Abstract

ABSTRAKSaat ini wisata syariah yang biasa dikenal dengan wisata religi sedang menjamur, khususnya di Jawa Timur. Sosok yang dianggap wali oleh sebagian orang itu berada di Surabaya, Gresik, dan Tuban, namun saat ini berkembang di kabupaten Jombang, yakni makam Presiden ke-4 Abdurrahman Wahid yang disebut Gus Dur. Penelitian ini bertujuan untuk mengetahui pemahaman masyarakat dalam memanfaatkan peluang wisata religi makam Gus Dur dalam meningkatkan perekonomian masyarakat sekitar pondok pesantren Tebuireng khususnya di dusun Jalan Seblak gang III. Penelitian ini dapat dicermati melalui perubahan kehidupan ekonomi, pemanfaatan peluang usaha dan faktor penghambat bagi kepentingan usaha. Penelitian ini menggunakan metode deskriptif kualitatif dengan teknik pengumpulan data wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa masyarakat setempat mengalami perubahan ekonomi dengan memanfaatkan peluang untuk membangun warung di atas tanah mereka dan menyewakannya kepada pedagang luar. Ini memberikan nilai ekonomi tambahan. Namun, penjualan warung-warung tersebut dinilai tidak mencukupi, sehingga mengharuskan mereka untuk membuka usaha sampingan. Terdapat peluang yang sangat baik bagi masyarakat untuk memilih menyewakan lapaknya karena faktor penghambat yaitu keluarga, tenaga kerja, permodalan, dan rasa empati yang tinggi terhadap pedagang pendatang. Saran bagi Pemerintah Kabupaten Jombang adalah memfasilitasi masyarakat dengan pengetahuan kewirausahaan dengan mengadakan seminar agar memiliki pengetahuan dan motivasi yang tinggi untuk menjalankan bisnis.Kata Kunci: Wisata Religi Makam Gus Dur, Peningkatan Ekonomi, Peluang Usaha. ABSTRACTCurrently, sharia tourism, commonly known as religious-friendly tourism is proliferating, especially in East Java. The figure, who is considered a guardian by some people, is located in Surabaya, Gresik, and Tuban but currently developing in the Jombang district, namely the tomb of the 4th President Abdurrahman Wahid, who is called Gus Dur. This study aims to determine the understanding of the community in taking advantage of religious tourism opportunities in Gus Dur's tomb in improving the community's economy around the Tebuireng Islamic boarding school, especially in the hamlet of Street Seblak street alley III. This study can be observed through changes in economic life, utilization of business opportunities and inhibiting factors for business interests. This study uses a qualitative descriptive method with interview and documentation data collection techniques. The results of this study show that the local community is experiencing economic changes by taking advantage of the opportunity to build a warung on their land and rent it out to outside traders. It provides added economic value. However, the sales of the stalls are considered insufficient, so they require them to open a side business. There is an excellent opportunity for the community to choose to rent out their stalls because of the inhibiting factors, namely family, labour, capital, and a high sense of empathy for migrant traders. The suggestion for the Jombang Regency Government is to facilitate the community with entrepreneurial knowledge by holding seminars to have high knowledge and motivation for business interests.Keywords: Religion Tourism of Gus Dur Tomb, Economic Improvement, Business Opportunity. REFERENCESAbdi, M. Abstract

The court is a place to seek justice. It is a place that must be respected. However, there are still many cases of contempt of court.  This is contrary to the Criminal Code and Islamic law.  This study examines the contempt of court perspective of Islamic law. This research is a library and qualitative research. Data collection is carried out through literature studies derived from laws, books, and journals. The collected data is described for deductive analysis using Islamic law. The results of the study mentioned that in Indonesia there is no specific law on Contempt of court.  Contempt of court is based on criminal code articles 210, 2lindung16, 217, 221, 222, 223, 224, 225, 242, 222, 231, 232, 233, 317, 417, 552.  In Islamic law, contempt of court is a prohibited act as described in the Qur'an and hadith. The sentence is in accordance with the form of the contempt of the court perpetrator's actions and the consequences they cause. If the terms of his sentence are not mentioned in the Qur'an and hadith, then the judge can decide based on his ijtihad called ta'zir.

