Abstract

Kerahasiaan itu diperlukan untuk kepentingan bank, dimana bank memerlukan kepercayaan dari masyarakat yang menyimpan uang. Lingkup rahasia bank memang menyangkut simpanan nasabah. Ketentuan rahasia bank menurut Undang-Undang No. 10 Tahun 1998 berlaku bukan saja menyangkut keadaan keuangan dari nasabah penyimpan dana (pasiva bank), tetapi berlaku pula bagi kredit yang diperoleh oleh nasabah debitur dari bank tersebut (aktiva bank). Hal tersebut berdasarkan penjelasan Pasal 44 ayat (1) dan ayat (2) yang berkaitan dengan informasi antara bank mengenai kredit. Kendala Penerapan Prinsip Kerahasiaan Bank Terhadap Tindak Pidana Penggelapan Oleh Pemegang Jabatan Di Bagian Kredit Dihubungkan Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan adalah rahasia bank pengaturannya belum mamadai. Akibatnya kurang memberikan perlindungan hukum bagi pihak-pihak yang terkait, sehingga dapat menimbulkan inefisiensi, karena banyaknya pertanyaan dan kasus-kasus pelaporan yang menyangkut rahasia bank.

Abstract

Tanah carik atau yang juga sering disebut dengan tanah bengkok, merupakan aset desa yang pemanfaatannya digunakan sebagai kompensasi atas kedudukan mereka sebagai pamong desa. Perlindungan Hukum Terhadap Masyarakat Penggarap Lahan Carik Yang Dialih Fungsikan Tanpa Hak di Kecamatan Sukawening Kabupaten Garut adalah ada tiga cara yang dapat dilakukan dalam rangka memberikan perlindungan tanah carik desa. Pertama, melalui tindakan-tindakan yang diperlukan agar supaya pelanggaran terhadap tanah carik desa tidak akan terjadi atau disebut dengan pencegahan (preventif). Kedua, bilamana pelanggaran atas tanah carik desa telah terjadi, maka upaya hukum tidak lagi bersifat preventif, tetapi menjadi korektif karena tujuannya melakukan koreksi terhadap akibat-akibat yang terjadi karena adanya perbuatan yang dilakukan oleh pelanggar hak. Ketiga, penjatuhan sanksi yang tegas. Kendala Perlindungan Hukum Terhadap Masyarakat Penggarap Lahan Carik Yang Dialih Fungsikan Tanpa Hak di Kecamatan Sukawening Kabupaten Garut adalah Kendala dalam proses peralihan hak atas tanah carik desa yang dikelola masyarakat kepada pemerintah desa meliputi adanya penolakan masyarakat terhadap upaya yang dilakukan oleh pemerintah desa terhadap pengambil alihan tanah carik desa, tidak adanya payung hukum berupa peraturan daerah dalam kaitannya dengan administrasi kewenangan pemerintah desa atas pengelolaan tanah carik desa.

Abstract

Digitalization of information is the process of converting various information, news, or news from an analog format into a digital format so that it is easier to produce, store, manage, and distribute. Court services have been initiated since the issuance of the 2010-2035 judicial reform blueprint. The process of digitizing court services begins with document administration, with the application of the SIPP which then extends to case processing from registration to the issuance of decisions that have legal force. Electronic justice where all case related processes can be served on e-court and e-litigation applications. Applications in court can continue to develop along with the demands of the justice seekers' needs.

Abstract

The replacement of ASN with robotics has actually been seen with various digital transformations carried out by the government. The current government continues to carry out digital transformation in the services provided by the management of the state civil apparatus. This has been going on for several years. The use of technology is seen as achieving bureaucratic effectiveness and budget savings, because with so many positions being replaced by technology, the state certainly does not need to pay salaries for civil servants. To accelerate the process of developing the Indonesian bureaucracy SuperApp, it is necessary to immediately build a National Data Center as a home for One Data Indonesia, build shared information and communication technology (ICT) infrastructure, prepare machine learning and artificial intelligence (AI) technology that will be used to bigdata analytics as the basis for various decision-making and policy development needs. With the Indonesian bureaucracy's SuperApps, various public services can be done online.

