Abstract

Studies about the politization of academic senate at higher education institutions in corruption control and prevention system are scarce. Framed by collective action, power balance, and bureaucratic transparency theories, this research aims to examine the effect of power imbalance due to double position of structural and academic senate leaders, and the dominance of ex-officio elements regarding to conflict of interests and corruptive behavior. The result reveals, the conflict of interests elicited by the power imbalance generated corruptive behavior in HEIs, especially in terms of policy corruption. In practical terms, nepotism and transactional patterns were the most common acts of corruption.   Abstrak Studi terkait politisasi senat akademik dalam sistem pengawasan dan pencegahan korupsi di perguruan tinggi masih sangat jarang dilakukan. Sehingga, penelitian ini bertujuan menguji dampak ketidakseimbangan kekuasaan akibat praktik rangkap jabatan pimpinan struktural dengan pimpinan senat akademik, dan dominasi unsur ex-officio dalam komposisi senat akademik terhadap konflik kepentingan dan perilaku korupsi di perguruan tinggi. Teori yang digunakan adalah teori tindakan kolektif, keseimbangan kekuasaan dan transparansi biro-krasi, Pengumpulan data dilakukan secara daring dan dianalisis menggunakan teknik des-kriptif, t-test, ANOVA, mediasi dan moderasi Hayes PROCESS. Hasil penelitian menyimpulkan, konflik kepentingan akibat ketidakseimbangan kekuasaan menyebabkan munculnya perilaku koruptif di perguruan tinggi, khususnya di ranah kebijakan. Sedangkan di ranah praktis, nepotisme dan pola transaksional menjadi dua perbuatan korupsi yang paling sering terjadi di perguruan tinggi.

Abstract

The National Guidelines of State Policy known to the Indonesian people as Garis Besar Haluan Negara (GBHN) used to be a set of political, economic and social principles enacted every five years by the People’s Consultative Assembly or Majels Permusyawaratan Rakyat (referred to as MPR hereafter) that had to be followed by both central and regional governments for the prosperity of Indonesia and the Indonesian people. However, since the amendments to the 1945 Constitution (1999-2002), which stripped MPR of much of its power, this national development planning scheme was abolished and decentralization was established throughout Indonesia. Nevertheless, in recent years more voices are being heard demanding the reinstatement of the National Guidelines. This paper discusses the issue of national development planning at the central government level. Drawing on the example of the Indonesian National Guidelines of State Policy, the paper argues that a possible return to the old guideline policy could be counter-productive as it would harm the decentralization process, political freedom, democracy, human rights, and the rule of law in Indonesia.

Abstract

The implementation of the act of number 25 years 2009 about the public services in an effort to create the principle of good governance ( good governance ) in the province of Riau and Jakarta west important because of anything services for the community of course there has been a the command of implementation , procedures and authority so that the recipient the service will be satisfied for what he received . The implementation of law number 25 years 2009 concerning public services in west sumatra still has not been effective, because of year to year still happens reporting by the community for government agencies, soe, who do not give public services such as delays , abuse, received in exchange for money and services and goods. Constraints that have been faced in the delivery of public among other: the low the quality of public services , public service system not clearly regulated , overlapping authority , the low external supervision from the community , the ineffectiveness of the decentralised system .The efforts being done to deal with the obstacles is besides built supervision external by the community through active provided a report on the ombudsman representatives to Riau and Jakarta , so internal control each agencies needs to be improved the system , if a long considered be unable to improve the quality of public services . The concept of public services ideal is well applied by ombudsman when is supervision public service done with activities investigation initiative , supervision public services , systemic investigation , and the compliance.

Abstract

Applicable local Pariaman Number 20 in 2012 About Providence health coverage Sabiduak Sadayuang (JK-SS) was established by the Government of Pariaman as a policy area in order to improve the policies of the Central Government to enact public health assurance program. Regulation of this area aims to ensure the public health Pariaman thoroughly. Health coverage in this area is not only intended for poor communities in Pariaman, but also intended for the children of Pariaman. In the provisions of article 5 paragraph (1) of the Regulation region of Pariaman number 12 in 2012 says that the audience is any person and or family members of citizens of the city of Pariaman who have paid dues or contributions.

