Abstract

AbtraksPenelitian ini membahas tentang penelitian yang diadakan oleh pusat kajian agamadan budaya Universitas Islam Negeri Syarif Hidayatullah Jakarta terhadap beberapa nuansa syariah hukum Islam di kota Tangerang. Masalah hukum yang menjadi pertanyaan dalam pelarangan prostitusi (no 8/2005), hukum perkawinan sebagaimana yang tercantum dalam kompilasi hukum Islam (KHI), dan peraturan agama termasuk keputusan mengenai aliran Ahmadiyah. Hasil temuan penelitian menyatakan bahwa secara hukum dianggap tidak saja memberi dampak negatif, namun juga positif. Peraturan keagamaan secara umum cenderung melanggar kebebasan beragama dan bahkan mengancam kebebasan akademik, khususnya isu mengenai. Keputusan bersama menteri telah memengaruhi bentuk forum kerukunan umat beragama (FKUB), mengalami deskriminasi, misalnya tentang konstruksi penempatan tempat-tempat ibadah bagi para pemeluk agama minoritas. Perda no.8/2005 mengenai prostitusi di kota tangerang tidak saja berdampak pada penurunan prostitusi, namun juga berakibat pada masalah pelanggaran hak-hak perempuan (mereka saat ini tidak berani keluar rumah setelah jam 10 malam) dan kebebasan berpendapat. Meskipun draf hukum telah dimusyawarahkan dengan tokoh masyarakat.---AbstractThe presentation will discuss the findings of a research that was carried out by the Center for the Study of Religion and Culture of the State Islamic University Syarif Hidayatullah Jakarta on several Shariah-nuanced bylaws of Tangerang City (which was funded by Respect). The bylaws in question are those on the Prohibition of Prostitution (no 8/2005), the Marriage Law as stipulated in the Compilation of Islamic Law (KHI), and regulations on religion including the decree concerning the Ahmadiyah. The main findings of the research are that the bylaws have negative but also positive impacts. The joint Ministerial Decree has been influential in the formation of the Forum Kerukunan Umat Beragama FKBU, Forum for Religious Harmony) but has been discriminatorial in matters such as the construction of places for religious worship for adherents of minority religions. The Perda No. 8/2005 on prostitution in the City of Tangerang has indeed resulted in reducing prostitution but has also resulted in the violation of women’s civil rights (they are now afraid to be active outside the house after 10 o’clock at night) and their freedom of expression and academic freedom. Although the draft of the bylaw was discussed with figures in society, the law was socialized in a top-down manner.

Abstract

The theory of modern litery criticism in the West begins with the birth of the theory of formalism in Russia between 1915-1930 developed by Jacobson, shklovsky, Eichenbaum and others. This theory is the foundation stone of modern literary science that formally consider literary work as art of language and sparate the literary works from other social sciences such as psychology, history, and culture. From this formalism theory then was born the theory of structuralism and its various manifold (post-structuralism), such as semiotics, geneticstructuralism, and others. Based on the formalism theory, literary works as autonomous works must be researched in terms of the work itself (intrinsic elemennts), not from outside ( extrinsic elements), because theory more emphasizes on the beauty of literary works. Therefore, what, is needed in criticizing a literary works is close reading, a microscopic reading of literary works as art of language.

