Abstract

ABSTRAKPekerja seks komersial adalah pekerjaan yang sampai sekarang dapat ditemui di tengah-tengah masyarakat Indonesia dan merupakan pekerjaan yang yang dinilai negatif baik dalam agama dan norma yang ada di Indonesia. Peraturan yang diatur di Indonesia mengenai Pekerja seks komersial pun dinilai masih belum mendapat perhatian karena hanya mengatur mengenai mucikari dan lokalisasi, hal ini mengakibatkan status saksi yang sampai saat ini diterima oleh psk merupakan ketidakadilaan bagi mucikari sekaligus memberi ruang kepada psk untuk bekerja tanpa jera karena tidak adanya kepastian hukum bagi kedudukan psk yang dimana sampai saat ini peraturan di Indonesia hanya mengatur tentang mucikari serta perdagangaan orang secara paksa.Kata Kunci : PSK, Saksi, HukumABSTRACTCommercial sex workers are jobs that until now can be found in the midst of Indonesian society and are jobs that are considered negative both in religion and norms in Indonesia. Abstract

As far as we concern, children are the biggest gift for us. Children will be the country next generation. They are the agent of change of a nation. If there are no educated children, a nation will be just a place with many citizens without any development in it. According to the Convention of ILO 182, there are some worst jobs for children such as slaveries, trafficking, compulsory works and even prostitutes. All abovementioned jobs are not suitable for children and only give a worthless experiences for them and of course can hurt themselves. In order to give education for children and to create the next generation agent of change for Indonesia, Kutai Kartanegara has tried to conduct a program called ‘Free Zone of Child Employee’ which aims to make a zero zone of child employee in Kutai Kartanegara since 2002. Abstract

The theory of conditio sine qua non is known in criminal law and is important in uncovering the causal relationship in criminal acts. However, it will generate problems when applied in environmental cases such as environmental pollution caused by oil pollution in Balikpapan. This study adopts a doctrinal approach including examining the Decision of the Balikpapan District Court Number: 749/Pid.B/LH/2018/PN.BPP. The theory of conditio sine qua non is not purely applied as a process of determining accountability. This theory is only applied at the investigation stage but not at the court process although in the facts of the trial there are several factors causing the oil spill in Balikpapan Bay including those who contributed in the occurrence of this case. Abstract

In Indonesia, cases of sexual violence against children are serious crimes. Law Number 17 the Year 2016 concerning Establishment of Government Regulation in place of Law (PERPPU) Number 1 the Year 2016 concerning Second Amendment to Law Number 23 the Year 2002 concerning Child Protection, which can be picked up following chemical castration. The author has two objectives, first about the additional legal requirements for chemical castration in terms of the perspective of justice against victims, the second to provide clarity on the additional innocence of chemical castration in Law Number 17 of 2016 concerning the Establishment of PERPPU Number 1 of 2016 in children The granting of additional castration chemical crime law from the perspective of justice against victims is a form of retaliation for the crime. Nothing in Law Number 17 of 2016 concerning the Establishment of PERPPU Number 1 of 2016 has the objective to be achieved is to protect the nation's children and become material for judges in opposing penalties against violence against children.

Abstract

ABSTRAKSI Perkawinan merupakan salah satu bentuk ketaatan seorang Muslim kepada Sang Pencipta, Allah SWT dan merupakan ibadah bagi Muslim tersebut. Bagi seorang Muslim, segala tindakan yang dilakukannya haruslah berdasar kepada aturan yang telah ditetapkan oleh sang Pencipta dan tertuang di dalam sumber hukum Islam, yaitu Al Quran, As Sunnah dan al Ijtihad yang terdiri dari Ijma’ dan Qiyas. Termasuk juga masalah perkawinan, yang dalam hukum Islam disebut dengan istilah Munakahat. Aturan yang ditetapkan oleh Sang Pencipta dan diturunkan kepada hamba-Nya tidak akan pernah memberatkan atau menjadi beban bagi mereka. Hal itu dikarenakan apapun yang diturunkan kepada semua manusia pasti tidak akan pernah melebihi apa yang dapat dilakukan oleh manusia tersebut. Termasuk juga masalah perkawinan. Akan tetapi saat aturan perkawinan tersebut dicantumkan menjadi suatu peraturan tertulis dalam konteks perundang-undangan di Indonesia, termasuk mengenai masalah batas minimum seorang laki-laki dan perempuan bisa melakukan perkawinan maka hal tersebut bisa menjadi bumerang bagi keberlakuan aturan itu sendiri di Indonesia. Hal itu terbukti dengan cukup banyaknya pasangan yang menikah di usia dini atau melakukan pernikahan di bawah umur dari standar yang telah ditetapkan oleh negara. Termasuk juga di Tenggarong Kabupaten Kutai Kartanegara, yang notabene termasuk dalam ruang lingkup wilayah kecil tapi ternyata cukup banyak pasangan bawah umur yang melakukan pernikahan. Kata Kunci: pernikahan dan bawah umur.

