Abstract

Tanah merupakan salah satu bagian terpenting bagi masyarakat. Keterikatan masyarakat dengan tanah yang dipijak semakin kentara bagi suatu masyarakat adat. Tidak jarang kepemilikan atas tanah adat pun berpotensi menimbulkan konflik, sebagaimana yang akan dibahas dalam artikel ini. Tanah Pauman merupakan objek pembahasan tulisan ini dan secara spesifik akan dibahas bagaimana model pendaftaran hak atas tanah dalam perspektif Hukum Agraria Nasional dan implikasi pendaftaran tersebut. Dari hasil penelitian ditemukan bahwa konversi tanah pauman dengan menggunakan ’Pura Pauman’ sebagai subjek hak merupakan model pendaftaran menurut Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria yang mampu melestarikan ’pemilikan komunal pauman’ serta aspek kepastian hukum, perlindungan, kemanfaatan sekaligus sebagai upaya pelestarian warisan nilai budaya. The Model of Registration on The Right of Pauman Land as King’s Rewards to Preserve The Cultural Heritage in Karangasem District AbstractLand is among the most important aspect of a community. It is even more evident in the tight-knit relationship between indigenous people and their land. Unfortunately, there are often conflicts regarding ownership of indigenous land as will be discussed in this article. This article will be discussing the issues regarding Pauman Land, specifically how is the model of land registration under the Basic Agrarian Law perspective and the implications that will follow. The result of the research shows that the conversion of Pauman Land by using ‘Pauman temple’ as a subject of right is the registration model pursuant to Basic Agrarian Law which is able to preserve ‘pauman communal ownership’ as well as legal certainty aspect, protection, expediency as the effort of heritage cultural value at once. Keywords: legal certainty, cultural value, heritage cultural preservation, land registration, Pauman land. DOI: https://doi.org/10.22304/pjih.v4n2.a10

Abstract

Corruption is the act of someone who enriches or is selfish or a certain group of people in abusing the position that has been given. This is the same as what happened in the embezzlement of funds by one of the administrators of the Tanggahan Peken Traditional Village Credit Institution located in Banjar Tanggahan Peken, Sulahan Village, Susut District, Bangli Regency. This research was conducted to reveal the form of criminal liability of LPD management who embezzled customer funds at LPD Sulahan Village, Susut District, Bangli Regency. This research was conducted using empirical legal research methods and using a legal concept analysis approach which was carried out by understanding legal concepts, views and doctrines that developed in legal science. Sources of data used in the form of primary and secondary data. The collected data were analyzed using the Qualitative Method. From the data that has been analyzed, it is revealed that after the trial the LPD management is required to continue to return the money from the embezzlement of funds that is enjoyed by unscrupulous management, not as a result of the actions of the management which results in a difference of 27 billion.

Abstract

Abstract

Financial Technology (Fintech) is a technology alternative that facilitates loan transactions that can be done online. Online loans create new problems such as rampant fraud and default. Referring to the problems described, this research was conducted with the aim of explaining the legal position of financial technology-based online loan agreements (Fintechl), and knowing the legal protection of creditors who provide financial technology-based online loans (Fintech). This research used normative legal research. Sources of data are primary and secondary legal materials, data are combined with recording techniques in obtaining primary and secondary legal materials, namely examining several reading materials such as journals, scientific books and statutory regulations. After the data is collected, it is then analyzed qualitatively. The result showed that the legal position of online loan agreements based on financial technology (Fintech) when reviewed legally, the online agreement is legally valid because it has a basis, namely Article 1320 of the Civil Code and the validity of the evidence used refers to law Number 11 of 2008 concerning Article 5 of the ITE Law on information, documents and electronic signatures. Legal protection for creditors in an online loan agreement based on financial technology (Fintech) consists of preventive legal protection and repressive legal protection.

Abstract

LPD is an economic institution belonging to the Traditional Village. LPD is formed, managed by Desa Pakraman, and serves financial transactions only within the internal environment of Desa Pakraman. LPD administrators are elected, stipulated, legalized, and dismissed by means of the village paruman. From all levels the LPD management comes from indigenous peoples and cannot avoid problems that arise in the institution, thus, this research focuses on to manage loans (credit) to customers so as to avoid bad credit at the Village Credit Institution (LPD) Adat Ungasan and to examine the responsibility of the Ungasan Traditional Village Credit Institution (LPD) in fulfilling the rights of customers who hold deposits. The research method used in this research is empirical research method. Based on the research results, it can be concluded that there are four parts to the procedure for giving credit to the LPD, namely: The Credit Section, the Head of the LPD, the Cashier Section and the Bookkeeping Section. Furthermore, all losses of the Ungasan Traditional Village LPD shall be borne by the Traditional Village, in the event that the Traditional Village is able to back up the losses of the Ungasan Customary LPD, provided that the old Ungasan LPD administrators cover all losses to the Traditional Village because the Traditional Village is a communal customary organization or promoting togetherness

