Abstract

This study examines the disputed decisions made by the Constitutional Court of the Republic of Indonesia on the election of the Regent and Deputy Regent of Yalimo Regency, Papua Province, in 2020 that do not adhere to the principle of permanent and final legal force. The Constitutional Court's decision on the dispute over the election of the elected Regent and Deputy Regent resulted in a lengthy case due to the possibility of re-election, which still resulted in general election disputes. The author discusses the consequences of re-election, which has the potential for ongoing disputes at the Constitutional Court of the Republic of Indonesia, as well as non-compliance with the principle of final punishment, which has permanent legal force from the standpoint of fairness and justice. Findings from the study of the proposed candidate having been sentenced by the court, as well as the validity of the vote count results in the District that has been declared valid and not re-voted in the Constitutional Court Decision Number 97/PHP.BUP-XIX/2021 (Study of Constitutional Court Decision Number 145/PHP BUP-XIX/2021) are also presented. According to this study, in the dispute over the election of Yalimo's regent and deputy regent, the judge decided on the same case, which had permanent legal force and violated the principle of legal certainty.

Abstract

This qualitative article analyzes the idea of human rights as inalienable rights. Long before modernity changed the world, it signed many agreements to establish human rights, particularly those governing the boundaries of the authority of leaders and citizens. Although moral assumptions are involved, they have no significant impact on its enforcement. Thus, along with its limited capability, the concept of human rights is solely a decorative element of the constitution and legal framework. Under such circumstances, recognizing the significance of understanding human rights needs an all-out concerted effort, mainly from a universal perspective and a legal enforcement effort. The study seeks to determine why human rights enforcement in Indonesia is ineffective and contrary to the concept of universal human rights. The author employs qualitative research with a descriptive method to address this issue. This research is also desk (library research), as I entirely based it on library data sources on library research. In addition, it employs literature related to the enforcement of Human Rights (HAM) from a legal perspective. This study concludes that human rights enforcement in Indonesia is weak because of flaws in the law and the state's lack of political will to enforce human rights and obligations. These changes include ensuring that the enforcement of human rights is absolute and not influenced by political perspectives and motivations and thus guarantees human freedom. The author suggests that establishing a more effective institution and agency is a more critical step in the coming years.

Abstract

Many government and non-governmental entities have already introduced community outreach to prevent corrupt practices by raising public awareness and encouragement in recent years. The issue would be that the anti-corruption consultation could empower society to stop corruption. The primary aim of such counseling would be to create a better understanding and conformance to village officers concerning types of corruption, the dangers of corruption, the law, the risks associated with crime, and alternative prevention. The method used in this outreach is a participatory method that includes lectures, discussions, and questions and answers. I aim this community outreach at 343 Village Heads in Purworejo Regency, Central Java, Indonesia for the 2019-2024 term of service. This program facilitates participants about anti-corruption measures. Despite some challenges that village heads face in managing village funds, these outreach efforts have significantly affected promoting anti-corruption efforts in Purworejo Regency. An effective anti-corruption intervention that involves village officials is a step toward developing anti-corruption understanding at the village level and transforming it into an Anti-Corruption Village. As a result, the village head must be one of the anti-corruption components, laying the groundwork for a more robust National Integrity System.

Abstract

It is difficult for women to become police officers in Indonesia. One of the mandatory requirements is to become a virgin. Women who are no longer virgins cannot pass the selection. However, if the woman's hymen is damaged not because of sexual intercourse but because of an accident, she still hopes to become a police officer. This study aims to examine the virgin criteria as a requirement to become a policewoman in Indonesia. This quantitative study examines the virginity for police admission based on virginity requirements from a human rights perspective and the concept of innocence. Inspired by the idea of purity from Hanne Blank that celibacy does not reflect a known biological necessity and provides no demonstrable evolutionary advantage. This article says that police virginity testing is not essential and makes up discrimination of women's opportunity to become a police officer because there is no correlation between virginity and police duty. This article evaluates this activity performed Indonesian police force from the lights of human rights. It criticizes the policy development specification of Indonesia which is even poor than India and Muslim countries as even in this country women empowerment is prioritized and respected. This country is needed to incorporate changes in this policy.

Abstract

News of the racist incident that occurred at the Papuan Student Dormitory in Surabaya on August 16, 2019, then spread so quickly and massively, especially through social media. The purpose of the research was to find out the media literacy of Papuan students related to acts of racism. This study uses a qualitative method with data collection techniques consisting of observation, in-depth interviews, documents and focus group discussion. The results showed that racist is an act of abuse against ethnic Papuans who violate human rights and a racist is an act that violates religious teachings.  Racists are considered to be degrading acts of Papuans as beings created by God who have human rights brought from birth regardless of racial, ethnic, and physical differences and no religion allows the act of harassing or insulting fellow human beings.

