Abstract

Dalam rangka menciptakan peradilan yang bersih dan transparan sebagai wujud pencapaian tujuan hukum (kepastian, kemanfaatan, dan keadilan) Komisi Pemberantasan Korupsi Indonesia bekerja sama dengan 34 Perguruan Tinggi se Indonesia untuk melaksanakan kegiatan perekaman persidangan Tindak Pidana Korupsi secara audio dan visual. Tujuan kegiatan ini disamping sebagai wujud pemantauan dari sisi peradilan juga dimanfaatkan sebagai bahan kajian mahasiswa yang terlibat dalam kegiatan perekaman ini untuk memperdalam kajian hukum acara pidana.Penelitian ini menghasilkan kajian berupa data empiric terhadap efektifitas kegiatan perekaman sidang tindak pidana korupsi. Dalam penelitian dikemukakan bahwa kegiatan pemantauan persidangan ini secara sistematis dilakukan untuk karena secara substansi hukum telah memperoleh pengakuan secara hukum, namun masih beberapa hambatan dalam sisi teknisnya, terkait sikap korporatif pihak pengadilan dalam mendukung kegiatan perekaman ini.

Abstract

Every human being has rights that have been given since humans are in and the right to life is an absolute right that must be lived by every human being. Law Number 39 of 1999 concerning Human Rights does not provide space for euthanasia because euthanasia is contrary to the provisions of the Human Rights Law, especially the right to life of a person. The right to life in Law Number 39 of 1999 concerning Human Rights explains that every human being or every person without exception has the right to life, the right not to be tortured, the right to personal freedom thought and conscience, the right to religion, the right not to be enslaved, the right to recognized as a person and equality before the law, and the right not to study based on applicable law is a human right that cannot be reduced under any circumstances and by anyone.

Abstract

Penelitian bertujuan untuk menganalisis masalah potensi korupsi lingkungan hidup dilingkungan pemerintah daerah. Penelitian dilakukan dengan metode penelitian hukum normatif. Hasil penelitian bahwa terhadap potensi terjadinya Tindak Pidana Korupsi Di Lingkungan Pemerintah Daerah dengan pencegahan sejak dini sehingga tidak membudaya dan akan merusak serta merongrong sendi-sendi perikehidupan berbangsa dan bernegara melalui tangan -tangan oknum yang tidak bertanggungjawab dengan memanfaatkan peluang untuk kepentingan pribadi dan golongan melalui Pengawasan Internal dan Eksternal, Kontroling dan evaluasi serta Koordinasi. Upaya-upaya yang ditempuh dalam rangka Meminimalisir Tindak Pidana Korupsi Di Lingkungan Pemerintah Daerah melalui transparansi, regulasi, independensi, sanksi, akuntabel, kerja ihklas, kerja cerdas, kerja keras, tertibu, teratur, imtak. This study aims to analyze the potential problems of corruption in local government circles. The research was conducted by using normative legal research methods. The results of the study show that the potential for Corruption in the Local Government Environment with early prevention so that it does not become cultured and will damage and undermine the joints of the life of the nation and state through the hands of irresponsible individuals by taking advantage of opportunities for personal and group interests through supervision Internal and External, Control and evaluation as well as Coordination. Efforts taken in order to Minimize Corruption in Local Government Environments through transparency, regulation, independence, sanctions, accountability, clever work, smart work, hard work, orderly, orderly, imtak.

Abstract

Procurement of goods and services through electronics (e-procurement) is a system that can be applied because it is more transparent, effective and efficient when compared to the conventional system of procurement of goods and services (face to face). In this article the author limits the study of the effectiveness of the application of law to the procurement of goods/services by the government which is carried out through conventional and electronic methods. In this paper, using a normative juridical method, namely analyzing the enactment of the rule of law and then describing it systematically. The current legislation regarding the procurement of goods and services through electronics can be said to be ineffective because the legal regulations have not specifically regulated this matter, both in substance and in technical implementation. So it is necessary to immediately establish a law that regulates the procurement of goods and services through electronics (e-Procurement). This regulation will be the basis for implementing e-Procurement, given the increasingly complex problems in the procurement of goods and services, these regulations continue to be adjusted and changes and improvements are made, both in terms of substance and technical supporting regulations.
