Abstract

Efforts Made to Overcome Counterfeiting Crimes in the Passport Making System is the Imposition of criminal sanctions related to immigration criminal acts can be carried out effectively if the government conducts effective supervision and legal action against individuals, corporations and officials of relevant government agencies involved in activities that lead to the criminal act of immigration by imposing the maximum sanctions both imprisonment and fines, another effort is by the application of biometric technology, different from the previous technology that separates the making of photographs and fingerprints.Biometric technology can narrow the process within minutes connected online with the central office as a storage of biometric data (face and fingerprint) and between immigration offices to prevent the acquisition of multiple passports to the same person because they have multiple identity documents, the passport data is not necessary again sent to Kemkumham, because the data has been centralized online.

Abstract

The cause of disparities in punishment in the settlement of criminal cases is the independence of judges in carrying out their profession. The existing laws do not regulate or limit the minimum sentence imposed upon the accused. Based on the basic experience, the consideration of the defendant's condition includes the individual, the behavior of the community, the financial situation and social status. The disparity in court decisions in cases of corruption can lie on legal paradigm by formulating the contents of legislation properly, avoiding mistakes in interpreting the law, using reasoning both deductively and inductively and discovering legal values ​​that live in the society. Criminal disparities cannot be eliminated by themselves. Therefore, there must be benchmarks with transparency in the imposition of criminal sanctions in accordance with the principles of criminal procedural law. Abstract

AbstractThe law plays an important role in the economic development of a nation but in order for the law to be able to play its role in providing legal certainty for economic operators, government as policy maker for the law. Setting investment law in an effort to create an investment climate, has started with the presence of the Capital Market Law normatively accommodate the various interests of foreign investors. For example, there is the provision and maintenance of non-discrimination, which is given to local entrepreneurs or domestic arena market share, investment protection and guarantees against the threat risk of nationalization and exports, and the guarantee of the right to transfer profits or dividends, as well as the right to carry out settlement law through international arbitration.

Abstract

Faktor-faktor yang menghambat pemeliharaan pendaftaran hak atas tanah hasil lelang di kantor pertanahan Kabupaten Garut adalah pemenang lelang seringkali mengulur waktu dalam melakukan proses peralihan haknya tersebut, sehingga menghambat kinerja Kantor Pertanahan. Tanah hasil lelang tersebut melekat Hak Tanggungan yang tidak dibersihkan atau diroya, sedangkan peroyaan tersebut sangat penting bagi keperluan peralihan hak karena pelelangan tersebut karena apabila tidak ada pernyataan roya maka pihak Kantor Pertanahan tidak dapat melakukan proses pendaftaran hak atas tanah hasil pelelangan tersebut menjadi terhambat karena ulah kreditor yang tidak tahu aturan sebenarnya. Kantor Pertanahan masih bersifat pasif, karena menunggu data atau dokumen dari pemohon, jadi, tertib administrasi yang diharapkan menjadi kurang terlaksana dengan baik. Lambatnya pelayanan disebabkan karena selain kurangnya tenaga pelaksana dibandingkan dengan volume pekerjaan, dan terkesan pelayanan tersebut oleh masyarakat masih dirasakan lambat, sulit berbelit-belit, dan mahal. Upaya kantor pertanahan Kabupaten Garut dalam pemeliharaan pendaftaran hak atas tanah hasil lelang adalah adanya penambahan petugas pelaksana pada setiap kegiatan pelayanan pertanahan, sehingga proses pelayanan akan dapat berjalan lebih cepat, efisien dan efektif.

Abstract

Ekonomi pembangunan adalah menciptakan upaya-upaya untuk memperbaiki taraf hidup masyarakat. Serangan wabah virus Corona atau Covid-19 diprediksi bakal memukul ekonomi global. Di Indonesia sendiri, Covid-29 akan memperburuk ekonomi Indonesia, bahkan pertumbuhan ekonomi diprediksi bakal tumbuh hanya sebesar 2,5 persen bahkan bisa mencapai 0 persen. Kecepatan pemulihan ekonomi tergantung kepada kombinasi kebijakan yang pas antara kebijakan pemutusan sebaran virus (virus containment secara maksimum) dan kebijakan ekonomi (intervensi kebijakan ekonomi yang maksimum). Proyek Prioritas Strategis (Major Project) dalam RPJMN 2020-2024 akan menjadi fokus dalam rencana dan anggaran RKP. Major Project yang menjadi fokus pemulihan ekonomi seperti membangun 10 destinasi pariwisata prioritas, proyek 9 kawasan industri di luar Jawa dan 31 smelter, industri 4.0 di 5 sub sektor prioritas, pendidikan dan pelatihan vokasi untuk industri 4.0, jaringan pelabuhan utama terpadu, integrasi pelabuhan perikanan dan fish market bertaraf internasional, kemudian penguatan jaminan usaha serta 350 korporasi petani dan nelayan.