Abstract

The factors that cause business fraud under the guise of a pyramid scheme in the territory of Indonesia can be categorized into 2 (two) namely internal and external factors. Internal factors that arise from the perpetrators, such as greed for profit, and the use of public ignorance. As for the external factors that arise from the victim, such as being easily influenced by persuasion, still has a practical mindset, and lacks information. Another factor is due to economic pressure. The countermeasures carried out by the police are carried out in a preventive manner by conducting press releases, outreach, and education to the public in collaboration with the Investment Alert Task Force formed by the OJK by the Regional Police and repressive efforts are carried out with investigations and investigations related to business cases under the guise of implementing a pyramid scheme.

Abstract

Polri dalam penegakan hukum penimbunan bahan pokok berupa minyak goreng bakal menindak tegas para pelaku atau masyarakat yang mencoba melakukan penimbunan minyak goreng yang kemudian dijual kembali dengan harga yang tinggi. Pemerintah menetapkan harga jual minyak goreng Rp14.000/liter untuk seluruh kemasan berbagai merek. Lakukan penindakan bila ada upaya aksi borong dan penimbunan, khususnya minyak goreng kemasan premium. Apabila ada yang kedapatan melakukan tindak pidana tersebut bakal dijerat pidana penjara tak akan lolos dari hukum. Hal ini sesuai Pasal 107 Undang-Undang (UU) Nomor 7 Tahun 2014 tentang Penimbunan, dengan ancaman 5 tahun atau denda Rp50 miliar. Polri juga mengantisipasi terjadinya penimbunan minyak goreng satu harga Rp 14.000 di seluruh wilayah Indonesia. "(Polri) antisipasi adanya aksi borong dan penimbunan. Antisipasi Polri dilakukan dengan berkoordinasi bersama Kementerian Perdagangan dan Dinas Perdagangan baik di provinsi, kota, dan kabupaten. Koordinasi itu terkait penerbitan peraturan pelaksanaan / teknis penjualan minyak goreng satu harga Rp14 ribu per liter. Yang dibatasi 2 liter setiap pembelian.

Abstract

The reason is that civilians without official military missions like Deddy Corbuzier can be awarded the title of Lieutenant Titular. Abstract

In Law Number 1 of 2023 concerning the Criminal Code, especially Article 281, criminal acts against the court process (contempt of court) are punishable by imprisonment for a maximum of 1 year or a fine of up to 10 million rupiah. The actions included in the offense of contempt of court, among others, are aimed at anyone who: Does not comply with a court order or a judge's decision issued for the benefit of the judicial process. Being disrespectful to judges or the trial or attacking the integrity or impartiality of judges in court proceedings; or Unlawfully record, publish directly, or allow for publication anything that can affect the impartial nature of judges in court hearings. The environment of the court body must be able to become a legal institution that is trusted by the public. These events should be viewed from the perspective of the "consequences" that events could have had. Some of the public are of the opinion that sometimes courts are not really a place to seek and find justice. This assumption arose because of a number of previous events. For example, there were cases of judges and other court officials who were tried and convicted of accepting bribes. Another incident, there are arrears of cases that are not terminated in accordance with the principle of simple and fast. Therefore, it is important to strengthen public trust. This is to reduce the number of contempt of court and to foster the public's desire to maintain and protect the honor of the court and judges from all forms of harassment.

Abstract

Presidential Regulation (Perpres) Number 15 of 2021 concerning the Organization and Work Procedure of the Prosecutor's Office of the Republic of Indonesia, revising Presidential Regulation Number 38 of 2010. The existence of this Perpres, attorney General's Office(AGO) officially has a Deputy Attorney General for Military Crimes. The Deputy Attorney General for Military Crimes has the duty and authority to carry out the duties and authorities of the Prosecutor's Office in the field of technical coordination of prosecutions carried out by the prosecutor and handling connectivity cases.
