Abstract

Tujuan penelitian untuk menemukan dan menganalisa hukum pidana di dalam pengaturan alat bantu pendeteksi kebohongan (lie detector) di pengadilan dalam pembuktian perkara pidana dan kedudukan pemakaian alat bantu deteksi kebohongan (lie detector) pada proses penyidikan terhadap tindak pidana berlandaskan Undang-Undang No. 8 Tahun 1981 tentang Hukum Acara Pidana. Studi ini memakai pendekatan/metode penelitian hukum yuridis normatif melalui peraturan perundang-undangan serta studi kepustakaan. Hasil studi menunjukkan bahwa dalam konsep penegakkan hukum acara pidana guna mendapatkan kebenaran materiil agar mendapatkan kepastian hukum. Salah satu cara agar mencapainya dengan memastikan keterangan pelaku ataupun saksi berkesesuaian dan tidak rancu/bertumpang tindih antara satu dengan lainnya sehingga keterangannya dapat diberikan secara jujur dengan menggunakan alat bantu pendeteksi kebohongan (lie detector). Pengaturan penggunaan lie detector dalam proses peradilan pidana belum memiliki parameter yang diatur secara tegas dalam KUHAP karena lie detector bukanlah alat bukti yang utama di dalam pengadilan, namun keabsahan lie detector yang digunakan dalam pembuktian perkara pidana di pengadilan yang diperlukannya keterangan ahli laboratorium forensik komputer. Hasil print out tersebut yang dianalisis oleh ahli psikologi forensik yang akan menjadi keterangan ahli yang sah dalam persidangan berkedudukan sebagai alatbukti pelengkap berkas penyidikan, seperti yang termuat dalam ketentuan Pasal 184 ayat (1) KUHAP. The purpose of this research is to find out and analyze criminal law in the arrangement of lie detector tools in proving criminal cases in court and the position of using lie detector in the investigation process of crimes linked to Law Number 8 of 1981 regarding Criminal Procedure Law. This study uses a normative juridical legal research method with a statutory approach and literature study. The results of the study show that in the concept of enforcing criminal procedural law in order to obtain material truth in order to obtain legal certainty. One way to achieve material truth is to ensure that the testimonies of witnesses and perpetrators are compatible and do not overlap with one another so that the information can be given honestly by using a lie detector. The regulations for the use of lie detector in the criminal justice process do not yet have parameters that are strictly regulated in the Code of Criminal Procedure because lie detector is not the main evidence in court, but the validity of lie detector used in proving a criminal case in court is used as a support to the process of disclosing a suspect's testimony in the stage of an investigation process that requires a computer forensic laboratory expert's statement. The print out results from the lie detector serve as a complement to the investigation files analyzed by the forensic psychologist at the trial, which can be used as evidence, as stated in Article 184 paragraph (1) KUHAP.

Abstract

The purpose of this writing is to examine, analyze, and elaborate on the concept of trademark squatting actions and legal protection for registered trademarks due to trademark squatting actions based on good faith in Indonesia. This study is written using normative research methods using statutory approaches, conceptual approaches, and analytical approaches. This study's results shows that the concept of Trademarks Squatting is not regulated in the provisions of the Law on Trademarks and Geographical Indications, but at the international level, WIPO explains that trademark squatting is the act of registering or using a mark which is generally a well-known foreign brand, where the mark has not been registered in a country or the mark has been registered but has never been used by the owner of the mark concerned. As well as, the legal protection of registered trademarks due to trademark squatting in Indonesia, in particular, the possibility of taking legal action against other parties who illegally use a Mark that is essentially similar in terms of rules or its wholeness for similar products or services in the form of a claim for compensations; and/or Termination of all actions related to the use of said Mark based on the stipulations of Article 83 point (1) of the Law on Trademarks and Geographical Indications.