Abstract

Economic developmentin era globalization increasing, with finance becoming necessity for every human being. research problems are: What factors cause bad credit at Surya Mandiri Savings and Loans Cooperative Gianyar Regency and how bad credit settlement efforts through litigation at Surya Mandiri Savings and Loan Cooperative Gianyar Regency This type research used Empirical Law. the factors that cause bad credit in cooperatives are internal factors that cause bad credit originating from the cooperative itself, external factors are factors that cause bad credit originating from customer side. Non-litigation is settlement of disputes outside the court that closed to public and the confidentiality of the parties guaranteed. Litigation dispute resolution is dispute resolution carried out through the court. It can be concluded that factors that cause bad credit at Surya Mandiri Savings and Loan Cooperative in Gianyar Regency are internal factors and external factors. The settlement of bad credit at Surya Mandiri Savings and Loan Cooperative in Gianyar Regency can be done by non-litigation and litigation. should not only pursue profit, but must be more assertive and apply the principle of prudence and Head of the cooperative credit department must be more careful providing loans to borrowers.

Abstract

Penerapan sistem manajemen koperasi yang belum tepat dimasa pandemi covid-19, model format perjanjian simpan pinjam yang belumsesuai dengan kondisi pandemi covid-19, kredit macet, menganalisa perjanjian kredit dan mengubahnya agar lebih baik serta mengawasi penarikan kredit macet. Beberapa hal tersebut merupakan masalah yang terdapat di koperasi simpan pinjam selama masa pandemi covid-19. Penelitian ini bertujuan untuk mengembangkan koperasi melalui pendekatan pembinaan, pendampingan, dan sosialisasi. Penelitian ini merupakan penelitian pengabdian yang berlokasi di Koperasi Simpan Pinjam Shanti Prapta Sedana. Karena kekuatan koperasi berada di tangan anggotanya, maka kesadaran akan disiplin dan fanatisme anggota sangat penting guna meningkatkan pemahaman koperasi serta etos koperasi yang perlu ditanamkan pada setiap anggota. Dalam rangka pengembangan sumberdaya manusia pada koperasi dapat menempuh pendekatan baik struktural maupun kultural. Pendampingan Koperasi Simpan Pinjam Santhi Prapta Sedana ini juga dilakukan via telefon, WhatsApp, Zoom Meeting, dan secara langsung agar lebih berjalan maksimal. Berdasarkan hasil penelitian pengabdian ini, tim pengabdian memberikan pendampingan dengan memberikan usulan-usulan terkait masalah penarikan kredit bermasalah dan membina para anggota yang bermasalah diantaranya reconditioning, restructuring, cashflow, write off.

Abstract

Social contract theory is the theory that illustrates the origin of a state formation. The theory of social contracts is composed of several instruments, including natural human rights, morals and mutual agreement (common will). Humans (individuals) surrender their rights to the ruler (state). The rights that are handed over to the state include rights in the field of public law (public interest). One of the rights in the field of public law is the right to establish norms in criminal law (ius poenale) and the right to convict (ius puniendi). Through the existence of penal mediation in Indonesia, the state's right to convict offenders is reduced. It also means that the rights handed over by individuals to the authorities (state) in social contracts are reduced. Its theoretical implication is that the right of the state to impose criminal sanctions on offenders who are based on the surrender of individual rights to social contracts, begins to be purified again with the settlement between individuals through penal mediation on violations of public (criminal) law that take place.

Abstract

This article discusses problems of corruption which until now hasn’t been completed in its eradication process. Every effort is made to find both internal and external causes in order to get the solution. The problem that is studied sociologically is, why is corruption incomplete? If corruption isn’t yet complete, and work isn’t finished yet, then how can work be completed? Understanding Corruption can be called work is complete, must be understood from the anti-corruption values and principles contained therein. It’s include honesty, independence, discipline, responsibility, hard work, simple, courage, and justice. It’s need to be applied by each individual to be able to overcome external factors so that corruption doesn’t occur. To prevent the occurrence of external factors, in addition to having it, each individual needs to deeply understand the anti-corruption principles of accountability, transparency, fairness, policy, and policy control. Therefore the relationship between anti-corruption principles and values is an inseparable unity. Success or failure to solve the problem of corruption is expected in the legal system that makes the handle in solving corruption cases, namely strengthening the legal structure, legal substance and legal culture of the community.

Abstract

The inheritance and the division of inheritance that is felt to be unfair is often a source of dispute. The disputes that occur can sometimes be resolved by making a peace agreement between the disputing parties. The peace desired by the parties is, of course, expected to end disputes/conflict and to provide legal certainty among those in dispute. However, sometimes peace agreements that have been made between those in dispute are disputed again in court. This study aims to examine the settlement of Balinese traditional inheritance disputes through a binding peace agreement between the parties make it. The method used in this study is a normative legal research, using a statute approach and a case approach. The result of this study showed that the settlement of Balinese indigenous inheritance disputes through a binding peace agreement of the parties that make it if the peace agreement is made based on the validity of the agreement as stipulated in article 1320 of the Civil Code, based on good faith as the principles in the law of the agreement, and must be made in the form of a notary deed is in accordance with the provisions for conciliation in book III of the Civil Code.