Abstract

This article explains the differences and similarities between the British legal system and German Law and reflects their application to Indonesian law which was influenced by the swift flow of legalism. The writing uses a normative juridical method with a comparative law approach. Authors use English common law sources along with their application and German civil law along with their application under the stuffenbau theory. The difference between these legal systems is the common law system prioritizes precedent application, while the civil law system prioritizes statutes. Furthermore, these systems also have similarities whereas both systems are applying customs, doctrines, and legal interpretations as to their complementary legal instruments. The authors address that Indonesia needs to apply methods beyond the statute approach, and Indonesia shall take into account customs, doctrines, and interpretations to achieve justice.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum terhadap perempuan dalam masalah penegakan Hak Asasi Manusia (HAM) pada kasus pidana. Diskriminasi yang dialami perempuan pada kasus pidana menjadi perhatian penting dalam masalah penegakan HAM. Bentuk perlakuan yang tidak manusia dan merendahkan harkat dan martabat manusia yaitu kekerasan verbal termasuk didalamnya pelecehan seksual dan kekerasan fisik. Bentuk dari penyiksaan tersebut dengan memanfaatkan organ seksualitas dan reproduksi perempuan berupa penelanjangan dan pemerkosaan. Perempuan yang berhadapan dengan kasus pidana masih mengalami kekerasan serta direnggut harkat dan martabatnya sebagai manusia yang dilakukan justru oleh Aparat Penegak Hukum (APH). Negara harus melindunginya melalui kebijakan hukum yang ketat untuk melindungi hak-hak perempuan dalam perspektif hukum emansipatif. Untuk keberhasilan perlindungan hukum terhadap perempuan ini tentunya harus didukung oleh semua pihakDari penjelasan tersebut, dapat ditarik kesimpulan, bahwa perhatian terhadap perlindungan hukum terhadap perempuan pada kasus pidana, yaitu perempuan sebagai terlapor, tersangka, terdakwa, ataupun terpidana pelaksanaan perlindungan hukum terhadap perempuan belum sepenuhnya tercapai seperti harapan. Perlindungan hukum terhadap perempuan pada kasus pidana penting untuk diperhatikan karena perempuan juga memiliki hak-hak yang melekat pada dirinya harus dilindungi.

Abstract

Rendahnya pengetahuan masyarakat untuk mengelola sampah merupakan salah satu kendala yang dihadapi oleh masyarakat kota Bekasi, khususnya masyarakat yang tinggal di Kelurahan Bojong Menteng. Rendahnya pengetahuan dan kesadaran masyarakat tentang pengolahan sampah menjadi salah satu kendala yang dihadapi masyarakat setempat. Akibatnya, sampah organik yang berasal dari rumahtangga tidak dikelola dengan baik dan dibuang ke kali yang ada disekitar perumahan Bojong Menteng. Rendahnya kesadaran disertai dengan pertambahan penduduk dan kebiasaan membuang sampah dikali menjadi salah satu faktor menumpuknya sampah di kali Bojong Menteng. Pengolahan sampah rumahtangga sebagian dilakukan dengan cara membakar ditempat sampah dan sebagian dikumpulkan dan ditempatkan di Tempat Pembuangan Akhir (TPA). Salah satu upaya meningkatkan kesadaran dan pengetahuan masyarakat untuk pengelolaan sampah adalah dengan cara memberikan penyuluhan kepada masyarakat mengenai cara pengelolaan sampah, tindakan yang dilakukan terhadap pihak yang membuang sampah sembarangan serta prosedur pelaporan kepada pihak yang berwenang menangani pencemaran lingkungan.   Program penyuluhan hukum sadar lingkungan ini dilakukan oleh tim pengabdian masyarakat Program Magister Hukum Universitas kristen Indonesia dengan metode pemaparan tentang cara pengelolaan sampah kepada perwakilan masyarakat Kelurahan Bojong Menteng, Pengurus Karang Taruna dan staf Kelurahan Bojong Menteng, Kota Bekasi.

Abstract

Tujuan dari tulisan ini adalah untuk mendeskripsikan dan mengevaluasi pelaksanaan pengabdian masyarakat yang dilakukan penulis dari Program Pascasarjana Universitas Kristen Indonesia Jakarta untuk membangun kesadaran masyarakat terhadap pendidikan dan kesehatan, dua bidang yang terlupakan yang menjadi sasaran pengabdian ini bagi suku Hmong di Ban. Nong, Distrik Hadxayfong, Prefektur Vientiane, Laos. Langkah-langkah dan strategi yang dipilih untuk penjangkauan masyarakat Hmong ini mencakup survei peluang layanan kesehatan dan pendidikan serta rujukan mitra yang menjadi dasar strategi tersebut. Strategi yang dilakukan antara lain penyuluhan kesehatan gigi dan kuku serta sosialisasi pentingnya bersekolah khususnya bagi anak yang disampaikan melalui pendidikan khususnya keluarga muda (penyuluhan kesehatan gigi dan kuku serta penyuluhan hakikat pendidikan) yang dilakukan melalui presentasi di hadapan para peserta. peserta dengan dukungan World Prayer International. Kami melakukan sosialisasi selama satu minggu dan memberikan edukasi dan demonstrasi kepada sekitar 100 peserta, termasuk ibu dan anak, tentang cara menyikat gigi dan merawat kuku yang benar agar terbebas dari penyakit. Rata-rata 60% peserta yang mengikuti penyuluhan ini mengaku memahami cara menyikat gigi yang benar, cara merawat dan membersihkan kuku, serta pentingnya pendidikan bagi anak. Kesadaran akan pentingnya menjaga kesehatan gigi dan kuku meningkat sebesar 10% setelah mereka mendapatkan edukasi. Strategi sosialisasi dan pelibatan masyarakat khususnya penyediaan sikat gigi dan gunting kuku membuat sosialisasi menjadi lebih efektif karena peneliti mempraktekkannya langsung di rumah sakit. depan para peserta.
