Abstract

Islamic stocks is one of the instruments in islamic capital market which isoperated based on islamic principles. Islamic stocks are the securities proof ofequity participations in the company and with the evidence of these investments,the shareholders are entitled to receive part of the profits. Operationalmechanisms of islamic stocks is differently in each country. There are someproblems of the mechanisms on screening process. Assessment criteria of islamicstocks broadly divided into qualitative and quantitative criteria. Qualitativecriteria are based on halal and haram, while quantitative criteria are based onthe financial performance of the company. There is a differences of shari?acriteria in each country, specially at JII, DJIM, and KLSI. The differences willimpact to growth and development of islamic stocks in each country.

Abstract

Buying and selling over motorcycle financing with profits in the District of Ingin Jaya, namely by transacting motorbikes that are still in financing by obtaining profits and this has become a habit for the people of the Ingin Jaya community. for this reason, the sellers and buyers need to know how the practice of buying and selling over motorcycle financing with profits that are in accordance with the perspective of the sale al-ba’i and hiwalah. In this study the authors used a descriptive analysis research method based on data obtained from interviews with Yamaha Sales Executive, Second Motorbike business owner Umar Matang and buyers from the general public which included transaction procedures and understanding in the agreement to set prices until the transfer was made. The results show the agreement between the seller and the buyer is based on a sense of willingness and an element of help on the condition that the leasing company that provides financing know and approves the transfer is made. And the buyer of the transferred motorbike of the Financing negotiates the transfer price with the first owner and later the buyer of the second motorbike will continue the remaining deposit. From the perspective of the Hiwalah and al-ba'i and Al-Milk At-Tamm contracts, the transfer and sale and purchase transactions that occur are very much in accordance with the concept of Hiwalah, al-ba'i, and complete ownership requirements (Al-Milk At-Tamm) in fiqh muamalah, and also the profits obtained are considered legitimate in buying and selling because the profits are obtained from goods that have clear ownership and are known between the two so that neither party is injured. The transaction has also become a good habit for the people of the District of Ingin Jaya.

Abstract

This study aims to find out how Ijarah in Islamic finance. This research is a type of library research (libraty research) which focuses on qualitative data management with data analysis methods using descriptive-analysis method. The results of this study are: In Banking, two types of Ijarah. The first ijarah is done in cash between the bank as a renter and the one who rents out services. The second ijarah is made in installments between banks as tenants to customers. The bank also takes advantage of this ijarah transaction. Islamic banks that operate ijarah products do leasing, both in the form of operating leases or financial leases. But in general, more Islamic banks use ijarah vomiting tamlik bit (IMBT) because it is simpler in terms of bookkeeping. Ijarah contract development is also known as ijarah muntia bi at-tamlik (IMBT).

Abstract

The mode of trading transactions continues to develop day by day, one of which is the presence of trading transactions through electronic systems. Sellers and buyers no longer need to meet face to face to carry out buying and selling transactions, but can be created remotely and form agreements using electronic media. The Indonesian government has issued special regulations governing trade transactions through this electronic system, namely Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems, and the rules regarding electronic contracts are contained in articles 50 to 57. This study aims to find out how the regulations regarding electronic contracts in PP No. 80 of 2019 and the view of Islamic law on electronic contracts. The type of research used is library research, with the primary sources of this research being Government Regulation Number 80 of 2019, the Civil Code, and fiqh books. While secondary sources include writings on electronic contracts in the form of books, journals, and other writings related to electronic contracts. The result of this research is that electronic contracts in PP No. 80 of 2019 are created when the parties mutually agree to carry out trading transactions using an electronic system. Regarding the mechanism of the contract itself, it is left to the parties to determine what kind of contract they want. Electronic contracts in muamalah contracts as regulated in PP No. 80 of 2019 from the perspective of Islamic law is legal and permissible, in accordance with fiqhiyah rules, namely the law of origin of muamalah is permissible (al-ibahah) as long as there is no evidence that prohibits it. Electronic contracts, in this case, are legal and permissible according to Islam as long as they fulfill the pillars and conditions of the contract (akad) and there are no elements that are invalidated and damaged by it such as fraud, coercion, usury and etc.

