Abstract

Mediasi penal dikenal dalam sistem peradilan pidana di Indonesia dilatar belakangi pemikiran yang dikaitkan dengan ide-ide pembaharuan hukum pidana (penal reform), dan dikaitkan dengan masalah pragmatism atau kekakuan hukum dalam menjawab persoalan yang ada dalam masyarakat. Latar belakang pragmatisme antara lain untuk mengurangi stagnasi atau penumpukan perkara, mediasi penal yang dimaksud adalah merupakan proses restorative justice dalam hukum pidana yang dilakukan dengan cara mediasi antara pelaku dan korban dengan tujuan. Dalam perspektif sosiologi hukum dan berorientasi pada budaya, masyarakat di Indonesia pada umumnya, khusunya di Kabupaten Gorontalo memiliki mekanisme penyelesaian konflik yang berbasis adat istiadat yang senantiasa mengedepankan pemecahan masalah secara bersama-sama dengan tujuan untuk memperbaiki atau mereparasidengan cara konfrensi yaitu mempertemukan pelaku dan korban, keluarga dari kedua belah pihak serta tokoh masyarakat.Penelitian ini bertujuan untuk mengetahui kedudukan hukum proses penyelesaian tindak pidana (kejahatan) melalui mediasi penal oleh masyarakat desa, serta untuk mengetahui faktor yang mempengaruhi proses penyelesaian tindak pidana (kejahatan) melalui mediasi penal oleh masyarakat desa di Kabupaten Gorontalo.Adapun metode yang digunakan dalam penelitian ini adalah penelitian sosio yuridis yaitu penelitian hukum yang mempelajari hubungan timbal balik yang terjadi antara hukum dan perkembangan yang ada dalam masyarakat.Kata kunci : Mediasi Penal, Masyarakat Desa

Abstract

Penelitian ini bertujan untuk menganalisis penyebab tingginya angka cerai gugat dan untuk mengetahui solusi terhadap tingginya cerai gugat di Pengadilan Agama Gorontalo. Penelitian ini menggunakan jenis penelitian empiris. Hasil penelitian menunjukkan bahwa tingginya faktor cerai gugat disebabkan dengan berbagai faktor, yaitu: faktor ekonomi, faktor pihak ketiga dan faktor moral. Ketiga faktor ini menjadi penyebab utama. Adapun solusi cerai gugat adalah melakukan mediasi kepada para pihak dan memberikan penyuluhan hukum kepada masyarakat terhadap dampak percerain.

Abstract

The future of the Indonesian nation is very dependent on the condition of today's children. Therefore, future attention to children is the main focus, especially for Correctional Students (ADP) who live in the Special Child Development Institution (LPKA). One of the things that is of concern to children who are behind bars is the right to obtain formal and informal education. The purpose of this study was to analyze and evaluate the implementation of the fulfillment of the right to education for correctional students and to design an ideal model of fulfilling the right to education for children in Class II LPKA Gorontalo. The type of research used in this research is empirical normative legal research. The research results show that the educational process for ADP at LPKA is carried out in accordance with the mandate of Law Number 22 of 2022 concerning Corrections where ADP can pursue formal or informal education. In the implementation of formal learning process activities, there are still obstacles in the form of learning processes carried out outside LPKA, so it is necessary to formulate a learning model that should be made like a child-friendly school within LPKA and supported by educators who are truly competent and experienced in educating children.

Abstract

The implementation of a community service program sponsored by the Legal Aid Institution of Ichsan University Gorontalo. The initiative took place at the office of the sub-district head in Dulalowo Village, Central City District, Gorontalo City, where the community faced challenges in comprehending the legal regulations governing electronic transactions (e-commerce). This lack of awareness often led to disputes and losses between businesses and consumers. The program aimed to empower the community through the empowering the community on legal protection in electronic transactions (e-commerce) program. A combination of surveys, questionnaires, lectures, and discussions was employed to achieve the desired outcomes. The results of this community service initiative demonstrated a noteworthy improvement in the participants' understanding of legal norms and juridical foundations concerning electronic transactions (e-commerce). As a result, the community became more discerning and cautious when engaging in online transactions, now equipped with knowledge about safe and secure strategies for conducting such transactions. The positive impact of this endeavor contributes to a more informed and confident community in Gorontalo City, fostering a thriving e-commerce environment for both businesses and consumers alike
