Abstract

Countries in Southeast Asia in the past period are still faced with several acts of piracy and terrorism in the territorial sea. Piracy has a negative effect that is felt by the international community. In this paper, the author aims to focus the discussion on how to implement the ASEAN Convention on Counter Terrorism in overcoming the problem of terrorism in the seas around Southeast Asia. This research is normative juridical conducted by examining library materials or secondary data as basic material to be investigated by conducting a search of the regulations and the literature relating to the problems under study. The results of the study showed that at the convention there was a reference to jointly handling the problem of terrorism in the Southeast Asia region. The implementation of the convention in piracy cases in the waters around Southeast Asia is carried out through the principle of cooperation. However, the implementation of the convention has not been effective because it still faces several obstacles such as the nature of responses to situational terrorism, constraints on state sovereignty and the principle of non-interference among members, differences in sea area awareness.

Abstract

The presence of multinational corporations as one subjects of international economic law has had a significant influence in international economic relations. A corporation certainly can give a big contribution in social, economic, and cultural progress. But, on the other side, we are also faced by many processes which bring adverse impact to societies, loss the sources of the society life or at more serious level is the violations of human rights in the sector of corporate activity. This article aims to see how the international community’s effort in issues related to the company in the business filed when dealing with human rights. One of efforts undertaken by the international community was made an initiative name with United Nations Global Compact. Author use juridical-normative research method with literature studies. According to the result of studies, can be seen that the ultimate goal of initiative is to create a sustainable world economy. By the presence of this initiative, we hope that businesses which run a multinational company may enforce the values and principles that have been established in United Nations Global Compact, on of which is the respect of human rights.

Abstract

Hak Asasi Manusia (HAM) digunakan dan dimaknai secara berbeda disetiapnegara. Hal ini diawali dari era terjadinya Perang Dingin antara Amerika Serikat dan Uni Soviet. Sebagai dua negara dengan perbedaan ideologi, kedua belah pihak berkompetisi melalui penyebaran ideologi dalam pembentukan hukum HAM internasional. Tulisan ini akan menjelaskan mengenai bagaimana politik hukum ideologi mempengaruhi pembentukan dan penerimaan hukum HAM internasional. Penelitian ini merupakan penelitian yang bersifat yuridis normatif, yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti yang meliputi bahan hukum primer, sekunder, dan tersier yang terkait dengan permasalahan yang diteliti. Hasil penelitian menunjukkan bahwa pertimbangan politik dalam pembentukan hukum HAM internasional sangat dipengaruhi oleh ideology negara-negara, seperti DUHAM yang dapat dikatakan sebagai penyatuan antara konsep liberal (pasal 3 sampai dengan pasal 21) dan konsep sosialis (pasal 22 sampai dengan pasal 27). Perbedaan ideologi ini yang menghadirkan 2 Kovenan terpisah yang ruang lingkupnya berbeda dan proses perancangan kovenan-kovenan tersebut 18 tahun sejak DUHAM diterima.