Abstract

ABSTRACTAccording to the Corruption Act, any conducts of the civil servants or public officials who accept gifts from others. The civil servants also certain intention with regard to the recipient do something or not take action on the contrary to their duty, and thus the receipt can be categorized as an element of corruption. The Court Decision scrutinized in this article liberate a regent accused of accepting money from a third party as the costs over the project of natural disaster prevention. This interpretation of the conduct as “on the contrary to their duty” has apparently been barely construed by the judge without considering the officer’s real intentions and his other greater liabilities as a regional leader, to be precise, his obligation to obey the law and regulations.Keywords; corruption, gratification, regional leader ABSTRAKTerkait dengan Undang-Undang Anti Korupsi, terdapat berbagai kasus yang melibatkan pegawai negeri sipil atau pegawai pemerintah menerima hadiah dari pihak lain. Mereka juga dipastikan terkait dengan pihak ketika untuk melakukan atau tidak melakukan kegiatan yang bertentangan dengan kewajibannya sebagai hubungan timbal balik untuk memperoleh pekerjaan termasuk korupsi. Putusan pengadilan yang menjadi kajian ini melepaskan terdakwa dalam perkara Proyek Penanggulangan Bencana Alam dengan pertimbangan tidak dapat dipersalahkanmelakukan perbuatan yang bertentangan dengan kewajibannya. Penafsiran  terhadap ketentuan bertentangan dengan kewajibannya, “on the contrary to their duty” dalam tindak pidana korupsi belum dimaknai secara tepat oleh hakim karena kedudukan terdakwa sebagai kepala daerah tidak sebatas hanya terkait dengan upaya meningkatkan taraf kesejahteraan rakyat, melainkan wajib menegakkan peraturan perundang-undangan. Pejabat negara tidak dapat menggunakan alasan kesejahteraan tersebut dengan melakukan pelanggaran hukum.Kata kunci; korupsi, gratifikasi, kepala daerah.

Abstract

This paper intends to describe how the omnibus law mechanism applied in lawmaking in Indonesia. Look at the 2020 priority national legislation program, which includes four draft bills that formed using the omnibus law mechanism. The omnibus law is a new mechanism in the lawmaking process in Indonesia. Because this mechanism not contained in Law Number 12 of 2011 concerning the Formation of Laws and Regulations as amended by Law Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning the Formation of Laws and Regulations. With this, the first thing that must answer is the question of the constitutionality of its application. Therefore the omnibus law is a law that formed to change or cancel the various norms that existed in many Laws that had previously been in effect. The aim is to be able to provide policy recommendations on the application of the omnibus law mechanism in the formation of laws in Indonesia. The research method used in this paper is prescriptive-descriptive legal research with a normative juridical approach.

Abstract

Penelitian ini bertujuan untuk membandingkan konsep ultra vires dalam hukum perusahaan di Indonesia, Inggris, Jerman, Singapura, dan Australia. Ultra vires mengacu pada tindakan perusahaan yang melewati batas wewenang yang telah ditetapkan dalam anggaran dasar atau memorandum of association. Setiap negara memiliki kerangka hukum yang berbeda dalam mengatasi masalah ultra vires, dan tulisan ini akan menganalisis perbedaan dan persamaan dalam pendekatan hukum kelima negara tersebut.

Abstract

Banyaknya Lembaga Yang Berwenang Pengamanan Dan Penegakan Hukum Laut, dapat menyebabkan potensi gesekan antara Lembaga yang satu dan yang Lain. Untuk itulah, Penelitian ini memberikan Konsep Lembaga Pengamanan Dan Penegakan Hukum Laut Akan Produktif Dan Efektif-Efisien Jika Sesuai Dengan Pancasila. Penelitian Ini Menggunakan Menggunakan Metode Penelitian Hukum Normatif, dengan Pendekatan Perundang-Undangan, dan Konseptual. Hasil Penelitian Ini:Pertama, Langkah-Langkah Mewujudkan Lembaga Pengamanan Dan Penegakan Hukum Laut Berdasarkan Cita Hukum Pancasila adalah dengan meningkatkan pemahaman dan penerapan tentang Geopolitik Kemaritiman Indonesia kepada seluruh Lembaga Pengamanan dan Penegakan Hukum Laut; dan Membentuk Insititusi Sipil Non-Militer Yang Memililki Kewenangan Penegakan Hukum di Laut. Kedua, Penataan Lembaga Pengamanan dan Penegakan Hukum Laut Berdasarkan Cita Hukum Pancasila dilakukan melalui upaya: 1).Penataan Kebijakan Peningkatan Kesadaran dan Pemahaman Wawasan Nusantara kepada seluruh Lembaga Pengamanan dan Penegak Hukum Laut; 2).Penataan Kebijakan Maritim Nasional yang Komprehensif, Integral, dan Holistik; 3).Penataan Stabilitas Keamanan Maritim Nasional guna Mendukung Pembangunan Nasional; 4).Penataan Institusi Sipil Non-Militer Dan Merevisi Kebijakan Multy Agency Single Function menjadi Single Agency With Multy Function yang memiliki Kewenangan Penegakan Hukum Laut; 5).Optimalisasi Bakamla Sebagai Pusat Informasi Keamanan Maritim Nasional Terhadap Stabilitas Keamanan.
