Abstract

Salah satu perkembangan yang menarik mengenai keamanan global saat ini adalah isu sengketa Laut China Selatan antara Filipina dengan Tiongkok. Filipina telah membawa sengketa tersebut ke Permanent Court of Arbitration. Putusan dari Permanent Court of Arbitration mengatakan bahwa klaim Tiongkok mengenai nine dash line terbantahkan dan tidak memiliki dasar hukum. Akan tetapi Tiongkok menolak putusan tersebut dan tetap agresif di Laut China Selatan sehingga berpotensi menimbulkan instabilitas kawasan Laut China Selatan. Artikel ini bertujuan untuk melihat implikasi putusan Permanent Court of Arbitration bagi negara pihak dan negara sekitar kawasan Laut China Selatan. Penulis menggunakan metode penelitian yuridis normatif dengan studi kepustakaan. Hasil penelitian menunjukkan bahwa negara pihak yang bersengketa harus melaksanakan dan menghormati putsan Permanent Court of Arbitration tersebut karena sudah menjadi sumber hukum internasional. Bagi negara di sekitar kawasan, putusan tersebut juga memiliki pengaruh di dalam menghadapi agresivitas Tiongkok dan pengaturan mengenai klaim maritim di kawasan Laut China Selatan.Kata kunci: Arbitrase, Implikasi Hukum, Sengketa Laut China Selatan AbstractOne of an interesting development about the global security now is the issue of territorial disputes in the South China Sea between Philippines and China. Philippines has brought the dispute to the Permanent Court of Arbitration. The ruling from Permanent Court of Arbitration said that China’s claim about a nine-dash line does not have a legal basis. However China rejects the ruling and remain aggressive in the South China Sea which might cause instability in South China Sea region. This research aims to look at the implications of the ruling of the Permanent Court of Arbitration for state parties and states around the South China Sea region. Authors use juridical normative research method with literature studies. This research shows that states parties have to implement and respect the ruling because it has already become the source of international law. For the state that located around the region, the ruling also has an effect to facing China’s aggressiveness and rules handling maritime claims in the South China Sea region.DOI:  https://doi.org/10.23920/jbmh.v2n1.1

Abstract

This research is intended to examine the means of Indonesia in adressing the vulnerability of the societal security in the Indonesia-Malaysia border area at Sajingan Besar District, Sambas Regency. Transnational activities in the Indonesia-Malaysia border area, especially at Sajingan Besar District, Sambas Regency, had an impact on national security. The existence of Indonesian society was threatened because of the very intense transnational activities with the Malaysian people on the border area. State as an actor in international relations has the obligation to secure its territory and inhabitants. The method used in this research was qualitative research method with case study technique. Data were collected by conducting interviews and conducting secondary data tracking, either from books, journals, or internet sources. The study was conducted by analyzing the societal security and national security approach. The means of Indonesia in 2014-2016 to address the vulnerability in Sajingan Besar District area include several issues, such as mentioned “border area” in Nawacita, increasing presidential visits to the border area, development and improvement of infrastructure, and improvement of public policy. The means that had been done shows the increased attention and real action from the government of Indonesia towards their border area.

