Abstract

The Regional Offices of the Ministry of Law and Human Rights in each region have an important role in the harmonization of regional regulations in accordance with the legal hierarchy. Harmonization of law is an effort to create a harmony, suitability and compatibility to balance the legal norms. One of the agencies that has this role is the Ministry of Law and Human Rights to each region. The results of the study show that in relation to the duties and functions of the Regional Office, basically the duties and functions of the Regional Office in preparing regional regulations are in line with the provisions of Law Number 12 of 2011 concerning the Establishment of Legislation. the invitation, but the involvement of the Regional Office of the Ministry of Law and Human Rights is limited and passive waiting for the local government and DPRD to participate. In an effort to increase the role of the Regional Office of the Ministry of Law and Human Rights in the process of drafting regional regulations, it is necessary to formulate a rule for implementation that regulates in detail the mechanism for the preparation of regional regulations involving the Regional Government, DPRD and Regional Office of the Ministry of Law and Human Rights. optimizing the preparation of quality regional regulations.

Abstract

Applicable local Pariaman Number 20 in 2012 About Providence health coverage Sabiduak Sadayuang (JK-SS) was established by the Government of Pariaman as a policy area in order to improve the policies of the Central Government to enact public health assurance program. Regulation of this area aims to ensure the public health Pariaman thoroughly. Health coverage in this area is not only intended for poor communities in Pariaman, but also intended for the children of Pariaman. Abstract

After the Amendment of 1945 Constitution, democracy and Rule of Law become two concepts. They are the concept on how to run the power and run the goverment of Indonesia. Both concept, are interconected among each others and can not be separated, because on one side, democracy gives the grounds and mechanisme of power based on the principles of togetherness and equality, while on the other side, rule of law gives guide lines that goverment in the state is not a human but the law of human being. The both of concepts have relation each other. This article are trying to connected and related both concepts in an unseperated function.

Abstract

In the history of the formation of laws and regulations in Indonesia, the Law of the Republic of Indonesia Number 11 of 2020 Concerning Job Creation, is a product of laws and regulations that used the Omnibus Method for the first time in drafting its laws. The Mechanism for Forming Law Number 11 of 2020 refers to Law of the Republic of Indonesia Number 12 of 2011 concerning Formation of Legislation and as amended by Law of the Republic of Indonesia Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning Formation of Legislation, these two laws do not regulate the Omnibus Method. Arrangements related to the new Omnibus Method are included in the Law of the Republic of Indonesia Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation.

Abstract

AbstractThe personal judges of the Constitutional Court are the main pillars for realizing the independence and impartiality of the Constitutional Court. The composition of the nine judges at the Constitutional Court of the Republic of Indonesia, proposed three people by each state institution namely the People's Representative Council (DPR), the President, and the Supreme Court (MA). The involvement of the three state institutions in the mechanism for filling the positions of Constitutional Justices has the potential to trigger a conflict of interest (especially in the DPR and the President) which has an impact on the credibility and independence of the appointed Constitutional Justices. The research is doctrinal research by conceptual approach and statute approach. Results study explains that the dynamics of politics in Indonesia do not mature so that the guardian of Constitutional Court judges is threatened. Therefore, to avoid this offense, it is necessary to form an ad hoc committee in the process of selecting candidate judges for the Constitutional Court as a form of implementing independence. AbstrakPersonal hakim Mahkamah Konstitusi merupakan pilar utama untuk mewujudkan independensi dan imparsialitas Mahkamah Konstitusi. Komposisi sembilan hakim pada Mahkamah Konstitusi Republik Indonesia, diajukan tiga orang oleh masing-masing lembaga negara yakni Dewan Perwakilan Rakyat (DPR), Presiden, dan Mahkamah Agung (MA). Keterlibatan ketiga lembaga negara tersebut dalam mekanisme pengisian jabatan hakim konstitusi, berpotensi akan memicu terjadi konflik kepentingan (terutama di DPR dan Presiden) yang berdampak pada kredibilitas dan independensi hakim konstitusi yang ditetapkan. Metode penelitian ini menggunakan penelitian hukum normatif (doctrinal research) dengan pendekatan analitis (conceptual approach), pendekatan undang-undang (statute approach). Hasil penelitian ini menjelaskan bahwa dinamika perpolitikan di Indonesia tidak kunjung dewasa sehingga terancamnya marwah hakim Mahkamah Konstitusi. Oleh sebab itu, menghindarkan ketersinggungan tersebut maka perlunya membentukan panitia ad hoc dalam proses pemilihan calon hakim Mahkamah Konstitusi sebagai bentuk implementasi independensi.

