Abstract

This study examines the legal considerations in settling inheritance disputes involving land distribution in Selong Religious (Islamic) Court of West Nusa Tenggara. The data in this study were obtained from interviews and court decision analysis. This study shows that the practice of granting property before the death of the muwārith (testator) can cause inheritance-based land disputes in the future. Disputes usually arose when the land was distributed only to particular heirs, neglecting the others, especially the daughters and their descendants. In deciding the land disputes in inheritance cases, judges evermore considered the legal validity of the land distribution. Besides that, the judges use Islamic legal sources such as the Quran, Hadith, opinions of scholars, and fiqh in their legal considerations. However, the use of these multiple references does not necessarily lead to a diverse outcomes.  Abstrak: Penelitian ini mengkaji bagaimana pertimbangan hukum hakim dalam memutus perkara sengketa hibah tanah di Pengadilan Agama Selong, Nusa Tenggara Barat. Data pada penelitian ini diperoleh dari wawancara dan analisis putusan. Penelitian ini menunjukkan bahwa kebiasaan masyarakat menghibahkan harta sebelum kematian pewaris cenderung menjadi pemicu sengketa tanah berbasis waris di kemudian hari. Sengketa biasanya muncul dari pembagian tanah yang hanya kepada sebagian ahli waris dan merugikan sebagian ahli waris yang lain, terutama bagi anak perempuan dan keturunannya. Dalam memutus sengketa hibah tanah dalam kewarisan, hakim selalu mempertimbangkan keabsahan hukum hibah tanah dalam kasus yang diajukan. Selain itu, hakim juga menggunakan ayat-ayat al-Qur’an, hadis, pendapat ulama, dan kaidah fikih sebagai pertimbangan hukumnya.

Abstract

The old wells oil management is petroleum management which accentuates the empowerment of local communities in the producing region. The goal of this oil management is to provide maximum prosperity for the people as mandated by Article 33 of the 1945 Constitution. This paper aims to formulate the model of old wells oil management based on the social justice principle. This paper has a normative legal study method that uses a term of old wells management in Wonocolo oil fields, Bojonegoro regency. The result is because old wells oil management in Wonocolo oil field does not fully reflect the social justice principle, then it causes illegal mining activities. Therefore, it is necessary to formulate a model of old wells management based on the principle of social justice with two indicators i.e. 1) The equal distribution of benefits and 2) Participation.Keywords: Oil, Old Wells, Illegal Mining, Benefit Distribution, Participation, Social Justice

Abstract

Indonesia has enacted mining law, environmental protection law, and a number of rules addressing mining and environmental issues. However, the establishment of these numerous laws and regulations has not resulted in a decline in corruption cases and environmental degradation. In fact, government officials are frequently lenient with mining industry owners who fail to follow good environmental standards. This is critical since Indonesia has spent the last two decades attempting to resolve corruption and environmental challenges. This study describes specific instances of mining and environmental law confusion resulting from corrupt activities. The study takes a normative legal approach. Resources have been gathered through examinations of mining and environmental laws and regulations, as well as reports by multiple authorities that track the same subject. The study demonstrates how prior Indonesian mining law policy acknowledged regional governments as mining authorities. The policy has caused widespread mining corruption, particularly in the area of business permits, involving regional political leaders and the private sector. The irresponsibility of regional political elites has jeopardized the environment and ecosystem. It is also an echo of overlapping legislation and authorities in the mining and environmental sectors.

Abstract

This study aims to analyze and illustrate the problem of monitoring the transparency of the use of the Corona Virus 19 financial budget. Transparency is one of the important elements in the realization of good governance. This research is a normative study with a statutory approach. The data of this research uses secondary data with primary, secondary and tertiary legal materials. The results show that first, the Covid-19 pandemic has caused a decline in the economy and activities in various sectors. Second, supervision of the use of covid funds is very weak considering Law Number 2 of 2020 gives absolute power to change budget postors and remove checks and balances and gives immunity authority to the government in managing state finances so that they cannot be corrected and are immune to the law.