Abstract

Pengaturan bentuk badan usaha terhadap pelaksanaan PMA merupakan perintah dari UU Penanaman modal yang bertujuan untuk memberikan kepastian hukum kepada setiap penyelenggaraan PMA di Indonesia. hal tersebut tidak lain bertujuan agar penanaman modal yang menjadi bagian dari penyelenggaraan perekonomian nasional dapat ditempatkan sebagai upaya untuk meningkatkan pertumbuhan ekonomi nasional, menciptakan lapangan kerja, meningkatkan pembangunan ekonomi berkelanjutan, meningkatkan kapasitas dan kemampuan teknologi nasional, mendorong pembangunan ekonomi kerakyatan, serta mewujudkan kesejahteraan masyarakat dalam suatu sistem perekonomian yang berdaya saing. Asas kepastian hukum merupakan suatu asas termasuk kedalam nilai dasar hukum. Asas ini pada pokoknya mengharapkan dan mewajibkan hukum dibuat secara pasti dalam bentuk yang tertulis.

Abstract

The legal power of digital signatures in business transactions is the Law of the Republic of Indonesia Number 11 of 2008 concerning Electronic Information and Transactions, which explicitly acknowledges that electronic signatures have legal force and legal consequences as long as the electronic signature follows the requirements stated in Article 11 of the ITE Law which is a minimum requirement and must be met in every electronic signature creation, the level of security of an electronic signature will be guaranteed if it has an electronic certificate containing the information or identity of the user, the electronic certificate is obtained on the basis of an application to the Certification Authority (CA) by the user (subscriber) . Dispute Resolution in the Use of Digital Signatures in business transactions is based on the agreement of both parties regarding the choice of law and the institution that resolves the problems that occur.

Abstract

The regulation for chemical castration is contained in Law Number 17 of 2016 concerning Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection. Chemical castration sanctions through a long process are listed in article 81, article 82 and article 81A of Law Number 1 of 2016 as an additional punishment and it can be an option for law enforcement officers, especially judges as judges in the trial to give punishments with the aim of deterrence For the perpetrators, chemical castration sanctions are considered in accordance with the purpose of punishment. Criminal sanctions are one of the methods used to achieve the purpose of holding criminal penalties. The application of the castration penalty has not yet been implemented.

Abstract

The culture of proving electronic evidence in law enforcement of criminal acts of terrorism in Indonesia is Law Number 11 of 2008 concerning Information and Electronic Transactions ("UU ITE") which provides a legal basis for the legal culture of electronic and formal evidence and material. requirements for electronic evidence to be accepted in court. Electronic Evidence is Electronic Information and/or Electronic Documents that meet the formal requirements and material requirements stipulated in the ITE Law. Article 5 paragraph (1) of the ITE Law stipulates that Electronic Information and/or Electronic Documents and/or their printouts are legal evidence. The implementation of the regulation of electronic evidence in law enforcement of criminal acts of terrorism in Indonesia is the use of evidence in the form of wiretapping and video recordings which were actually applied in the 2002 Bali Bombing Case. 1 of 2002 concerning the Eradication of Criminal Acts of Terrorism. Despite the controversy, the Public Prosecutor emphasized that the reading of the statements of witnesses from Malaysia and Singapore who were unable to attend the trial was legal because it was in accordance with the description of the evidence in the law. The same is regulated in the Law on Information and Electronic Transactions. Article 5 states that electronic information and/or printed electronic information are legal evidence and have legal consequences. Of course, electronic information is declared valid if it uses an electronic system in accordance with the applicable laws and regulations.