Abstract

During the Covid-19 pandemic, the family cluster was among the clusters that caused the spread of this virus. For families exposed to this virus, their family's resilience has been tested. This article discusses the resilience of families exposed to Covid-19 to be analyzed in maqasid al-shari’ah. The method used in this research is qualitative and field research. Data were collected through observation, interviews, and documentation. The collected data were analyzed as normative-descriptive. This study concluded that families exposed to Covid-19 work together to fight this virus by adjusting their respective conditions. For the mild, they self-isolate at home, and those with severe illnesses are hospitalized. If a family dies from Covid-19, the family left behind is isolated. What the family exposed to Covid does is maintain family resilience and maintain the physical and psychic health of the family. From the perspective of maqasid al-shari'ah, the effort corresponds to the concepts of hifz al-din (guarding religion), hifz al-nasl (guarding offspring), hifz al-nafs (guarding the soul), and hifz al-'aql (guarding reason).

Abstract

Kekerasan seksual masih banyak terjadi di kampus, karena itu perlu ada pencegahan kekerasan seksual di perguruan tinggi. Di UIN Sunan Ampel Surabaya, salah satu lembaga yang berperan penting dalam mencegah kekerasan seksual di kampus adalah pusat studi gender dan anak (PSGA). Artikel ini membahas tentang peran PSGA UIN Sunan Ampel Surabaya dalam mencegah kekerasan seksual di kampus dalam prespektif hukum pidana Islam. Penelitian ini adalah penelitian lapangan dan kualitatif. Penelitian dilakukan di UIN Sunan Ampel Surabaya. Pengumpulan data dilakukan melalui wawancara, observasi dan dokumentasi. Data yang terkumpul dideskripsikan untuk dianalisis secara deduktif dengan menggunakan perspektif hukum pidana Islam (fiqh al-jinayah). Hasil penelitian menyebutkan bahwa PSGA UIN Sunan Ampel Surabaya berperan penting dalam mencegah kekerasan seksual di kampus. PSGA UINSA berupaya mencegah kekerasan seksual di kampus dengan menerapkan asas kampus responsive gender, membentuk SATGAS PPKS, dan aktif mensosialisasikan anti kekerasan seksual di kampus kepada stake holder. Jika ada laporan kekerasan seksual di kampus, maka PSGA berkoordinasi dengan pihak terkait dalam menyelesaikan kasus tersebut dengan memberikan hukuman kepada pelaku dan melindungi korban sesuai dengan prosedur yang ada. Dalam perspektif hukum pidana Islam, peran PSGA tersebut telah sesuai dengan teori zawajir (pencegahan) dan jawabir (paksaan).

Abstract

Fiqh al-aqalliyyat plays an important role in addressing the unique challenges faced by Muslim minority communities in multicultural societies. In multicultural societies, where diversity and multiple cultures are embraced, issues relating to values, culture, and customs can lead to discrimination or marginalisation of certain groups. Therefore, it is important to promote equality, inclusion and non-discrimination, which allows all individuals to feel valued, respected and have equal access to opportunities. Muslim minority groups, such as Shia Muslims and Ahmadiyya Muslims, face particular challenges in a multicultural society like Indonesia. The study of fiqh al-aqalliyyat in multicultural societies, particularly in Indonesia, aims to understand how Islamic law is applied to Muslim minority communities and their religious practices. Qualitative research using concept analysis is used to examine fiqh al-aqalliyyat from the perspective of Yusuf al-Qaradawi. Data source triangulation and content analysis techniques were used to collect and analyse primary and secondary data. In conclusion, fiqh al-aqalliyyat plays an important role in addressing the challenges faced by Muslim minority communities in a multicultural society. By adopting a comprehensive approach that considers various aspects of their lives, fiqh al-aqalliyyat aims to promote the rights, obligations, and welfare of minority groups while respecting Islamic principles. The development and application of fiqh al-aqalliyyat are constantly evolving to adapt to the ever-changing realities and contexts faced by Muslim minority communities.

