Abstract

Abstrak: Artikel ini berbicara tentang penyelesaian sengketa wakaf dalam sejarah hukum Islam. Permasalahan wakaf telah muncul di awal sejarah Islam. Sehubungan dengan sengketa tentang status harta sebagai wakaf telah muncul pada masa lalu  disebabkan oleh perubahan sosial; pergeseran nilai dan tatanan masyarakat, dan ditambah lagi dengan masalah bahwa tidak adanya bukti tertulis yang menyatakan bahwa status suatu harta sebagai objek wakaf. Pada tulisan ini dikemukakan kasus-kasus permasalahan sengketa wakaf yang terjadi pada awal periode Islam dan kasus-kasus kontemporer tentang sengketa perwakafan serta penyelesaiannya, yang terjadi di Indonesia pada beberapa dasawarsa yang lalu.Abstract: The Settlement of Religious endowment (waqf) Dispute: A Socio-Historical Approach of Islamic law. This paper concentrates on the settlement of religious endowment (waqf) dispute in the perspective of Islamic law history. The disputes relating to waqf  has emerged since the early development of Islamic history. In regard with the conflict of the status of waqf property, the disputes have originated from the social change, the shift of values in the society, and the absence of written evidence of waqf property. This article will elaborate the cases of waqf disputes which occured in the early periods of Islam and the contemporery cases along with the settlement of the disputes taking place in Indonesia in the last few decades.Kata Kunci: Hukum Islam, Hukum Perwakafan, Sejarah Sosial Hukum Islam

Abstract

This article concentrates on Islamic law product relating to charitable religious endowment (waqf) in Indonesia. Based on the traditional perspective of fiqh originated from the earlier Islamic jurists of orthodox view and in turn it had long been legislised as part of Indonesia positive law system, the law of waqfhad regulated that the wealth to be waqf shall be limited to only unmoving properties.  This regulation had led the management of waqf to be unproductive to raise the social welfare.By the virtue of the relatively wider viwpoint of the contemporar y Islamic law thinkers,the Islamic law refor m takes place in Indonesia particularly at the level of postive law ,namely Law Number 41/2004 Relating to Waqf. This law stipulates the thing to be waqf could be either unmoving or moving properties, like cash, gold, certificate of obligation, inteletual wealth, and so forth. This law also lays down the regulation relating to the penalty against those who deviate in managing a waqf. However, as a critque and recommendation the writer propose that the society could be involved in preser ving the purpose of a waqf which is the right of Allah. And it could be conducted by stipulating the class action as a way of the settlements of dispute occuring to a waqf property.

Abstract

The poor utilization of zakat funds given to mustahik is the driving force behind this study. According to several observations made by researchers, some mustahik do not utilization the ZIS funds in accordance with their designation, either in operating or growing their business. In some cases, there are also some Mustahik who used the ZIS funds for personal needs without disclosing how they were used. The goal of this study was to determine the impact of transparency as an intervening variable on the distribution and utilization of zakat infaq and shadaqah (ZIS) money on mustahik consumption behavior. This study is quantitative in nature. 62 samples make up the research's sample. A closed questionnaire on mustahik BAZIS Darul Mursyid Islamic Boarding School is used as the data gathering tool. The inner model, outer model, and testing of the intermediary hypothesis are all used in data analysis. Based on the research findings, it is known that the study's variables can explain 88.8% of the variance, while the consuming behavior variable's R2 value is 0.836, or 83.6 percent, and 16.7% of the variance can be accounted for by other study factors. The study's findings show that there is no relationship between distribution and transparency, but there is a relationship between utilization and transparency, and there is a relationship between distribution and consumption behavior. However, there is no relationship between transparency and consumption behavior, and there is no relationship between distribution and utilization.

Abstract

Theoretically, Islamic doctrines can adapt to the situation and conditions of reality. However, in Islamic history, it isn't easy to find studies about the importance of establishing a relationship with nature or the environment in which that reality stands. This research offers a paradigm that bridges the new relationship between humans and the environment. At this level, the author builds a paradigm with a multidisciplinary approach. Methodologically, maqa>s}id al-shari>'ah is used as a paradigm foundation and umbrella for human actions when responding to their environment. This study found that the maqa>s}id al-shari>'ah-based eco-spiritual paradigm is embodied in spiritual actions in the form of sacralization and ecological contemplativeness. Explicatively, sacralization and ecological contemplativeness are applied based on the principles of Islamic ethics, al-insija>m (harmony), al-iqtis}a>d (equality), al-ta'a>nu>q (interdependency), and al-tanz}i>f (cleaning).

Abstract

Penelitian ini bertujuan untuk mengetahui (1) Pelaksanaan program keluarga berencana pada pasangan Muslim di bawah umur di Kabupaten Mandailing Natal. (2) Persfektif Maqoshid Syariah terhadap pelaksanaan program keluarga berencana pada pasangan Muslim di bawah umur di Kabupaten Mandailing Natal. Penelitian ini menggunakan pendekatan kualitatif bersifat deskriptif. Subjek penelitian ini yaitu pasangan suami istri yang menikah berkisar di bawah usia 18 tahun di Kabupaten Mandailing Natal, petugas pelayanan KB di Puskesmas Mandailing Natal, Kepala DPPKB Madina sesuai data yang dibutuhkan dan Kepala KUA di Kabupaten Mandailing Natal.Teknik pengumpulan data dalam penelitian ini yaitu wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa (1) Pelaksanaan Program Keluarga Berencana di Kabupaten Mandailing Natal masyarakat memiliki kesadaran yang tinggi sehingga melakukan program KB, dilihat dari kondisi ekonomi yang dibilang pas pasan dan kondisi usia yang belum siap untuk mempunyai anak sehingga mereka perlu melakukan program KB tersebut supaya anak-anak yang dilahirkan sesuai yang diharapkan terpenuhi kebutuhannya, sehat serta mandiri. (2) Perspektif Maqoshid Syariah, Keluarga Berencana merupakan salah satu upaya menciptakan keluarga berkualitas, baik secara agama maupun kemanusiaan. Di dalam Maqhashid Syari’ah Pemeliharaan keturunan atau Hifz al-nasl merupakan kebutuhan yang dharuriyyat yakni kebutuhan utama yang harus di pelihara dan dilindungi dengan sebaik-baiknya oleh syari’at islam sebagai orang tua, mengikuti program KB bisa menjadi kebutuhan sekunder atau kebutuhan hajiyyat bagi keluarga, yang mana keberadaannya dibutuhkan untuk memberikan kemudahan serta menghilangkan kesukaran dan kesulitan dalam kehidupan keluarga.

