprestasi. Kedudukan parate eksekusi sebagai pranata hukum jaminan pasca putusan Mahkamah Konstitusi merupakan permasalahan hukum dalam penarikan jaminan, yang secara yuridis belum dimiliki oleh lessee. Dari permasalahan diatas, maka tujuan dalam penulisan ini hendak mengkaji kedudukan parate eksekusi pasca putusan Mahkamah Konstitusi No. 18/PUUXVII/2019 dan No. 2/PUU-XIX/2021 terhadap hak eksekutorial lessor berdasarkan pranata parate ekekusi. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa kedudukan parate eksekusi sebagaimana diatur Pasal 15 Ayat (2) dan (3) UndangUndang Nomor 42 Tahun 1999 tentang Jaminan Fidusia telah dieliminasi dan eksekusi jaminan harus berdasarkan kesepakatan dengan debitur yang telah mengakui wanprestasi atau mengajukan permohonan pelaksanaan eksekusi kepada Pengadilan Negeri.

Abstract

In Indonesia, to date, the world of children has become very concerning. This is not in words, but there is a fact that does exist and should receive serious attention. This is evidenced by the growing number of non-governmental organizations caring about the fate of Indonesian children, and there is good faith in the government to overcome the situation by issuing stricter rules and regulations to ensure the protection for children. This study examines the legal arrangements for perpetrators of criminal acts of sexual harassment against minors and the legal sanctions. This research is a legal research and the approach used is a normative juridical approach that is descriptive analytic. The data collected comes from the prevailing laws and regulations, which are analyzed quantitatively and then interpreted by deductive method. Sexual harassment appears as a form of sexual act or discourse in which an adult seeks sexual gratification with a minor. Sexual abuse of a child can include contact or interaction between a child and an adult, wherein the child is exploited for sexual stimulation by the offender or another person who is in a position of power or control over the victim, including inappropriate physical contact, making pornography or showing adult genitals to children. Sanctions for sexual harassment are strictly regulated in the Criminal Code, namely in Articles 287, 290, 293, 294, and 295. Meanwhile, according to the Child Protection Law no. 23 of 2002, it is regulated in articles 78, 82 and 88. In all of these articles, it is explained about the criminal provisions and the types of sanctions given to the perpetrators of the sexual harassment. The sanctions given are in the form of imprisonment and fines.
