Abstract

In March 2019, the European Union considered palm oil to cause ILUC along with being one of the contributors for emission and pollution. However, the move has been condemned by palm oil exporting States, such as Indonesia. It is accused as a modern, “green protectionist” move to protect national market or other countries importing goods. Since European Union uses environmental justification to restrict palm oil import from Indonesia, it is inherently correlated with the general exception enshrined in Article XX of the GATT relating to the principles of international trade. Under the assessment based on Article XX and judicial decisions before the WTO, the article concludes that the DR is not the only measure possible and will not give siginificant effect on ILUC. It only creates unjustifiable and arbitrary discrimination towards Indonesia since there is no sufficient link between the environmental purpose of the DR and its provisions

Abstract

This study proposes to address the issue of the effectiveness of the World Trade Organization (WTO) Special and Differential Treatment (S&D) provisions in helping developing countries, in the sense of whether or not the provisions have achieved their ends. To address this issue, the following question will be asked: to what extent have the S&D provisions been effective, both in their implementation in practice by the WTO Members, and in their enforcement in dispute settlement process? Three main legal research methods have been employed for this study, namely  ormative and empirical legal studies, and case studies. This study argues that the implementation and enforcement of the S&D provisions have been mostly ineffective. In the implementation, the unenforceability of the S&D provisions has been the most significant contributing factor to their ineffectiveness. In the dispute settlement, factors for the ineffectiveness have been the failure of developing countries to fulfil conditions required by the S&D provisions; the failure of developing countries to submit adequate prima facie evidence to support their claims or defences; and strict and narrow interpretation of the provisions by panels and the Appellate Body.Key word : Special treatment and different, developing countries, problem solution

Abstract

The development of internet, undeniably, has multidimensional implications and specific characters of cyberspace. In fact, mostexisting laws have been provided and created for there alworld. There fore, the questions are whe therornot the laws  for realworld provide for cyberspace? Should laws for cyberspace differ from those for realworld? Is it a must to have a specific Cyberlaw? This writing proposes to elaborate on problems a rising or potentially a rising from activities in intemet, especially those related to E-Commerce,directly or indirectly. The enactment of Copy Rights Law 1997 No. 12 has been the effort of Indonesia to harmonize intellectual property rights laws with the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs). Abstract

Dari enam hukum yang paling berpengaruh di dunia saat ini, ternyata tidak ada satupun yang tidak mengalami perubahan (dinamika). Bahkan, tradisi hukum yang bersum berpada wahyu (relevasi) seperti Hukum islam dan Hukum Taimudik, tidaklah se-statis sebagai yang diasumsikan banyak orang. Hanya saja memang, menurut Nandang Sutrisno, ada tradisi hukum yang tipis(thinner traditions) dan ada pula tradisi hukum yang tebal (thicker traditions). Di situlah jawaban atas seberapa besar masing-masing tradisi hukum memiiiki kans untuk berubah.

Abstract

This article discusses two reasearch questions, firstly, whether law reforms on investment by the issuance of policy packages involving massive numbers of regulations during the First Period of President Jokowi have been successful to increase the realization of foreign investments? Secondly, how is the projection of foreign investment policies in the Second Period Of President Joko Widodo to increase the realization of foreign investments? Theoretical framework used in this article methodologically places law as external environment for foreign investors, and that law is the priority factor and the most relevant for investment and economic growth. This article concludes that first, law reforms on investments by the issuance of massive regulations in the First Period, even though having been successful to increase the values of realization of cumulative foreign investments significantly, they have been unsuccessful in increasing the annual percentages of foreign investment growth. Second, Omnibus Law and the then implementing regulations that would be used to increase foreign investments have been inviting resistances from various components of the nation, due to lack of transparent procedures and degrading the interests of public at large, and bias of the intersets of investors. Therefore, the effectiveness of law reforms in the Second Period would be impeded by various resistant movements, and in turn, be contraproductive with the purposes of legal reforms. Abstrak Artikel ini membahas dua permasalahan utama, pertama apakah reformasi hukum investasi melalui serangkaian paket kebijakan dengan jumlah peraturan yang masif pada Periode Pertama Presiden Jokowi telah berhasil meningkatkan realisasi investasi asing? Kedua, bagaimanakah proyeksi kebijakan investasi asing pada Periode Kedua Presiden Jokowi untuk meningkatkan realisasi investasi asing? Kerangka teoretik yang digunakan dalam artikel ini secara metodologis menempatkan hukum sebagai lingkungan eksternal dari investasi asing, bahwa hukum merupakan faktor prioritas dan paling relevan untuk investasi dan pertumbuhan ekonomi. Kesimpulan dari artikel ini pertama, reformasi hukum investasi dengan mengeluarkan produk hukum yang masif pada Periode Pertama meskipun berhasil meningkatkan nilai investasi asing kumulatif secara signifikan, tetapi tidak berhasil meningkatkan persentase pertumbuhan pertahunnya. Kedua, Omnibus Law dan peraturan-peraturan pelaksanaanya yang akan diandalkan untuk meningkatkan investasi asing telah mengundang resistensi dari berbagai komponen bangsa, karena secara prosedur pembentukannya tidak transparan dan secara substantif mendegradasi kepentingan masyarakat luas serta lebih berpihak kepada kepentingan para investor. Dengan demikian efektivitas reformasi hukum pada Periode Kedua akan terganggu dengan berbagai gerakan resistensi yang akan menyebabkan kontraproduktif dengan tujuan dari reformasi hukum tersebut.

Abstract

The massively growing popularity of Japanese animation or Anime creates a certain movement and has exported cultural form in another reflection from their fans in many countries. It can be in a form of data such as films, pictures, videos, or made by fans such as fan-subs, fan arts, fan-fictions or it can be in a real form such as clothes, merchandises or costumes for cosplayers. In Indonesia copyright is regulated in the Law no. 28 of 2014 on Copyright while internationally copyright are regulated by some of international convention and agreements such as Trade-Related Aspects of Intellectual Property Rights Plus concluded by WTO; Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, and the Rome Convention concerning protection of neighboring rights to literary works which are concluded by WIPO. Even though the infringement of intellectual property rights violated copyright and it is nationally and internationally protected by law, but the phenomenon of violation of this anime is can be easily found in daily life and massively growing, and due to unclear limitations and parameters of the balance in enjoying the economic benefits of reasonable interest which also regulated in Article 44 and is called as fair use however, questions arise, what kinds of movement which infringing the law and which one is not.
