Abstract

Abstract: This article discusses about dissenting opinion and concurring opinion in the decision of the Constitutional Court. Law enforcement can be done through the Constitutional Court in the form of law judicial review. The issue of dissenting opinion is regulated through Law No. 24 Year 2003 and Constitutional Court Regulation No. 6 of PMK Year 2005 concerning Procedural Law of Tests of Act. The phrase used in the Constitutional Court Law is “the different opinion of the judiciary members". The different opinion, according to Jimly, is divided into two namely dissenting opinion and concurrent opinion. A verdict is considered concurring if there is an argument by a member of the panel of judges that is different from that of the other members of the judiciary but it does not affect the difference of the decision. On the other hand, a decision is said to be dissenting if the opinion of a member of the panel of judges is different from that of the majority of the other members of the panel of judges and the difference is not merely in the case of reasoning but to touching on the verdict. Abstrak: Penegakan hukum dapat dilakukan melalui pengadilan oleh Mahkamah Konstitusi dalam bentuk pengujian terhadap undang-undang. Masalah dissenting opinion diatur melalui Undang-Undang Nomor 24 Tahun 2003 dan Peraturan Mahkamah Konstitusi Nomor 6 PMK Tahun 2005 tentang Hukum Acara Pengujian Undang Undang. Frase yang dipakai dalam UUMK adalah “pendapat anggota majelis hakim yang berbeda”. Pendapat yang berbeda menurut Jimly, dibedakan menjadi dua yaitu dissenting opinion dan concurrent opinion. Suatu putusan dianggap sebagai concurring apabila terdapat argumentasi anggota majelis hakim yang berbeda dengan mayoritas anggota majelis hakim yang lain, namun tidak berimbas pada perbedaan amar putusan. Di sisi lain, suatu putusan dikatakan dissenting, jika pendapat suatu anggota majelis hakim berbeda dengan pendapat mayoritas anggota majelis hakim yang lain dan sampai menyentuh pada amar putusan. Abstract

Dalam rangka meningkatakan kesejahteraan di desa-desa, Undang-Undang Nomor 6 Tahun 2014 tentang Desa memberikan sebuah instrument bagi Desa untuk melakukan kegiatan usaha melalui Badan Usaha Milik Desa. Penelitian ini bertujuan untuk mengenalkan Badan Usaha Milik Desa kepada masyrakat di Desa Sumberanyar, Kecamatan Nguling, Kabupaten Pasuruan dalam rangka meiningkatkan kesejahteraan di desa tersebut. Penelitian di awali dengan Assesement Masalah dan Kebutuhan Desa, Focus Group Discussion, dan diakhiri dengan Legalitas BUMDes. Dari penelitian ini menunjukan, bahwa masyrakat di Desa Sumberanyar, Kecamatan Nguling, Kabupaten Pasuruan memiliki antusiasme yang tinggi terhadap pembentukan Badan Usaha Milik Desa di desa tersebut dan berharap kedepannya terdapat pelatihan-pelatihan terkait dengan pengurusan Badan Usaha Milik Desa tersebut agar pengurus-pengurus yang ada dapat menjalankan fungsi dan tugasnya dengan baik

Abstract

Decentralisation puts weigh in the dynamic of local government. As consequences of decentralization, local governments are entitled to enact local regulation in order to serve public services in the daily basis. Local regulation as the product of the Mayor of course does not stand alone. It is part of national legislative system which lay at the low tier of the hierarchy of laws. It should be work effectively and harmoniously with the system. By analyzing the nature of decentralization and the function of local legislation, it is essential to establish a good review mechanism for this legislative product. Different mechanism results in different consequences to the regulation. This article has analysed three mechanisms both preventive and represive; executive review which is done by the Governor and National Government; judicial review which is done by the Court and even political review which is exercised by the local representatives who act as balancing power to the local executive.Keywords: Peraturan Kepala Daerah, Executive Review, Judicial Review, Political Review

Abstract

This research aimed to analyze the Indonesia constitutional court decisions which contain dissenting opinion regarding the constitutionality of the law. As a part of constitutional court law of procedure, some constitutional judges allowed to give their different opinion against the majority of the judges. In one hand, this action has reflected the independency of the judges cum the independency of the judicial power. On the other hand the dissenting opinion has raised a question concerning the legitimacy of the decision since the decision was not decide unanimously. This research is doctrinal research which means that all the material will be analyzed by using the law, court decisions and law principles.Keywords: dissenting opinion, decision, constitutional review.

Abstract

Based on the Decree of the People's Consultative Assembly in 1999, the legal status of the territory of Timor Leste is no longer the territory of the Unitary State of the Republic of Indonesia. With the establishment of the state of Timor Leste, between Indonesia and Timor Leste, boundaries of land and sea need to be included which cover territorial, ZEE and continental shelf boundaries, especially in the southern waters and north of the island of Timor, including the Oecusse enclave area. The negotiators of the two countries have not succeeded in agreeing on several Oecusse borderlines with the Indonesian territory. Various methods have been pursued including involving indigenous peoples. At present, the Oecusse enclave is designated as a special economic zone by Timor Leste with the aim of optimizing the area as a border area and having adequate economic activities so as to improve the quality of the local community. As an alternative effort in resolving regional boundary agreements, the application of the principle of Uti Possidetis Juris, which is a principle of territorial claims based on the Uti possidetis doctrine, means that a newly independent state inherits administrative boundaries formed by the previous authorities, so that the historical and conceptual approaches in the stipulation are established. It is recommended to avoid different interpretations between the two countries, and regional boundaries can be resolved immediately.
