Abstract

According to Asean Development Bank (ADB) report that for about one to two million people had been sold. Most of them are from poor country, 150.000 from West Asia country and 225.000 from North West Asia Country. The main problem in reducing trafficking in women and child is the weaknesses of law enforcement. Solvement of this case is an ice mount fenomena where the tripe case which accord is more than success to solve and brought to the law process by assosieted party. Abstract

AbstrakPerdagangan karbon adalah masalah universal yang dapat dipraktikkan di setiap negara, termasuk di kawasan seperti Uni Eropa. Uni Eropa adalah satu-satunya organisasi regional yang berpartisipasi sebagai pihak dalam United Nations Framework Convention on Climate Change (UNFCCC). Sejauh ini Uni Eropa telah membentuk kerangka hukum yang paling ambisius untuk pengurangan emisi karbon di dunia. ASEAN sebagai asosiasi perkumplan negara-negara di Asia Tenggara dengan tingkat emisi yang cukup tinggi, baik dari kegiatan berbasis industri maupun aktifitas di darat belum menunjukkan kerjasama jual beli karbon antar anggota ASEAN seperti yang telah dlakukan oleh Uni Eropa. Apakah ASEAN memiliki skema perdagan emisi tersendiri atau ada kema lain yang dapat dicontoh seperti yang terjadi di wilayah Uni Eropa.Kata kunci: Perdagangan Karbon; Uni Eropa; ASEAN; Perubahan Iklim

Abstract

The effort of fulfillment over people's food is a constitutional obligation of the State.  The development of an increasingly large population can threaten the existence of the tropical wet forest area when opening the land needs of food became imperative. As was the case in East Kalimantan, the area of food land is diminishing because over the function of the land are massive for coal mining and palm oil plantations. This will bring up the feared conditions insistence to open forest areas to agricultural land of food.  The Central Government has the authority to make the national policy while the local government is based on the provisions of Division of the authority of Government, have the authority to make policies related to land protection food crop sector ongoing in the area. This article would like to know (1) How is the legal content in the regulation regarding the protection of sustainable food crop lands at the national level; and (2) how is regional can make a regulation of the protection sustainable food crop lands. The method is used the legal research of normative, as well as by the method of analysis is  analytic descriptive. Based on the results of the study it was concluded that the regulation of sustainable food crops land protection at the national level has been set in full, but the content of legal protection, there is a weakness in political designation, which allows agricultural lands sustainable food converted as long as there is not determination as a sustainable agricultural lands. In other words, the provision in The Law No 41 Of 2009 On The Protection Of Land For Sustainable Food  Plantation, but in substance precisely open up opportunities for the occurrence over the function of the land. there is a regulation on the region level regarding legal protection one of them the Regional Regulation No 1 Of 2013 On The Protection Of Sustainable Agricultural Lands, but contain elements of weakness that requires a determination of the agricultural lands before protection While official functionary who is not determination agricultural location does not get strict sanctions. This is a weakness for the agricultural land which has not been established, although physically it is the agricultural land of food, but because there is no designation then will not be affordable by the regulation of the area.

Abstract

Today's labor competition is a problem, especially in the context of reducing unemployment in the region. Since regional autonomy the issue of labor has become a problem that is the authority of the regional government, so the regional government continues to work hard in overcoming the problem. This socio legal research wants to answer two problems, firstly, how the legal arrangement regarding the obligation to employ local labor force that applies. Secondly, knowing and analyzing the implementation related to the obligation to employ local workers based on the provisions of the Regional Regulation of Berau Regency, East Kalimantan Province. Law Number 4 Year 2009 Concerning Mineral and Coal only regulates the obligation to prioritize the use of local labor, likewise in Law Number 13 Year 2003 regarding Manpower there is no regulation on the obligation to employ local workers. This is different from Berau District Regulation No. 8 of 2018 concerning Protection of Local Workers which regulates the obligation to employ local workers as much as 80% (eighty percent) in the company.