Abstract

The Nagari Government is the lowest government and the implementation of the Nagari government is based on the traditions and socio-culture of the people of West Sumatra. The form of the Nagari Government has been regulated through the West Sumatra Provincial Regulation Number 7 of 2018 concerning Nagari. The development that occurs from a homogeneous society to a heterogeneous society has the potential for social change both internally and externally. This social change is influenced by various factors, including population transmigration, marriage, and the economy that forces people to settle in the area. The increase in heterogeneous society certainly gives rise to heterogeneous villages in West Sumatra. The results of the first study, the form of legal construction of the village administration policy can be done in an argumentum a contrario. This legal construction is the right model where in order to achieve all the interests of the community in the local nagari, legal discovery can be made by agreement (buek arek) with due regard to local wisdom. Second, the policies in the Nagari Government are special and different from the general village regulations and are based on the values ​​that have been integrated into the Nagari environment..

Abstract

In Indonesia, the understanding of rule of law cannot be separated from the influence of the development of good thinking fromrule of law northe rule of law, but still has distinctive characteristics as shown in the 1945 Constitution of the Republic of Indonesia. The method for forming laws and regulations in Indonesia uses codification and sectoral. The codification method is the preparation of legal regulations in a book of laws in writing including collecting scattered legal provisions, then arranged systematically. There are various problems that arise in the formation of legislation in Indonesiaover regulations, overlapping regulations, multiple interpretations, ineffective, and sociologically problematic. Government encouragement in the progress of the Indonesian economy through the application of the methodlaw to all namely the Job Creation Law. This research is a legal research (doctrinal research) with a conceptual approach (conceptual approach) and the legal approach (statues approach). The results of this study explain that MethodAll Law in the formation of laws and regulations it has been regulated through Law Number 13 of 2022 where the purpose of the Omnibus Law is to link a rule with other related rules as intended to be integrated. Second, the Omnibus Law as an effort to overcome hyper regulation as a whole. Simplification as to avoid overlapping between regulations and other regulations

Abstract

Old-Age Security (JHT) is an employment social security program that has the objective of providing cash benefits through a lump sum payment when participants enter retirement age, pass away, or experience permanent total disability. Where this mechanism is the embodiment of the mandate of Article 28H Paragraph (3) of the 1945 Constitution. However, the practice of implementing JHT has experienced several problems, for example changing implementing regulations in a short time, which raises two problems: First, regarding the dynamics of JHT arrangements in Indonesia, and the perspective of Human Rights in the implementation of JHT. This study uses a normative juridical method with library data collection techniques. This study concludes that the regulatory changes that have occurred in the regulations surrounding JHT are the government's efforts to adapt regulations to developments so that workers can enjoy JHT, but the government is not optimal in disseminating regulations to JHT beneficiaries. Meanwhile, from a human rights perspective, it can be concluded that the government is already present in realizing the fulfillment of the right to social security through JHT, which is through a legal umbrella in the form of Government Regulations and Ministerial Regulations. It's just that changing legal products in a short time is the main obstacle that has resulted in JHT not running optimally, so that workers have not been able to fully enjoy the fulfillment of their rights to JHT. Therefore, this study concludes that the government needs to create permanent regulations that do not require changes in a short time to fulfill JHT rights as a form of legal certainty.

Abstract

The precedent of dismissal and replacement of Constitutional Court Judge Aswanto during his term of office by the proposing body (DPR) is the first time this has occurred in the history of filling the position of Constitutional Court Judge in Indonesia. Does the DPR unilaterally have the authority to dismiss or...recall against Constitutional Judges originating from their proposals during their term of office. The research results explain thatLThe proposing body can renominate or replace the constitutional judge from his proposal during his term of office if the constitutional judge from his proposal is dismissed during his term of office by the President first at the request of the Chairman of the Constitutional Court based on the reasons stated in the Law on the Constitutional Court. However, the proposing institutions (DPR, Supreme Court and President) cannot unilaterally withdraw or recall constitutional judges based on their proposals.