Abstract

Pembajakan pesawat terbang merupakan bentuk kejahatan yang tergolong baru, motif yang melatar belakangi tindakan pembajakan tersebut pun beragam, mulai dari motif ekonomi sampai dengan politik. Masyarakat internasional memandang bahwa tindakan pembajakan tersebut dapat mengancam perdamaian dan keamanan internasional. Dalam rangka melawan kejahatan pembajakan pesawat terbang ini, masyarakat internasional membuat berbagai konvensi dari Konvensi Tokyo 1963, Konvensi The Hague 1970, Konvensi Montreal 1971, sampai yang terakhir adalah Konvensi Beijing 2010. Oleh karena itu dilakukan pengkajian mengenai konvensi-konvensi yang terkait dengan tindakan pembajakan pesawat terbang ini, terutama menyangkut yurisdiksi untuk menghukum pelaku tindakan pembajakan pesawat terbang ini. Penelitian ini merupakan penelitian yang bersifat yuridis normatif, yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti yang meliputi bahan hukum primer, sekunder, dan tersier yang terkait dengan permasalahan yang diteliti. Hasil penelitian menunjukkan keterkaitan konvensi mengenai tindakan pembajakan pesawat terbang dapat dilihat dari pembahasan masing-masing konvensi, yakni Konvensi Tokyo 1963 tentang pelanggaran-pelanggaran dan tindakan-tindakan tertentu lainnya yang dilakukan di dalam pesawat terbang, Konvensi The Hague 1970 tentang pemberantasan penguasaan pesawat terbang secara melawan hukum, Konvensi Montreal 1971 tentang pemberantasan tindakan-tindakan melawan hukum yang mengancam keamanan penerbangan sipil, serta Konvensi Beijing 2010 tentang pemberantasan tindakan melanggar hukum yang berkaitan dengan penerbangan sipil internasional. Salah satu bentuk upaya dalam rangka menanggulangi tindakan pembajakan pesawat terbang ini adalah dengan cara menetapkan yurisdiksi agar dapat menghukum pelaku tindakan pembajakan pesawat terbang. Abstract

Sebagai salah satu subjek hukum internasional, organisasi internasional memegang peranan penting di dalam perekeonomian internasional. Hukum ekonomi internasional tidak sekedar membahas mengenai aturan-aturan hukum melalui perjanjian internasional dan prinsip-prinsip, tetapi juga mengatur mengenai fungsi dan kewenangan organisasi ekonomi internasional yang telah diakui sebagai subjek hukum internasional. Di antara organisasi internasional tersebut terdapat IMF, World Bank, dan ILO. Artikel ini bertujuan untuk membahas mengenai eksistensi IMF, World Bank, dan ILO di dalam bidang hukum ekeonomi internasional. Pendekatan penulisan ini menggunakan yuridis normatif. Artikel ini menyimpulkan bahwa IMF dan World Bank lebih bergerak dibidang dalam membantu negara-negara yang mengalami kesulitan ekonomi yang serius, sedangkan ILO lebih berfokus mengenai isu perburuhan.

Abstract

Countries in Southeast Asia in the past period are still faced with several acts of piracy and terrorism in the territorial sea. Piracy has a negative effect that is felt by the international community. In this paper, the author aims to focus the discussion on how to implement the ASEAN Convention on Counter Terrorism in overcoming the problem of terrorism in the seas around Southeast Asia. This research is normative juridical conducted by examining library materials or secondary data as basic material to be investigated by conducting a search of the regulations and the literature relating to the problems under study. The results of the study showed that at the convention there was a reference to jointly handling the problem of terrorism in the Southeast Asia region. The implementation of the convention in piracy cases in the waters around Southeast Asia is carried out through the principle of cooperation. However, the implementation of the convention has not been effective because it still faces several obstacles such as the nature of responses to situational terrorism, constraints on state sovereignty and the principle of non-interference among members, differences in sea area awareness.

Abstract

The presence of multinational corporations as one subjects of international economic law has had a significant influence in international economic relations. A corporation certainly can give a big contribution in social, economic, and cultural progress. But, on the other side, we are also faced by many processes which bring adverse impact to societies, loss the sources of the society life or at more serious level is the violations of human rights in the sector of corporate activity. This article aims to see how the international community’s effort in issues related to the company in the business filed when dealing with human rights. One of efforts undertaken by the international community was made an initiative name with United Nations Global Compact. Author use juridical-normative research method with literature studies. According to the result of studies, can be seen that the ultimate goal of initiative is to create a sustainable world economy. By the presence of this initiative, we hope that businesses which run a multinational company may enforce the values and principles that have been established in United Nations Global Compact, on of which is the respect of human rights.

