Abstract

The state is a legal order which is also a social order. In the legal order, the State acts as organization performing coercive measures in order to achieve the objectives of that State. While the social order are series of institutional structure, and human culture are interrelated. A study of the constituent powers to establish the law can take a look at the system of Deliberative Democracy and Direct Popular Checks, or direct inspection by the public. This means that society placed as a pillar that can oversee their government. In essence, this system isa means of ultra-democracy which is an extension of the legislative process outside the assembly formed by the community. This becomes important in order to improve the quality of Indonesian democracy.Keywords: deliberative democracy, direct popular checks, and responsive law ABSTRAKNegara adalah sebuah tatanan hukum (legal order) yang juga merupakan tatanan sosial (social order). Dalam tatanan hukum, negara berperan sebagai organisasi yang melakukan tindakan-tindakan koersif guna mencapai tujuan negara tersebut, sedangkan tatanan sosial merupakan serangkaian struktur institusi dan kultur manusia yang saling berkaitan. Sebuah kajian mengenai kekuatan konstituen yang dapat membentuk hukum dapat kita lihat dalam sistem demokrasi deliberatif dan direct popular checks atau pemeriksaan langsung oleh masyarakat. Artinya, masyarakat ditempatkan sebagai sebuah pilar yang dapat mengawasi jalannya pemerintahan. Pada hakikatnya, sistem ini merupakan sarana-sarana ultra-demokrasi yang merupakan perluasan proses legislatif di luar majelis yang dibentuk oleh masyarakat. Hal ini menjadi penting dalam rangka peningkatan kualitas demokrasi Indonesia.Kata Kunci: demokrasi deliberatif, direct popular checks, dan hukum responsif

Abstract

This research is based on the low access of poor families to basic education and health care in Malang City that have an impact on social welfare and poverty problem. To overcome these problems, Ministry of Social Affairs of the Republic of Indonesia through Malang City Government and Social Department of Malang City implements Program Keluarga Harapan (PKH) in the form of conditional cash transfers to the Extremely Poor Households (RTSM). The result showed that the implementation of PKH has been implemented properly and according to the procedure and the number of RTSM recipients of PKH from year to year has decreased. Nevertheless, this program implementation does not significantly impact the number of poor people in the city of Malang in general.

Abstract

The existence of Bromo Tengger Semeru National Park (TN.BTS) is very important to preserve the flora and fauna and its ecosystem. In addition, TN.BTS also has a role to support research, education, recreation and cultivation activities. Inside the TN.BTS there is an enclave village named Ranu Pani. Problems arise when the villagers cut down trees causing negative impacts in certain areas and tourist areas management, which potentially cause damage to valuable sites of the Tengger community. By using descriptive method, this research tries to see how the role of BB-TN.BTS in solving the problem. The research concludes that efforts to empower the BB-TN.BTS and Tengger community should always be actively prioritized in preserving the National Park area. Empowerment means to involve Tengger indigenous people actively in planning, implementation, beneficiary, as well as in the process of monitoring and evaluation of TN.BTS management. Keywords: Soil Conservation, National Policy and Active Empowerment Abstrak Keberadaan Taman Nasional Bromo Tengger Semeru (TN.BTS) sangat penting untuk menjaga proses pelestarian flora dan fauna serta keseimbangan ekosistemnya. Selain itu, keberadaan TN.BTS juga memiliki peran untuk mendukung kegiatan penelitian, pendidikan, rekreasi dan budidaya. Namun di sisi lain, masyarakat Tengger, terutama desa Ranu Pani adalah sebuah desa enclave yang ada di kawasan TN.BTS. Fokus penelitian ini adalah di Balai Besar Taman Nasional Bromo Tengger Semeru (BB-TN.BTS). Konservasi Tanah TN.BTS menjadi bermasalah ketika masyarakat Tengger menebang pohon, menimbulkan dampak negatif di beberapa tempat, dan pengelolaan kawasan wisata, yang berpotensi menyebabkan kerusakan situs-situs berharga masyarakat Tengger. Dengan menggunakan metode penelitian deskriptif, peneliti mencoba melihat bagaimana peran BB-TN.BTS dalam menyelesaikan masalah kebijakan pemerintah melalui BB-TN. Upaya pemberdayaan BB-TN.BTS dan masyarakat Tengger secara aktif dalam melestarikan kawasan Taman Nasional perlu selalu diprioritaskan. Pemberdayaan juga berarti secara aktif melibatkan masyarakat adat Tengger dalam perencanaan, pelaksanaan, penerimaan manfaat, juga dalam proses monitoring dan evaluasi pengelolaan TN.BTS. Abstract

The opening of political access in a country that was going through a period of democratic transition gave rise to "little kings" through the practice of political dynasties in some regions. They fill the local political space by restructuring patronage networks and strengthening their social, economic and political bases in order to maintain their power. This kind of dynastic political practice generates negative sentiments towards the performance of the bureaucracy as the public policy tend to be beneficial for a particular political family. The research focuses on the impact of the Sutrisno family's political dynasty through the bureaucracy on the level of community satisfaction towards the performance and achievements of their programs. Given the impact of the Sutrisno family's dynastic political practices, some of them show an anomaly. The findings illustrate the high level of public satisfaction with the performance of the bureaucracy in the health, education, and economy sectors. Apart from the fact that the Sutrisno family dynasty was politically established and had consequences for control of the bureaucracy, the social base of the Sutrisno family network also played an important role in increasing public acceptance of bureaucratic work programs in various fields.