Abstract

Indonesia is the largest oil palm producer. The area of oil palm plantations is approximately 3.4 million. However, this large potential is not part away from legal issues such as illegal oil palm plantations. It is also implied by overlapping regulations and permits. This study aims to examine the policy of illegal oil palm plantations reform and the rooted regulation problem in forest areas during Joko Widodo era. This research relies on a normative legal approach. Data was collected through the investigation of legal material regarding oil palm policies. The results of this study indicate that the overlapping regulation contributes negatively to the reformation attempt. Yet, there are no legal products and policies regarding the dispute settlement of illegal oil palm in forest areas. Repressive implementation of criminal law does not solve the problem at the grassroots. The establishment of Job Creation Law provides new hope for the settlement of oil palm plantations problem by mainstreaming the nonlitigation mechanism, namely administrative sanctions.

Abstract

Environment is an essential element of life. The domain offers a variety of advantages and functions for humans to carry out activities and reside there. This is normative legal research using secondary sources. According to the study's findings, environmental law enforcement can be conducted both punitively and preventatively, depending on its effectiveness and nature. The lack of coordination between sectors (government officials), the absence of a monitoring plan, and the lack of environmental supervisors are obstacles to ecological monitoring.

Abstract

This study aims to analyze the compensation right of consumers from LA City Apartment who developed by PT. Priority Land Indonesia as a business actor. This research method is normative legal research with prescriptive of the study. The research approach used a law related to consumer protection over the compensation right as stated in the Consumer Protection Law. The type of data used primary and secondary data. Data collection techniques in this research used a library study with a deductive analysis. This research concludes that consumer protection for compensation rights in accordance with the sale and purchase agreement of LA City Apartment units should only be material but in resolving disputes that are taken through civil law in a material and immaterial because they did not use the Consumer Protection Law.

Abstract

This research is come from the importance of human resources in doing work. The factor that easily affects human resources in terms of production is Occupational Health and Safety (K3). Factors that influence the implementation of Occupational Safety and Health (K3) at PT. Halo Indonesia Manufacture, namely personal protective equipment (PPE), warning signs, human resources (HR) and technology.  The implementation of Occupational Safety and Health (K3) at PT. Halo Indonesia Manufacture, namely establishing an Occupational Safety and Health Management System (SMK3), preventing and reducing accidents, extinguishing fires, providing aid in accidents, providing personal protective equipment to employees and providing training on work safety.

Abstract

This study aims to determine the implementation of medical waste treatment at Bung Karno Hospital in Surakarta in accordance with Law Number 32 of 2009 concerning Protection and Management of the Environment and Government Regulation Number 101 of 2014 concerning Management of Hazardous and Toxic Waste. This study uses an empirical method and a statutory approach.The types of legal materials consist of primary and secondary.Primary legal materials is using laws, government regulations, and regional regulations of the province of Central Java. Secondary legal materials is using relevant books, journals and research. The author collected data by conducting observations and interviews with waste managers at the hospital. The results of this study are: The treatment of medical waste at Bung Karno Hospital is carried out in collaboration with external parties, this is because the hospital does not yet have its own incinerator. The implementation of liquid medical waste management, Bung Karno Hospital Surakarta, uses IPAL tanks and Redox AOP machines. The hospital has not properly implemented the regulations for B3 waste management.

Abstract

Penulisan hukum ini bertujuan untuk menganalisis dan mengkaji pengaturan reklamasi pertambangan batubara agar dapat berfungsi untuk menjaga kualitas lingkungan. Penelitian ini merupakan jenis penelitian hukum normatif yang bersifat preskriptif dengan bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) dengan teknik pengumpulan bahan hukum studi pustaka serta menggunakan metode interpretasi sebagai teknik analisis bahan hukum. Adapun hasil penelitian pada penulisan hukum ini ialah ketiadaan aturan pelaksana atas Undang-Undang Nomor 3 tahun 2020 tentang Perubahan Atas Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara serta adanya ketidaksesuaian dan ketidakselarasan antara ketentuan aturan perundang-undangan dengan aturan pelaksana yang berlaku sekarang dan eksisnya praktik penyimpangan pengaturan reklamasi pertambangan batubara yang dilandasi aturan pelaksana yang ada membuat implementasi pelaksanaan kegiatan reklamasi menjadi terkendala dan tidak dapat diwujudkan sebagaimana yang diharapkan.