Abstract

Abstract: There are regulations on marriage for widows or widowers of the deceased State Civil Apparatus. Widows/widowers of civil servants who pass away continue to receive pension benefits while unmarried. However, some widows/widowers from ASN still perform siri (secret) marriages to get alimony funds. This article discusses the law of siri marriage for widows/widowers of civil servants from the perspective of maqasid al-shari'ah. This research is normative. Data comes from rules, books and journal articles. The collected data were analyzed with the theory of maqasid al-shari'ah deductively. The results of the study concluded that one of the factors for widows/widowers of civil servants remarrying siri is to continue to receive pension benefits. It is as stipulated in Law Number 11 of 1969 concerning Employee Pension and Employee Widow/Widower Pension article 9, which states that widows/widowers of deceased civil servants are entitled to benefits while unmarried. If they remarry, they will have their benefits cut off. Siri marriages with such intentions violate maqasid al-shari'ah, especially in hifz al-nasl, because it is incompatible with the purpose of marital benefit and is opposed to hifz al-mal because it is part of fraud. Abstrak: Terdapat peraturan khusus tentang perkawinan bagi janda atau duda dari Aparatur Sipil Negara yang meninggal. Janda/duda dari ASN yang meninggal dunia, tetap mendapat tunjangan pensiun selama tidak menikah. Namun, terdapat janda/duda dari ASN yang melakukan nikah seacra siri agar tetap mendapat dana tunjangan. Artikel ini membahas tentang hukum pernikahan siri bagi janda/duda ASN dalam perspektif maqasid al-shari’ah. Penelitian ini adalah penelitian normatif. Data berasal dari undang-undang, buku dan artikel jurnal. Data yang terkumpul dianalisis dengan teori maqasid al-shari’ah secara deduktif. Hasil penelitian menyimpulkan bahwa salah satu faktor janda/duda ASN menikah lagi secara siri adalah untuk tetap mendapat tunjangan pensiun. Hal tersebut sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 1969 tentang Pensiun Pegawai dan Pensiun Janda/Duda Pegawai pasal 9, yang menyebutkan bahwa janda/duda dari ASN yang meninggal berhak mendapat tunjangan selama tidak menikah. Jika menikah lagi, maka akan terputus tunjangannya. Pernikahan siri dengan maksud tersebut telah menyalahi maqasid al-shari’ah, khususnya dalam hifz al-nasl karena tidak sesuai dengan tujuan kemaslahatan perkawinan dan bertentang dengan hifz al-mal karena bagian dari penipuan. Abstract

Abstract: This article discusses the development of Muslim women in Libya. Women in society play a role that surpasses the role of men in the growth and development of society, as women are half of society. Women in the pre-Islamic era were a commodity that men owned, and they did not have any rights. At the beginning of Islam's advent, women's status changed a lot, and women became entitled to many rights and status. In addition to obtaining all their rights recognized by the Islamic religion and accompanied by Libyan legislation, Libyan women have incited the inclusion of women's rights through the ratification of international conventions and women's participation in all fields. Women's rights are their right to education, their right to choose a husband, their right to litigation, to defend their financial rights and to remedy injustice against them, women's right to work and to hold public office, women's right to judicial and litigation functions,  women's right to political participation and community development, and women's right to health care. Keywords: Women, Muslimah, Islam, Libya.   الملخص: إن هذه المقالة تبحث تطور المرأة المسلمة في ليبيا. المرأة في المجتمع  تلعب دورًا يتفوق على دور الرجل في نماء المجتمع وتطوره، فالمرأة هي نصف المجتمع. كانت المرأة في الجاهلية عبارة عن سلعة تخضع لملكية الرجل ، ولم تكن لها أي من الحقوق. وبداية ظهور الاسلام تغير وضع المرأة كثيرا واصبحت المرأة لها كثيرا من الحقوق واصبحت لها مكانة. إن المرأة الليبية اضافة الي حصولها على جميع حقوقها التي اقرها الدين الاسلامي وواكبتها التشريعات الليبية التطور فحرضت على تضمين حقوق المرأة من خلال التصديق على المواثيق الدولية ومشاركة المرأة في كل المجالات. فحقوق المرأة هي حقّها  في التربية والتعليم، حقّها في اختيار الزوج وحقها في التَّقاضي والدِّفاع عن حُقوقها الماليّة ورفع الظلم عنها، حق المرأة  في العمل و تولي الوظائف العامة، حق المرأة في تولي الوظائف القضائية والتقاضي، حق المرأة في المشاركة السياسية و تنمية المجتمع، وحق المرأة والرعاية الصحية. الكلمات الرئيسيه: المرأة، المسلمة، اسلام، ليبيا.

