Abstract

In the voting process at elections, the people who vote in the elections believe they can influence the actions of those who are authorized to make binding decisions. In other words, they believe that what they are doing has a political effect (political efficiency). So it is an important thing to protect the political rights of all citizens, including the voting rights owned by groups of people with disabilities. Based on the above background, there are at least two problem formulations that can be used as a fence in this research, namely What are the problems and violations of the rights of groups of persons with disabilities in the 2019 General Election ?; and How are the rights of groups of persons with disabilities protected in the 2019 General Election in West Sumatra?

Abstract

The implementation of the act of number 25 years 2009 about the public services in an effort to create the principle of good governance ( good governance ) in the province of Riau and Jakarta west important because of anything services for the community of course there has been a the command of implementation , procedures and authority so that the recipient the service will be satisfied for what he received . The implementation of law number 25 years 2009 concerning public services in west sumatra still has not been effective, because of year to year still happens reporting by the community for government agencies, soe, who do not give public services such as delays , abuse, received in exchange for money and services and goods. Constraints that have been faced in the delivery of public among other: the low the quality of public services , public service system not clearly regulated , overlapping authority , the low external supervision from the community , the ineffectiveness of the decentralised system .The efforts being done to deal with the obstacles is besides built supervision external by the community through active provided a report on the ombudsman representatives to Riau and Jakarta , so internal control each agencies needs to be improved the system , if a long considered be unable to improve the quality of public services . The concept of public services ideal is well applied by ombudsman when is supervision public service done with activities investigation initiative , supervision public services , systemic investigation , and the compliance.

Abstract

Applicable local Pariaman Number 20 in 2012 About Providence health coverage Sabiduak Sadayuang (JK-SS) was established by the Government of Pariaman as a policy area in order to improve the policies of the Central Government to enact public health assurance program. Regulation of this area aims to ensure the public health Pariaman thoroughly. Health coverage in this area is not only intended for poor communities in Pariaman, but also intended for the children of Pariaman. In the provisions of article 5 paragraph (1) of the Regulation region of Pariaman number 12 in 2012 says that the audience is any person and or family members of citizens of the city of Pariaman who have paid dues or contributions.

Abstract

This study aims to discover the effect of applying Four Square Graphic Organizeron students’ achievement in writing descriptive text. It was conducted by usingexperimental research design. The population of this research was the seventh(VII) grade students of SMP Sultan Iskandar Muda Medan with four parallelclasses. The samples of the research were two classes divided into two groups,experimental and control group which were chosen by using random samplingtechnique. Fifty students were taken as the samples. The experimental group wastaught by using Four Square Graphic Organizer, while the control group wastaught by using freewriting technique. The instrument for collecting the data was awriting test. Pearson Product Moment formula was applied to obtain the reliabilityof the test. Based on the calculation, it shows that the reliability of the test was0,84 categorized as high reliability. Then, after analyzing the data, it was foundthat the value of tobserved was 3,66 with the degree of freedom (df)=48 at the levelof significance p(0,05) = 2,01. It means that tobserved is higher than ttable (3,66 >2,01). The result of this study shows that Four Square Graphic Organizer has asignificant effect on students’ achievement in writing descriptive text.

Abstract

Mahkamah Kontitusi melalui putusannya Nomor 91/PUU-XVIII/2020, menegaskan bahwa konsep demokrasi harus ada dalam proses pembentukan Undang-Undang. Frasa meaningful participation yang disematkan MK dalam putusannya kemudian diejawantahkan dalam pasal 96 undang-undang No 13 tahun 2022 tentang Pembentukan Peraturan Perundang-Undangan yang memberikan ruang partisipasi masyarakat, baik masyarakat yang terdampak langsung dan/atau mempunyai kepentingan dengan pemberian aspirasi secara luring (luar jaringan) ataupun daring (dalam jaringan). Namun, UU 13/20022 tidak secara spesifik mengatur terkait mekanisme pemberian aspirasi masyarakat. Oleh karena itu, ketentuan terkait partisipasi bermakna perlu diatur lebih spesifik untuk menciptakan kepastian hukum. Dalam penelitian ini, penulis menggunakan metode penelitian hukum normatif, sehingga ditemukan solusi bahwa salah satu metode yang dapat diaplikasikan oleh pemerintah dalam menjamin meaningful participation dalam pembentukan peraturan perundang-undangan adalah Regulatory Impact Assessment.