Abstract

Theoretically and empirically, the presence of women in politics is believed to reduce corruption behaviour. Unfortunately, in Indonesia, such essential categorization is not proven to reduce corrupt behavior considering that women can also be an executor, connoisseur, and even intermediaries of corrupt behavior. Women, as one category of sex, is not sufficient to analyze the role of women in corruption act, because woman is bounded by culture, religion, ethnicity and social class. Based on this background, this study attempts to find the root of the problem and the solution for woman politician in corruption act. By using electoral system theory and political party as theoretical analysis and literature study as the method, this study identifies that behavior of women corruptor cannot be separated from the power of elites in political parties and parliaments. The strong power of the oligarchic elite in political parties and parliaments itself is the result of an open proportional election system which has an impact on the high competitiveness of parties, so that led to high cost of political to be beared by women. Ultimately, to improve such conditions, the engineering of electoral and party systems is most likely to be a solution, as both are easy to intervene by state actors and civil society groups. In conclusion, this paper shows that political parties have to be responsible in promoting gender equality, and willing to review the quota and zipper system in relation to the proportional systems

Abstract

In a crisis, the public expects responsive, appropriate, and transparent governance and public communication practices from the government before the crisis, during the crisis, and after the crisis, as a form of government response and responsibility in controlling the Covid-19 pandemic, namely by forming a Covid-19 Task Force at the center and the regional level. This study focuses on mapping health risk communications carried out by the Covid-19 Task Force in Malang City and Regency based on the CERC model. The CERC model, known as Crisis and Emergency-Risk Communication, has five stages that can assist actors in mapping conditions from pre-crisis to crisis over, especially in public communication. This study aimed to determine the practice of crisis communication carried out by the Malang City and Regency Covid-19 Task Force during the pandemic. This research was conducted from August-October 2021. The data collection techniques were non-participant observation, intermittent interviews, and a literature study. Research findings show that the Malang City Covid-19 Task Force is more responsive in responding to information related to the Covid-19 pandemic through the internet and social media. The Malang Regency Covid-19 Task Force carried out a different strategy by prioritizing cross-sectoral coordination considering that geographically, the Malang Regency area is more comprehensive than Malang City. Another interesting strategy from the Malang City Covid-19 Task Force is the intensity of communication carried out by the Mayor of Malang through his personal social media account when conveying government appeals such as PSBB, PPKM, implementation of 3T (testing-tracing-treatment), and strict application of health protocols in society. The final result of this research is an integrated Covid-19 pandemic risk communication model between the government - experts  - the general public according to the cultural context of the affected community.Keywords: risk communication; health communication; CERC model; pandemic; Covid-19 task force Abstraksi-Dalam situasi krisis, masyarakat mengharapkan adanya tata kelola dan praktik komunikasi publik pemerintah yang responsif, tepat, dan transparan saat sebelum krisis, ketika krisis berlangsung dan setelah krisis. Sebagai bentuk respons dan tanggung jawab pemerintah dalam mengendalikan pandemi Covid-19 yaitu dengan membentuk Satgas Covid-19 di pusat dan di tingkat daerah. Penelitian ini memfokuskan pada pemetaan komunikasi risiko kesehatan yang dilakukan oleh Satgas Covid-19 di Kota dan Kabupaten Malang berbasis model CERC. Model CERC, atau yang dikenal dengan Crisis and Emergency-Risk Communication memiliki lima tahapan yang mampu membantu aktor dalam melakukan pemetaan kondisi sejak pra-krisis hingga krisis usai, terutama dalam aspek komunikasi publik. Tujuan penelitian ini yaitu untuk mengetahui praktik komunikasi krisis yang dilakukan oleh Satgas Covid-19 Kota dan Kabupaten Malang selama masa pandemi. Penelitian dilakukan sejak bulan Agustus-Oktober 2021. Teknik pengumpulan data berupa observasi non-partisipan, wawancara intermiten, dan studi kepustakaan. Temuan penelitian menunjukkan bahwa Satgas Covid-19 Kota Malang lebih responsif dalam menanggapi informasi terkait pandemi Covid-19 melalui pemanfaatan internet dan media sosial. Strategi yang berbeda dilakukan oleh Satgas Covid-19 Kabupaten Malang dengan lebih mengedepankan koordinasi lintas sektor mengingat secara geografis, wilayah Kabupaten Malang lebih luas dibanding Kota Malang. Strategi lain yang menarik dari Satgas Covid-19 Kota Malang yaitu intensitas komunikasi yang dilakukan oleh Walikota Malang melalui akun media sosial pribadi miliknya ketika menyampaikan himbauan pemerintah seperti PSBB, PPKM, pelaksanaan 3T (testing-tracing-treatment), dan penerapan protokol kesehatan secara ketat di masyarakat. Terakhir, hasil akhir penelitian ini yaitu model komunikasi risiko pandemi Covid-19 yang terintegrasi antara pemerintah – ahli (expert) – masyarakat umum menyesuaikaan dengan konteks kultural masyarakat terdampak.