Abstract:  In this article, the researcher presents the development of the Islamic world in Libya and beginning by talking about the entry of Islam into Libya and focusing on the Maliki school, which is one of the most prominent elements of this development, and then presents the role of the Senussi movement. It turns out that the entry of Islam to Libya and its development was early since the Islamic conquest of it in the first century AH and the seventh AD in the time of Caliph Omar bin Al-Khattab, and Libya embraced in the period of the Islamic conquest has the remains of some companions, may God be pleased with them, who were martyred in order to spread Islam in this country, the most famous of which are Al-Munaidher Al-Afriqi in the city of Tripoli, Ruwaifa Al-Ansari in the city of Al-Bayda, Abu Sajeef bin Qais in the city of Misrata, Zuhair Al-Balawi, Abu Mansour Al-Farsi and Abdullah bin Righteousness and both three in the city of Derna, and the development of Islam with the spread of the Maliki school and the emergence of scholars who contributed to its dissemination not only in Libya but in all countries of the Arab Maghreb, such as Sheikh Ali bin Ziyad Trabelsi, where the Maliki school was among the foundations in the development of Islam in Libya, and was associated with various aspects and formed an identity for Libyans throughout the ages, and the Senussi method formed a significant role in the development of Islam in Libya and played an essential role in spreading Maliki jurisprudence and the pure Sufi way far away On heresies and superstitions and in the dissemination of Maliki jurisprudence, as well as in the jihad movement against the Italian colonizer. Keywords: evolution, world, sect, Islam, Libya. الملخص: في هذه المقالة يعرض الباحث لتطور العالم الإسلامي في ليبيا والبداية بالحديث عن دخول الإسلام لليبيا ومركزا على المذهب المالكي الذي يعد من أبرز عناصر هذا التطور ثم يعرض لدور الحركة السنوسية. يتبين أن دخول الإسلام لليبيا وتطوره بها كان مبكرا منذ الفتح الإسلامي لها في القرن الهجري الأول السابع الميلادي في زمن الخليفة عمر بن الخطاب ، واحتضنت ليبيا في فترة الفتح الإسلامي لها رفات بعض الصحابة رضي الله عنهم الذين استشهدوا في سبيل نشر الإسلام في هذا البلد من أشهرهم المنيذر الأفريقي في مدينة طرابلس، ورويفع الأنصاري في مدينة البيضاء، وأبو سجيف بن قيس في مدينة مصراته، وزهير البلوي وأبو منصور الفارسي وعبد الله بن بر وكلا الثلاثة في مدينة درنة، وتطور الإسلام بانتشار المذهب المالكي وبروز علماء ساهموا في نشره ليس في ليبيا فقط بل في كل أقطار المغرب العربي مثل الشيخ علي بن زياد الطرابلسي، حيث كان المذهب المالكي من بين الأسس في تطور الإسلام في ليبيا، وارتبط بالنواحي المختلفة وشكل هوية لليبيين على مر العصور، كما شكلت الطريقة السنوسية دورا كبيرا في تطور الإسلام في ليبيا ولعبت أدورا مهما في نشر الفقه المالكي والطريقة الصوفية النقية البعيدة عن البدع والخرفات وفي نشر الفقه المالكي وكذلك في حركة الجهاد ضد المستعمر الإيطالي. الكلمات المفتاحية: تطور، العالم، المذهب، الإسلام، ليبيا.

Abstract

Abstract: Modern scholars know the clash of two conflicting currents of thought, between the extreme right (tafrith) and the extreme left (ifrath) currents. This is very dangerous for Islamic civilization. Therefore, wasathiy (moderate) Islamic scholars, such as Muhammad Imarah (1931-2020) seek to direct Muslims to understand and implement the teachings of wasathoy Islam. This article discusses Muhammad Imarah's thoughts on the fiqh of moderation. This research is literature and qualitative. Data collection is carried out through a literature review and analyzed descriptively. The results of the study concluded that about moderation fiqh, Muhammad Imarah argued that moderate ijtihad needs to be developed for now. Muhammad Imarah stated that the relationship between text and ijtihad is always side by side (al-talazum wa al musahabah daiman wa abadan), there is a text, there is ijtihad and ijtihad departs from the text, and ijtihad is to peel the meaning contained in a text to decide the fiqh law of the text. The fiqh verdict is subjective because it takes the form of conjecture (al-dhan).