Abstract

Para ulama masih berbeda pendapat terkait talak orang yang sedang mabuk. Ada ulama yang menyatakan talak orang yang sedang mabuk tidak jatuh. Namunn ada juga ulama yang berpandangan talak orang mabuk dibolehkan. Salah satu tokoh ulama yang pendapat dibolehkan yaitu Ibn Rusyd yang berpandangan bahwa talak orang mabuk dibolehkan, talaknya dipandang jatuh. Perbedaan pandangan tersebut yang kemudian menarik untuk dikaji perspektif Ibn Rusyd tentang hukum talak kondisi mabuk, dalil dan metode istinbāṭ hukum Ibn Rusyd dalam menetapkan hukum talak saat kondisi mabuk, serta relevansi pendapat Ibn Rusyd terkait hukum talak dalam keadaan mabuk dalam konteks kekinian. Pendekatan kualitatif digunakan dalam kajian untuk mendapatkan pandangan Ibn Rusyd terkait hal tersebut. Menurut Ibn Rusyd, talak dalam kondisi mabuk dibagi ke dalam dua kriteria. Pertama, talak dalam kondisi mabuk yang mabuknya tidak disengaja, maka talaknya tidak sah dan tidak jatuh. Kedua, talak dalam kondisi mabuk yang mabuknya disengaja, maka talak suami jatuh. Orang mabuk berbeda dengan orang gila. Orang mabuk merusak akal sehatnya dengan keinginannya sendiri, sedangkan orang gila tidaklah seperti itu, hal itulah yang menyebakan talak orang mabuk tetap jatuh, hal itu merupakan bentuk pemberatan baginya. Dalil yang digunakan Ibn Rusyd mengacu pada surat al-Baqarah ayat 229, riwayat Malik dari Sa’id bin Musayyab dan Sulaiman bin Yasar, serta atsar sahabat, yaitu Umar Bin Khatthab. Adapun metode istinbath hukum yang digunakan Ibn Rusyd ialah metode bayani dan ta’lili. Dalam konteks kekinian, talak kondisi mabuk mungkin sekali ada dan terjadi di tengah-tengah masyarakat. Hanya saja, talak suami dalam kondisi mabuk dan dilakukan di luar peradilan secara hukum tidak memiliki kekuatan hukum, kecuali suami mengajukan permohonan talak ke Mahkamah Syar’iyah atau Pengadilan Agama di tempat domisilinya. Untuk itu, pandangan Ibn Rusyd tentang jatuhnya talak dalam kondisi mabuk yang disengaja tidak relevan dengan konteks saat ini, sebab talak hanya diakui di depan pengadilan.

Abstract

Walimatul'urs is a recommendation in Islam. Walimatul 'urs aims as syi'ar and becomes a sunnah muakadah. In the Aneuk Jamee community, the traditional walimah has several series of customs running for seven days, thus many costs must be incurred during the implementation of this waimah. So that many people who have walimah choose to go into debt when they are going to have walimah. Walimah is considered important and has its own position for the Aneuk Jamee community. With this assumption, it is not uncommon to find that they are willing to borrow for the sake of carrying out walimah. In this study, the main problem in this study is how the practice of walimah 'urs in the aneuk jamee community and how the practice of walimatul 'urs in the aneuk jamee community from the perspective of maqāṣid shariah. The data obtained by the authors were obtained from observations and interviews with the community and related traditional leaders. From the results of the research, many of the Aneuk Jamee community carry out walimah beyond their ability, with the seven-day traditional series that costs a lot so that debt is the best way for the implementation of walimah. Walimatul 'urs in the perspective of maqāṣid shari'ah, if it is difficult then it is not in accordance with maqāid shari'ah because in the context of maintaining the inheritance of marriage it should not be forced so that debt can cause harm to debtors whose purpose is to maintain existence in the community so that it causes redundancy.