Abstract

Pasal 24A ayat (2) UUD 1945 menentukan kualifikasi Hakim Agung sebagai berikut: "Hakim Agung harus memiliki integritas dan kepribadian yang tidak tercela, adil, professional, dan berpengalaman di bidang hukum." Dalam penelitian hukum normatif ini, Penulis akan mengkaji dan menganalisis bagaimana model rekrutmen hakim sebagai penyelenggara kekuasaan kehakiman menurut konsepsi negara hukum. Jika dikaitkan dengan kekuasaan kehakiman maka setidaknya terdapat beberapa ciri negara hukum yang terkait langsung dengan kekuasaan kehakiman, yaitu: (a.) Perlindungan konstitusional; (b.) Badan kehakiman yang bebas dan tidak memihak; (c.) Hak-hak Asasi Manusia; (d.) Pemisahan atau pembagian kekuasaan. Terdapat beberapa model yang dikenal dalam proses judicial appointment, antara lain, Model Hamilton yang mempunyai alat ukur untuk menciptakan kekuasaan hakim yang merdeka dan mandiri dan Model Ginsburg yang merangkum empat model pengisisan jabatan hakim yang diterapkan pada negara-negara modern. Proses rekrutmen hakim menjamin hadirnya hakim yang berkualitas, dan proses rekrutmen hakim harus mampu menjamin kemerdekaan kehakiman pada setiap tingkat lembaga peradilan tersebut. UUD 1945 mengatur mekanisme rekrutmen Hakim Agung dan Hakim Konstitusi, yang membentuk calon hakim pada kedua puncak kekuasaan kehakiman akan melibatkan lembaga-lembaga yang berbeda. Penelitian hukum ini akan menganalisis putusan MK Nomor 43/PUU-XIII/2015 terjadi perubahan terhadap pola rekrutmen hakim pada lingkungan Peradilan Umum, Peradilan Agama, dan Peradilan Tata Usaha Negara.

Abstract

Artikel ini berusaha menjelaskan bahwa konstitusi telah memberikan ruang konstitusional dalam menghadapi kondisi darurat. Besarnya kekuasaan yang diberikan oleh konstitusi kepada negara di tengah keadaan darurat menimbulkan sejumlah kekhawatiran masyarakat tentang pelanggaran dan penyalahgunaan kekuasaan. Pelanggaran dan penyalahgunaan kekuasaan ini dapat dilacak melalui sejumlah potret problematika pembentukan peraturan perundang-undangan dan kebijakan yang lahir pada masa pandemi. Perundang-undangan dan kebijakan negara yang dibentuk pada masa pandemi tidak terlepas dari berbagai konflik dan menuai kritik keras diruang publik. Mulai dari kebijakan yang dianggap tidak responsif dan tidak fokus dalam menangani wabah Covid-19. Hingga memiliki cacat material dan formal dalam proses pembentukannya. Pasalnya, meski konstitusi telah memberikan ruang konstitusional dalam menghadapi kondisi darurat, Pemerintah belum mampu menangani wabah ini secara efektif dan signifikan, ditambah dengan kewenangan yang cukup besar yang diberikan konstitusi kepada negara di tengah keadaan darurat. Hal itu menimbulkan sejumlah kekhawatiran publik tentang pelanggaran dan penyalahgunaan kekuasaan. Oleh karena itu, penelitian ini mengkaji dan mendeskripsikan apa saja permasalahan peraturan perundang-undangan negara selama masa pandemi Covid-19 yang menjadi problematika dan mencoba menjelaskan bagaimana seharusnya negara membuat kebijakan di tengah keadaan darurat.

Abstract

Legal politics is necessary for examining the changes that need to be made to Law Number 16 of 2004 concerning the Prosecutor's Office to meet the needs of society. An analysis in Article 33 of the aforementioned law, which shows how crucial law enforcement agencies are in collaborating in the implementation of state power. The purpose of this article is to understand the legal politics of change and the implications of changes in collaboration regulations between the Prosecutor's Office and other law enforcement agencies and institutions. This article uses a Normative Juridical method. The research findings are as follows: first, the legal politics of the changes in Law Number 16 of 2004, which became Law Number 11 of 2021 on amendments to Law Number 16 of 2004 concerning the Prosecutor's Office, especially in Article 33 related to the collaboration of the Republic of Indonesia's Prosecutor's Office with other law enforcement agencies and institutions, were established to determine the position of the Prosecutor's Office in law enforcement in Indonesia. Therefore, the Prosecutor's Office collaborates with other law enforcement agencies and institutions to achieve the goals of the Prosecutor's Office itself. Second, the implications of the changes in Article 33 of the aforementioned law have an impact on the role of the Prosecutor's Office in the performance of prosecution, which can collaborate with various national and international law enforcement agencies, including institutions or organizations. Collaboration between the Prosecutor's Office and other law enforcement agencies can be seen in Memorandums of Understanding (MoUs).