Abstract

The presence of Law Number 43 of 2008 concerning State Territory (State Territory Law) shows the seriousness of the Indonesian Government in managing border areas. Even so, there are still many problemsin border area management that need solutions to be found. This is related to the issue of the authority to manage border areas and the institution for controlling national borders as regulated in State Territory Law. This article aims to analyze the reasons for the need to strengthen border area management. The research method in this article is a normative juridical approach presented in analytical descriptive. This article concludesthat State Territory Law has not been optimally implemented to encourage the realization of the border area as Indonesia's front porch. Therefore, the revision of State Territory Law is urgent to be carried out, especially related to the management of border areas where this needs to become a separate law, unlike currently which is only a subpart of State Territory Law. Meanwhile, related to institutions, the National Agency for Border Management needs to be strengthened in its authority in managing border areas, not only for cross-agency coordination but also to be able to carry out executions. This strengthening can even reach the stage of increasing the institutionalstatusin managing border areas, namely to the Ministry stage.

Abstract

International trade law is part of international law. Therefore, various imperfections or weaknesses of international law are also affected in the field of international trade law. This article will explain why the state in conducting international trade needs to comply with international trade law. This article argues that the reason for the states to obey international trade law is due to the belief that obedience will benefit the interests of the country itself. The next reason is that there are fundamental principles within the scope of international treaties, which are the source of law from international trade law, namely the principle of good faith. A state that is bound in the international trade agreement shall implement the provisions of the treaty by contents, soul, purpose, and purpose of the treaty itself, respecting the rights and obligations of each party.

Abstract

AbstrakKeberadaan Kemitraan Trans Pasifik (Trans Pacific Partnership/TPP) menjadi topik yang hangat diperbincangkan. TPP salah satu kesepakatan perdagangan terbesar dengan kesepakatan ambisius yang menjanjikan penghapusan semua tarif untuk mematahkan penghalang investasi dan perdagangan di antara negara-negara anggota. Presiden Joko Widodo mengungkapkan ketertarikannya untuk membawa Indonesia bergabung menjadi salah satu anggota dari TPP sehingga penelitian ini dilakukan dengan maksud dan tujuan untuk memahami konsekuensi bagi Indonesia apabila bergabung dengan TPP. Jenis penelitian yang digunakan adalah yuridis normatif. Adapun penelitian ini menyimpulkan bahwa Indonesia yang menyatakan ketertarikan untuk masuk ke dalam TPP, harus melakukan kajian yang mendalam, karena masih cukup banyak legal gap dengan pengaturan yang ditetapkan oleh TPP. Penyesuaian tersebut harus dilakukan agar jangan sampai ketika Indonesia telah masuk ke dalam TPP tidak mematuhi perjanjian dengan alasan hukum nasional, karena hal tersebut tidak dibenarkan berdasarkan hukum internasional. Kata Kunci: Trans Pacific Partnership, Perjanjian Internasional, Perdagangan Internasional AbstractThe Existence of Trans Pacific Partnership (TPP) is being a hot issue. TPP is one of the largest trade agreements with ambitious agreements promising to free up all of the tariffs to break the trade and investment barriers among the member states. President Joko Widodo expressed his interest to bring Indonesia to become a member of the TPP so that this research was conducted with the intent and purpose to understand the consequences for Indonesia when joining TPP. The type of research used is normative-juridical. The study concludes that Indonesia, which announced interest in joining TPP, should conduct a thorough study, since there are still a lot of legal gaps with the regulations set by TPP. This adjustment should be made to avoid Indonesia on not complying to the agreements under national law grounds when Indonesia has joined TPP, as it is not justified under International Law. Key Words: Trans Pacific Partnership, International Law of Treaty, International Trade Law

Hasil menunjukkan bahwa negara pihak yang bersengketa harus melaksanakan dan menghormati putusan Permanent Court of Arbitration tersebut karena sudah menjadi sumber hukum internasional.