Abstract

ABSTRACT The judge took the progressive step. This step strongly supports the prevention and eradication of Corruption Crimes. However, in implementing the revocation of rights, the time limit for revocation must be explicitly given for the right to vote. This study aims to find out additional crimes in the form of revocation of rights to choose and be elected to public office if reviewed from the perspective of criminal law and to find out the compatibility between the decisions of the Supreme Court judge Number 537K / Pid.Sus / 2014 with human rights principles. This study uses doctrinal types. Namely, the authors collect material from the literature. These are hardcopy and softcopy that relate to the title of this study and by using an analysis of the object of research. The results obtained from this study are as follows: 1). Revocation of the right to choose and be chosen should be based on the crime rate, the impact caused to society, and the position of the position while doing the crime of corruption. Revocation of certain rights must be determined by a judge’s decision, and there is a time limit for revocation according to what has been stipulated in article 38 Criminal Code. However, Article 38 of the Criminal Code does not regulate specifically related time constraints for the removal of the right to vote and elected in public office. 2). Revocation of the right to be elected in public office complies with the principles of human rights. It can be said to be included in the category of degradable rights, or rights can be restricted. While the revocation of the right to vote who are not given the time constraints and repeal incompatible with the principles of human rights. Because the right to vote is a fundamental right of every citizen, who has been guaranteed by the constitution of 1945, besides, the time limit for the removal of the right to vote still needed due to respect of human rights offender criminal acts of corruption but to provide justice for victims of crime over the extraordinary crime then the period of revocation may be given more long, judging from the level of crimes committed.Keywords: rights; Human Rights; Revocation; Criminal; Corruption

Abstract

A Pimp is a man or a woman whose life is financed by prostitutes, in prostitution it helps to find costumers where she gets her portion and profiting from work done by prostitutes. This covers two points, the first wanted to know criminal law enforcement against pimps related to online prostitution in Indonesia. Second to know and analyze the determination of pimps in criminal law in Indonesia. As for the law enforcement against pimps the ensnares Information and Transaction Electronic law, Human Trafficking law and Penal Code can’t reach the problem of online prostitution. In Indonesia the responsibility of pimps in criminal law does not meet elements done by pimps because the law that ensnares pimps in Indonesia haven’t set it about online prostitution.

Abstract

The principle of primum remedium emphasizes the application of Article 84 of Law Number 32 of 2009 concerning Protection and Management of the Environment, whose actions do not need to be proven, it is clear that committing environmental crimes, which in environmental law enforcement is rarely applied by judges in the Supreme Court decisions. Doctrinal research with the adjudication of judges' decisions. The application of the primum remedium principle in environmental law enforcement in B3 waste cases does not need to be proven and clearly commits pollution and destruction of the environmental environment, thus providing a deterrent effect for perpetrators and anyone who will commit environmental crimes. The formulation of the classification of criminal elements is clearly and firmly regulated in the UUPPLH criminal provisions relating to the application of the two principles of primum remedium and ultimum remedium. The validity of criminal law as primum remedium with Decision Number 487 / Pid.B / LH / 209 / PN Sm, does not pay attention to formal offenses so that environmental crimes can be released from criminal threats. For this reason, the judge's understanding and certification in deciding cases related to environmental law must be evaluated and monitored for the judge.

Abstract

State-Owned Enterprises are legal entities created by the Government using funds taken from the State Revenue Budget (APBN) as a form of state effort to meet the needs and benefits of the Indonesian people, but in carrying out their business several problems arise related to the limitations of the flow of state finances in the finances of the Agency. State-Owned Enterprises, which often this lack of clarity causes several problems related to legal qualifications due to business actions that are not profitable for State-Owned Enterprises that lead to criminal acts of corruption. detrimental to state finances. The Law Number 40 of 2007 concerning Limited Liability Companies has clearly adopted the legal principle of Immunity Doctrine against the structure of Limited Liability Companies, namely the Business Judgemaent Rule. there are several aspects to qualify as an action in accordance with the principles of the Business Judgment Rule. Abstract

Pemerintah Indonesia mengakui keberadaan masyarakat hukum adat yang tersebar di berbagai wilayah Indonesia. Bahkan memberikan pengakuan akan keberadaan masyarakat hukum adat tersebut salah satunya terdapat di dalam Undang-undang Nomor 5 Tahun 1960 tentang Peraturan-Peraturan Dasar Pokok-Pokok Agraria. Penelitian ini merupakan jenis penelitian doktrinal dengan menggunakan pendekatan konsep dan perundang-undangan. Permasalahan yang diangkat dalam penelitian ini adalah mengenai bagaimana keberadaan sanksi adat sebagai bagian dari penerapan hukum pidana adat di lingkungan masyarakat adat.  Hasil penelitian menunjukkan bahwa dari berbagai lingkungan masyarakat adat di Kalimantan Timur dan Kalimantan Utara ternyata sanksi terkait hukum pidana adat seharusnya hanya diberlakukan terhadap beberapa perbuatan tertentu saja dan tidak diberlakukan bagi semua orang. Akan tetapi pada kenyataannya masih belum ada kepastian hukum terkait pemberian sanksi pidana adat tersebut. Selain itu ternyata sulit untuk menerapkan aturan hukum pidana adat di tengah masyarakat adat saat ini. Hal tersebut dikarenakan masyarakat sudah banyak yang memahami mengenai keberadaan hukum nasional Indonesia serta cukup beratnya sanksi adat yang dijatuhkan terkait tindak pidana adat.Keyword: hukum, pidana, adat, sanksi