Abstract

Maritime security in Indonesia is still vulnerable because of the high level of violations at sea such as illegal fishing, as well as various threats and other problems. The practice of illegal fishing, which remains a common issue in Indonesian territorial waters has made it difficult for Indonesia to realize itself as a maritime nation. Therefore, the author intends to discuss how are the appropriate efforts to eradicate illegal fishing practices in order to create a sovereign Indonesian state. The type of research used is normative juridical. In addition, this research has an analytical descriptive nature. This research concludes that to maximize the eradication of illegal fishing practices in Indonesia is to strengthen its maritime security system. There are two indicators, namely the optimization of maritime security institutions and strengthening legal products in the form of the Maritime Security Law to be able to realize Indonesia as a maritime country.Keywords: maritime security; illegal fishing; sovereignty AbstrakKeamanan laut di Indonesia masih rawan karena tingginya tingkat pelanggaran di laut seperti penangkapan ikan secara ilegal, serta berbagai ancaman dan permasalahan lain. Praktik penangkapan ikan secara ilegal, yang saat ini masih sering terjadi di wilayah perairan Indonesia membuat keinginan Indonesia untuk mewujudkan diri sebagai negara maritim akan sulit dicapai. Oleh karena itu, penulis bermaksud untuk membahas terkait bagaimana upaya pemberantasan yang tepat terhadap praktik penangkapan ikan secara ilegal guna mewujudkan negara Indonesia yang berdaulat. Jenis penelitian yang digunakan adalah yuridis normatif. Selain itu, penelitian ini memiliki sifat deskriptif analitis. Penelitian ini menyimpulkan bahwa untuk memaksimalkan pemberantasan praktik penangkapan ikan secara ilegal di Indonesia adalah dengan memperkuat sistem keamanan maritimnya. Terdapat dua indikator yakni optimalnya lembaga keamanan maritim dan memperkuat produk hukum dalam bentuk Undang Undang Keamanan Maritim untuk dapat mewujudkan Indonesia sebagai negara maritim.Kata-kata Kunci: Keamanan maritim; penangkapan ikan secara ilegal; kedaulatan

Abstract

The 2019 general elections in Indonesia have been held differently from the previous period. The 2019 general elections held simultaneously five boxes. This article discusses how the implementation of the 2019 general election and how the rather election should be carried out in the future. The author concludes that the implementation of simultaneous general elections in 2019 caused tremendous complexity for participants, voters, and organizers. The complexity and constraints that occur make the selection process not run well and less efficient and effective time spent. Then for the coming period, the elections should be carried out using the design of simultaneous national elections and simultaneous regional elections. In the simultaneous national election, it held to elect the President and Vice President, members of the House of People’s Representative, and members of the Regional Representative Board. Then in the simultaneous regional election, it held to elect the Governor, Regent/ Mayor, Provincial Legislative Council, and Regency/ City Legislative Council.

Abstract

The arrangement of the types and hierarchies of statutory regulations has been confirmed in Article 7 paragraph (1) of Law Number 12 of 2011. In addition to the provisions of Article 7 paragraph (1), it is also regulated in Article 8 paragraph (1) of the types of laws and regulations established by institutions/agencies/commissions. In Article 8 paragraph (2), it is emphasized that the laws and regulations as referred to in Article 8 paragraph (1) are recognized to exist and have binding legal force as long as they are ordered by more comprehensive legislation high or formed by authority. The expansion of the types of laws and regulations, as confirmed in Article 8 paragraph (1), if it is associated with the provisions of Article 7 paragraph (1), will cause problems. Whether the hierarchical provisions of the legislation in Article 7 paragraph (1) also applies to the provisions of Article 8 paragraph. This research aims to conduct a juridical analysis of whether the laws and regulations in Article 7 paragraph (1) of Law No. 12 of 2011 also apply to the provisions of Article 8 paragraph (1) of Law Number 12 of 2011. Thus, according to the author, the requirements of the hierarchy of laws and regulations as regulated in article 7 paragraph (1) cannot be applied to the laws and regulations stipulated in article 8 paragraph (1). The role of laws and regulations is critical to creating and maintaining harmonization and synchronization of laws and regulations in the sense that their types and hierarchies must be arranged. Hence, there are no conflicts in their implementation.

