Abstract

As legal theories and instruments that have been legitimized by many scholars, Maslahah Mursalah and Sadd al-Dzariah become important analytical tools to be observed at the form of their use in the prophetic tradition. They have also a practical significance and relevance in the time of pandemic (Covid-19). Actually, Hadith of Ta’un can be positioned as a precedent value and practice for the Maslahah Mursalah and Sadd al-Dzariah theories in Islamic law. How the Prophet's advice that has been described in the hadith is related to keeping yourself from contracting the virus outbreak, it seems that it can be used as the basis for the current pandemic situation. This research is qualitative in nature, done by using the Usul Fiqh and Hadith Science approaches, emphasizing the use of legal precedent theories. The core existing data is a prophetic living tradition. It is presented in an analytical descriptive manner. The results of this study prove that the Hadith Ta’un is a practical precedent that can legitimize the theory of Maslahah Mursalah and Sadd al-Dzariah as a tool to explore Islamic law and cope with the current situation of the pandemic. The values and principles contained in this Hadith are still relevant today: they can be applied in preventing the transmission of the Covid-19, namely by physical distancing as well as health quarantine and several related adjustments.

Abstract

This article aimed to reveal the periodization of political  and cultural Islam in Indonesia from time to time. In its development, political and cultural Islam had become an entity that hadattracted the attention of academics in Indonesia. Both types of Islam have always been part of the history of this nation. Therefore, the periodization of the rounds needs to be disclosed in a neat and measurable manner. This research was qualitative using a historical approach, and the existing data were presented in a descriptive analytical manner. The primary data of the research covered the statutes and bylaw of Islamic parties, such as Partai Syarikat Islam Indonesia (PSII), Masyumi Party, Partai Persatuan Pembangunan (PPP), Partai Keadilan Sejahtera (PKS) and Partai Bulan Bintang (PBB), while the secondary data were documents of works of Indonesian authors, journals, and online news or articles. The results revealed that the periodization of Indonesian political and cultural Islam started from pre-independence to post-reformation. PSII, Masyumi Party, PPP, PKS and PBB respectively were examples of political Islam that were established in their era. Meanwhile, cultural Islam was patronized by Jam'iyyat al-Khair, Al-Irsyad, Muhammadiyah, Persis and Nahdlatul Ulama (NU). Both types and groups of the Islam basically had the same goal, namely to carry out Sharia. Therefore, for the political and cultural Islam, the power and sympathy of the people seemed to support the realization of this goal.

Abstract

Understanding the meaning of ummiy in the hadith does not seem to be able to be done partially, because this will lead to misinterpretation of a hadith text containing the term. Understanding the meaning of ummiy in the hadith by highlighting aspects of language and history is an important option to do. This can be the basis for placing the meaning of ummiy as the material for the next study. This study aims to reveal the meaning of ummiy in the hadith inclusively and contextually. This research is qualitative in nature using linguistic and historical approaches, and the existing data is presented in an analytical descriptive manner. The results of this study reveal that the term ummiy in the hadith does not only have one meaning, but has multiple meanings. Based on the language aspect, the term ummiy can be interpreted as illiterate, people who are not blessed with books and people who have bad characteristics. Meanwhile, from a historical point of view, the term ummiy is interpreted as illiterate and a title for Arabs in general. Thus, the meaning of the term ummiy needs to be adapted to the context. This relates to the subject characterized by the term, in this case the Prophet himself and the Arabs in general.