Abstract

Penelitian ini bertujuan untuk mengetrahui (1) Pengetahuan peran mediator sebagai pembelajaran tentang perkara perceraian (2) Faktor penghambat dan pendukung mediator dalam melaksanakan mediasi. (3) Efektivitas mediator dalam menyelesaikan masalah. Penelitian ini menggunakan pendekatan kualitatif bersifat deskriptif. Subjek penelitian ini yaitu pembelajrar hakim, mediator, Panitera, Panitera Muda. Teknik pengumpulan data dalam penelitian ini yaitu wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa (1) Pelaksanaan pembelajaran proses mediasi sesuai dengan PERMA No. 01 Tahun 2016 tentang prosedur mediasi PERMA tersebut sebagai acuan dalam mengaplikasikan mediasi. (2) Faktor keberhasilan mediasi dari aspek para pihak dan mediator sebelum melakukan proses mediasi dia memiliki pengetahuan terlebih dahulu permasalahan penyebab perkara yang dihadapi oleh kedua belah pihak sebagai seorang mediator. Faktor penghambat pelaksanaan mediator ada pada berbagai aspek, yaitu: durasi waktu mediasi, jumlah perkara perceraian yang banyak membuat hakim merangkap menjadi hakim mediator, mediator non hakim yang dari luar pengadilan yang hanya berjumlah dua orang saja sehingga sangatlah terbatas. (3) Pengetahuan tentang PERMA No. 01 Tahun 2016 belum efektif karena presentase dari perkara yang dicabut (berhasil di mediasi) tidak sampai, hal itu di karenakan unsur dari penegak hukumnya yang kurang memadai. Jika dilihat dari teori efektivitas hukum baikdari faktor hukum PERMA No. 01 Tahun 2016, faktor penegak hukumnya (mediator), faktor sarana prasarana, faktor masyarakat dan faktor kebudayaan di Pengadilan Agama Padangsidimpuan belum efektif

Abstract

This research is motivated by a phenomenon where in several previous studies that the religiosity of interest and awareness of civil servants in paying zakat is still quite low where when there is an appeal from the Padang Sidimpuan Ministry of Religion to distribute zakat to the profession, the acquisition of zakat can reach Rp. 4,600,000 s.d. Rp. 4,800,000. But at this time, in the absence of direct deductions, the zakat received is only around Rp. 1,000,000 to Rp. 2,000,000. So the purpose of this research is to find out how religiosity, income and education actually influence the intention to pay zakat through awareness. This research is a quantitative study with a total sample of 45 samples. The data collection instrument was carried out by conducting structured interviews with each respondent by providing a questionnaire to fill out. Data analysis used the outer model test, the inner model and tested the hypothesis on each of the variables studied. Based on the research results, it is known that there is an influence between religiosity on awareness (3.122 > 1.96) and p-value < 0.05 (0.003 < 0.05). There is no effect between income on awareness (0.747 < 1.96) and p-value > 0.05 (0.459 > 0.05). There is an influence between education on awareness (2.192 > 1.96) and p-value < 0.05 (0.034 > 0.05). There is an influence between religiosity on intention to pay zakat (6.167 > 1.96) and p-value < 0.05 (0.000 < 0.05). There is no effect between education on intention to pay zakat (1.922 < 1.96) and p-value > 0.05 (0.214 > 0.05). There is an influence between awareness of interest in paying zakat (2.685 > 1.96) and p-value < 0.05 (0.010 < 0.05). There is no influence between religiosity on intention to pay zakat through awareness (1.732 < 1.96) and p-value > 0.05 (0.090 > 0.05). There is no influence between income on intention to pay zakat through awareness (0.651 < 1.96) and p-value > 0.05 (0.519 > 0.05). There is no influence between education on intention to pay zakat through awareness (1.922 > 1.96) and p-value > 0.05 (0.214 > 0.05) at Madrasah Aliyah Negeri 2 Padangsidimpuan.

Abstract

Penelitian ini dilakukan untuk menganalisis kontribusi dan interaksi antara variabel inflasi, ekspor, impor dan pembiayaan perbankan syariah terhadap pertumbuhan ekonomi di Indonesia.Metode penelitian yang digunakan yaitu dokumentasi dan tinjauan literature. Teknik analisis data menggunakan teknik Vector Auto Regression (VAR) dengan alat bantu Eviews 10. Hasil penelitian menunjukkan bahwa untuk jangka panjang  inflasi dan impor berpengaruh positif terhadap pertumbuhan ekonomi sementara ekspor dan pembiayaan perbankan syariah berpengaruh negatif terhadap pertumbuhan ekonomi di Indonesia. Begitu juga sebaliknya untuk jangka pendek. Sementara dalam jangka pendek variabel inflasi, eskpor, impor dan pembiayaan perbankan syariah bisa saling  memiliki hubungan dengan variabel itu sendiri.