Abstract

Issues regarding Peat and Mangrove Ecosystem Management Arrangements are often discussed and become a problem in a region. There are many questions that arise, especially how to provide protection and management of peat and mangrove ecosystems and what are the wishes of the community, especially the village community, in formulating regulations regarding peat and mangroves. In fact, special methods are needed in regulating and formulating peat and mangrove regulations. For this reason, the ROCCIPI method is an alternative to making village regulations governing the Protection and Management of Peat and Mangrove Ecosystems. This study aims to discuss the urgency of implementing the ROCCIPI Method in Forming Village Regulations Concerning the Protection and Handling of Peat and Mangrove Ecosystems in Kubu Raya Regency. The research method uses descriptive qualitative. Data collection was carried out by observation and in-depth interviews. The withdrawal of informants was done on purpose. Data analysis used Miles and Huberman's interactive model which began with data collection, data reduction, data presentation and drawing conclusions. The results of the study show that the ROCCIPI method is very relevant to be used/applied in the preparation of Village Regulations concerning the Protection and Management of Peat and Mangrove Ecosystems in Kubu Raya Regency.

Abstract

This article examines how state territorial regulation can encourage development in Indonesia's border regions. This article also tries to explain the need for better management of borders between countries because there are several obstacles in implementing cross-border regulations. This research uses qualitative methods by taking the perspective of international law and constitutional law and collecting data through field research and reviewing related literature. Field research was carried out for 3 months by conducting in-depth interviews with several informants. Secondary data was obtained from reviewing books, journals, writings and mass media regarding international law, international relations and constitutional law. This research shows that the idea of ​​reforming border management between countries must be based on several aspects, namely law, institutions, development approaches and spatial planning. Abstract

This article aims to analyse the extent to which the regulatory authority established by Law Number 43 of 2008 has been implemented to manage the development of Indonesia’s border areas. The central and regional governments envision the forefront of the state to optimise the welfare of people living in Indonesia's border areas with neighbouring countries. Due to the widening economic gap with Sarawak, less optimal coordination between central and regional governments in handling state border areas, and limited infrastructure and social facilities, the border area poses a complex threat to the sovereignty of Indonesia. We conducted descriptive normative research by exploring several sources from the laws and regulations, books, journal articles, and online news articles. Additionally, we incorporated field research as our data collection method in West Kalimantan Province. The author observed the border area and conducted expert interviews with the local government, the manager of the border gate at Entikong, Sanggau Regency, and the West Kalimantan Provincial government representative. Normatively, the authority has been divided and defined in Law Number 43 of 2008. However, a lack of coordination in implementing the law was caused by the ambiguous hierarchy of authority among the stakeholders due to the physical capabilities to reach the areas. We argue that the closest coverage of authoritative bodies in giving services to the people will boost the people’s welfare in the border areas.

Abstract

Tujuan dari penelitian ini adalah untuk mendeskripsikan serta menganalisis faktor pendorong dan faktor penghambat pelaksanaan program Kartu Identitas Anak (KIA) sesuai dengan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 di wilayah Kabupaten Kapuas Hulu. Penelitian ini menggunakan jenis penelitian yuridis empiris dengan sifat penelitian deskriptif, cara pengumpulan data dengan melakukan observasi, wawancara, dan studi dokumen, serta teknik analisis datanya menggunakan teknik kuantitatif. Hasil dari penelitian ini ialah kepemilikan Kartu Identitas Anak (KIA) bagi anak di Kabupaten Kapuas Hulu sudah mencapai 70%, namun dalam penerapannya masih terdapat kendala-kendala seperti kurangnya informasi yang didapatkan masyarakat, kurangnya pemahaman masyarakat, kurangnya dukungan & koordinasi antar instansi, serta wilayah kabupaten Kapuas Hulu yang luas dan sulit dijangkau menjadi kendala-kendala dalam pengimplementasiannya. Selain itu, kemanfaatan yang dirasakan masyarakat dengan adanya Kartu Identitas Anak masih kurang. Saran dari penulis adalah Pemerintah diharapkan untuk mengkaji kembali terkait dengan program Kartu Identitas Anak ini terlebih kemanfaatan dan kegunaannya agar program ini dapat berjalan dengan efektif, serta perlu ditingkatkan kembali sosialisasi kepada masyarakat agar masyarakat mengetahui dan mengerti tentang program Kartu Identitas Anak (KIA).