Abstract

Indonesia merupakan negara kepulauan dikenal memiliki kekayaan tambang batu bara yang sangat besar. Diperkirakan cadangan Batu bara di Indonesia sebanyak 38 milyar ton. Saat ini Batu bara kembali dilirik sebagai energi alternative, seiring semakin menipisnya cadangan minyak dan gas bumi Indonesia. Beberapa permasalahan dalam pengusahaan pertambangan Batu bara di Indonesia diantaranya : (1) Penguasaan Negara atas bahan galian tambang Batu bara sangat besar; (2) Kebijakan Pertambangan Batu bara Lebih Berpihak Pada modal asing; (3) Konflik Pemilikan lahan dengan Penduduk Lokal dan meniadakan posisi masyarakat adat; (4) Tumpang tindih lahan dengan sektor lain; (5) Pelanggaran HAM dalam Pengusahaan Pertambangan Batu bara; (6) Ketiadaan konsep “Pencadangan Energi”; (7) Tidak berpihak terhadap lingkungan; (8) Reklamasi lahan paska penambangan tidak dilakukan; (9) Rakyat akan mudah dikriminalkan. Kesalahan utama kebijakan dan orientasi pertambangan Batu bara di Indonesia bermula dari ketentuan UU No. 11 tahun 1967 tentang Ketentuan Pokok Pertambangan, yang berorientasi pada kekuatan modal besar dan eksploitatif. Sebagai upaya memutus mata rantai kebijakan pertambangan yang tambal sulam, perlu dilakukan suatu terobosan berani, yaitu melakukan moratorium. Batu bara meskipun menjadi energi alternative saat ini, tetapi sifatnya tetap merupakan kekayaan alam yang tidak dapat diperbarui. Oleh karena itu jika dilakukan penambangan secara terus menerus nasibnya akan sama dengan minyak bumi, pada saatnya akan habis, karena itu diperlukan pengelolaan yang baik dengan startegi pemanfaatan yang bijaksana. Abstract

Oil and Natural Gas Mining is strategic commodity which become one of the Indonesian earnings pledge. According to ability of state, there are various model of mining effort, one of mining effort called Production Sharing Contract on Oil and Natural Gas Mining. Production Sharing Contract is important on Oil and Natural Gas Mining, because according to Undang-undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi, every Oil and Natural Gas Mining must be conducted by an executive body based on cooperation contract. Even if there is Oil and Natural Gas Mining done without cooperation contract with executive body can be told as illegal mining and punishable. Abstract

ABSTRACT The judge took the progressive step. This step strongly supports the prevention and eradication of Corruption Crimes. However, in implementing the revocation of rights, the time limit for revocation must be explicitly given for the right to vote. This study aims to find out additional crimes in the form of revocation of rights to choose and be elected to public office if reviewed from the perspective of criminal law and to find out the compatibility between the decisions of the Supreme Court judge Number 537K / Pid.Sus / 2014 with human rights principles. This study uses doctrinal types. Namely, the authors collect material from the literature. These are hardcopy and softcopy that relate to the title of this study and by using an analysis of the object of research. The results obtained from this study are as follows: 1). Revocation of the right to choose and be chosen should be based on the crime rate, the impact caused to society, and the position of the position while doing the crime of corruption. Revocation of certain rights must be determined by a judge’s decision, and there is a time limit for revocation according to what has been stipulated in article 38 Criminal Code. However, Article 38 of the Criminal Code does not regulate specifically related time constraints for the removal of the right to vote and elected in public office. 2). Revocation of the right to be elected in public office complies with the principles of human rights. It can be said to be included in the category of degradable rights, or rights can be restricted. While the revocation of the right to vote who are not given the time constraints and repeal incompatible with the principles of human rights. Because the right to vote is a fundamental right of every citizen, who has been guaranteed by the constitution of 1945, besides, the time limit for the removal of the right to vote still needed due to respect of human rights offender criminal acts of corruption but to provide justice for victims of crime over the extraordinary crime then the period of revocation may be given more long, judging from the level of crimes committed.Keywords: rights; Human Rights; Revocation; Criminal; Corruption

Abstract

Public participation in the preparation of regional regulations is a right guaranteed by the constitution, especially if the regulations to be made are closely related to the sustainability of the community's living space. This is what underlies community service activities carried out to the coastal communities of Balikpapan Bay through groups of fishermen and activists who focus on environmental and coastal issues with the aim of providing legal understanding and awareness to be involved or participate in the preparation of RZWP3K. With the FGD method through 3 stages which include presentation of material, identification of problems, and preparation of policy briefs, it is hoped that it will be able to provide concrete efforts for community participation in the preparation of regional regulations. Based on the results of community service activities, legal awareness was formed for the participants who attended, as evidenced by the involvement of all participants in the preparation of a policy brief that was submitted to the Kaltim DPRD - Special Committee on the Draft Regional Regulation. at RZWP3K East Kalimantan