Abstract

Abstract During the era of Reformasi the face of Indonesian politics was marked by, among other things, the kindling in a number of regions of the formalizing of Islamic law through regional bylaws, and in other areas through public policy. Efforts to achieve this started at the third level, that is at the level of regulating aspects of religious services and worship, going beyond Islamic family and economic law, and this was also the case with formalizing shariah law at national level.Despite the positive impacts of thissuch as improved security, seen from the perspective of the rights of non-Muslims the implementation of regional Islamic regulations or public policy is a threat, in part because of its positioning as something that may trigger the violation of non-Muslim rights. Examples of this are freedom of worship, freedom to establish schools, the right to take positions of leadership and inter-faith marriage. Moreover, parts of this implementation directly infringe the rights of non-Muslims, such as the obligation to wear a veil. From the Islamic legal perspective, shariah bylaws or regulation have also crossed the boundaries of traditional shariah law, particularly in the requirement to wear a veil and in freedom of worship. Shariah bylaws are a close reflection of traditional Islamic law. Because of this, the shariah law already embodied in regional legislation must be reinterpreted to make it something of benefit to people, providing a sound footing for accomodating such contemporary demands as basic human rights. In any case, the shariah that becomes formalised in bylaws should be progressive and modern, and this is the shariah law that needs to be publicised and supported. Key Words: shariah bylaws,dzimmî, mainstream, hudîûd, khalwat, jizyah, ahl al-kitâb, takwil,and istishlâh.  ------- Abstak Selama era reformasi, wajah perpolitikan Indonesia ditandai dengan adanya, antara lain, menjamurnya jumlah daerah-daerah yang memberlakukan hukum Islam melalui peraturan daerah, melalui kebijakan publik.Usaha untuk memeroleh hal ini dilakukan dengan tiga tingkatan, yaitu pada tingkat pemberlakuan aspek-aspek keagamaan, pelayanan dan peribadatan, kemudian berlanjut pada masalah hukum ekonomi dan keluarga islami, dan hal ini juga menjadi masalah pemberlakuan hukum syariah pada tingkat nasional.Meskipun dampak positif semacam ini dapat meningkatkan keamanan, ditinjau dari perspektif hak-hak non-muslim terhadap pemberlakuan peraturan daerah atau kebijakan publik menjadi sebuah ancaman, dikarenakan posisinya sebagai sesuatu yang bisa memicu pelanggaran  hak-hak non-muslim. Contohnya adalah kebebasan beribadah, kebebasan medirikan sekolah, hak untuk mengambil alih kepemimpinan dan perkawinan beda keyakinan. Di samping itu, sebagian dari implementasi ini dapat berpengaruh pada pelanggaran hak-hak non-muslim, misalnya kewajiban untuk memakai jilbab. Dari perspektif hukum Islam, hukum/peraturan syariah telah melanggar batas hukum syariah tradisional, khususnya dalam mewajibkan penggunaan jilbab dan kebebasan beribadah.Perda syariah merupakan refleksi hukum islam klasik. Hal ini dikarenakan hukum islam mencakup peraturan daerah yang harus ditafsirkan untuk memberikan manfaat bagi masyarakat, dengan menampung aspirasi suara bawah. Abstract

Arabic prose is different from Indonesia spch texts, correspondences, and maqamat as a part of the  prose. Prose is generally divided into two types: imaginative and non-imaginative. All of the immaginative  literature have elements such as characters, plot, setting, theme,and beautiful language style.

Abstract

PurposeAs the title suggests, this paper discussed the monodisciplinary tradition of studying Arabic language and literature which became an obstacle for scientific publications or other dissemination activities.MethodThe qualitative study made a library research design whose primary data sourced from journal articles, books, research proposals/thesis, and online sources. Careful reading and analysis were applied to get the intended data useful in answering the problems being investigated. The collected data and relevant information were qualitatively analyzed using Ricoeur’s Hermeneutics.Results/FindingsThe found out many negative consequences of the using of a monodisciplinary study. In general, the study of Arabic language and literature had lack of research significance, depth of analysis, and criticism. It was neither lack of originality nor creativity. In addition to the mono-disciplinary study tradition factor, the teaching university paradigm and poor learning traditions became another contributing factor.ConclusionA mono-disciplinary in studying Arabic language and literature did not contribute significantly to its development. It was necessary to use multidisciplinary intra/interdisciplinary paradigm as a trend in the teaching and studying of Arabic language and literature in the world by which various shortcomings lessened.