Abstract

Indonesian Goverment is required to have social policies in reducing poverty, one of which is through the Program Keluarga Harapan (PKH). In fact, some individuals abused their authority in this program. PKH Facilitators commit corruption (bureaucratic pathology) and consumptive behavior (social pathology) shown by PKH beneficiaries. Qualitative research methods and literature studies were used to see the many social and bureaucratic problems in PKH implementation. So that researchers can describe and examine why these problems occur. Using social exchange theory, this article discusses the social problems faced by PKH beneficiaries. As a result, their consumptive behavior occurs because the evaluation process is not optimal from the PKH assistants. So they can abuse the social assistance. The debt bondage they face is also a complex problem. Next, the factors that cause PKH assistants to commit corruption. The complexity of political power relations, bureaucracy and their mentality problems are the dominant factors. The key to this problem lies with the PKH assistants. If they can carry out their role properly, PKH beneficiaries are also subject to every existing regulation. The state must also ensure the professionalism and welfare of PKH assistants to prevent them from committing corruption again.

Abstract

People's needs are often considered trivial by bureaucrats who sit in the government of a country. They tend to carry out and make programs or policies with top-down development, but the compatibility between what is needed by the people and what is done by the government is often different. Therefore, a more bottom-up approach must be present in the policy making process that is within the body of government. One of the goals of writing this article is the desire to strengthen the role of the community in the policy-making process that is considered important. The writing of this article uses the use of normative writing models. So that it uses a conceptual approach to explain to readers the importance of the concept of participatory leadership in development policy. Participatory leadership is leadership that bases its policy makers on a mature process of deliberation (deliberation process) by involving the public, so that development policies that are born can answer the needs and improve the socio-economic capabilities of the public. The concept of participatory leadership can be applied to every public official in the central to regional government environment, the government's goal to carry out comprehensive bureaucratic reform can be achieved. Also, the community will be far more independent and strong. The independence and strength of the community, in addition to being used to participate in the planning process, are also very much needed as an external party in monitoring and evaluating development policies. Keywords: Participation, Development Policy, Participatory Leadership Abstrak Kebutuhan rakyat seringkali dianggap hal yang sepele oleh birokrat yang duduk didalam pemerintahan sebuah negara. Mereka memiliki kecenderungan melakukan dan membuat program atau kebijakan dengan pembangunan yang bersifat top-down, namun kesesuaian antara apa yang dibutuhkan rakyat dengan yang dikerjakan oleh pemerintah sering kali berbeda. Maka dari itu, pendekatan yang lebih bottom-up harus hadir didalam proses pembuatan kebijakan yang ada didalam tubuh pemerintah. Salah satu tujuan penulisan artikel ini adalah keinginan untuk memperkuat peran masyarakat dalam proses pembuat kebijakan yang dinilai penting. Penulisan artikel ini menggunakan penggunaan model penulisan normatif. Sehingga didalamnya menggunakan pendekatan konseptual untuk menjelaskan kepada pembaca pentingan konsep kepemimpinan partisipatif dalam kebijakan pembangunan. Kepemimpinan partisipatif adalah kepemimpinan yang mendasarkan pembuat kebijakannya pada proses pertimbangan yang matang (proses deliberasi) dengan mengikutsertakan publik, sehingga kebijakan pembangunan yang lahir bisa menjawab kebutuhan dan meningkatkan kemampuan sosial-ekonomi publik. Konsep kepemimpinan partisipatif ini bisa diaplikasikan pada setiap pejabat publik yang ada dilingkungan pemerintahan pusat hingga daerah, tujuan pemerintah untuk melakukan reformasi birokrasi secara menyeluruh bisa tercapai. Selain itu, masyarakat akan jauh lebih mandiri dan kuat. Kemandirian dan kekuatan masyarakat, selain bisa digunakan untuk ikutserta dalam proses perencanaan, juga sangat dibutuhkan sebagai pihak eksternal dalam pengawasan hingga evaluasi kebijakan pembangunan. Kata Kunci: Partisipasi, Kebijakan Pembangunan, Kepemimpinan Partisipatif.
