Abstract

AbstractThe principle of legality currently in effect in Indonesia still has weaknesses when faced with actions that are included in the Crimina Extra Ordinary which cannot be reached by the legality principle. The problem that arises is that the act causes harm to the victim, and the perpetrator cannot be convicted. This problem is formulated in the question: how are the limitations of the legality principle related to the protection function for victims? how is the construction of the ideal legality principle in providing protection for victims? The writing of this article uses normative legal research that discusses the legality principle as the basis for the implementation of punishment using a conceptual approach to the legality principle. The analysis technique used is deductive analysis technique, with the nature of prescriptive analysis. The result of this research is the concept of extending the legality principle that provides equal protection for the perpetrators and victims of crime to replace the current formulation of the legality principle, which does not have a protection function for crime victims.Keywords: Limited of Legality Principles, Protection Functions, Crime Victims

Abstract

ABSTRACTThe criminal law that has been used as one of the means to eridicate crime is built on a retributive paradigm, so its repressive and coercive nature dominates. Based on the retributive paradigm, crime prevention is the sole authority of the law enforcement apparatus. Crime prevention based on the retributive paradigm is also offender oriented. Unlike the retributive paradigm, the paradigm of restorative justice offers another way of dealing with crime. In the retributive paradigm of justice, the sanction imposed does not aim to take revenge on the perpetrators of crime but rather sanctions that can arouse the perpetrator's responsibility for the suffering of the victim or sanction aimed at restoring the suffering of the victim. According to the paradigm of restorative justice, the process of solving crimes is done by involving perpetrators, victims and the community. Keywords: crime prevention, criminal law, retributive, restorative justice. INTISARIHukum pidana yang selama ini dipakai sebagai salah satu sarana untuk menangulangi kejahatan dibangun atas dasar paradigma retributif, sehingga sifatnya yang represif dan koersif begitu mendominasi. Berdasar paradigma retributif, penanggulangan kejahatan merupakan kewenangan tunggal aparat penegak hukum. Penanggulangan kejahatan berdasar paradigma retributif juga bersifat offender oriented. Berbeda dengan paradigma retributif, paradigma keadilan restoratif menawarkan cara lain dalam menanggulangi kejahatan. Dalam paradigma keadilan retributif, sanksi yang dijatuhkan tidak bertujuan untuk melakukan pembalasan terhadap pelaku kejahatan melainkan sanksi yang dapat menggugah tanggung jawab pelaku terhadap penderitaan korban atau sanksi yang bertujuan untuk memulihkan penderitaan korban. Menurut paradigma keadilan restoratif, proses penyelesaian kejahatan dilakukan dengan cara melibatkan  pelaku, korban dan masyarakat. Kata kunci: Penanggulangan kejahatan, hukum pidana, retributif, keadilan restoratif.

Abstract

Abstrak Kecerdasan buatan adalah hasil dari perkembangan teknologi yang demikian pesat di era revolusi industri 4.0. Kehadiran kecerdasan buatan memberikan banyak manfaat dan memudahkan pekerjaan manusia sehingga lebih efektif dan efisien. Selain dampak positif dari kecerdasan buatan, ternyata terdapat potensi permasalahan dari kehadiran kecerdasan buatan yakni jika kecerdasan buatan melakukan tindak pidana dan menimbulkan korban. Hukum positif Indonesia belum mengatur mengenai pengaturan pertanggungjawaban perbuatan yang dilakukan oleh kecerdasan buatan ketika melakukan tindak pidana. Artikel ini bertujuan untuk mengetahui prospek pengaturan pertanggungjawaban pidana terhadap perbuatan yang dilakukan oleh kecerdasan buatan. Metode yang digunakan dalam penulisan artikel ini adalah metode penelitian hukum normatif dengan pendekatan konseptual. Hasil dari penelitian ini adalah kecerdasan buatan bukanlah subjek hukum dalam hukum pidana, dan pertanggungjawaban pidana terhadap tindak pidana yang dilakukan oleh kecerdasan buatan dibebankan kepada pembuat kecerdasan buatan, dan pengguna kecerdasan buatan. Kata Kunci: kecerdasan buatan; pertanggungjawaban pidana; subjek hukum. Abstract Artificial intelligence is the result of such rapid technological developments in the era of the industrial revolution 4.0. The presence of artificial intelligence provides many benefits and facilitates human work so that it is more effective and efficient. Apart from the positive impact of artificial intelligence, it turns out that there are potential problems with the presence of artificial intelligence, namely if artificial intelligence commits crimes and causes victims. Indonesia's positive law does not yet regulate the regulation of accountability for actions committed by artificial intelligence when committing a crime. This article aims to find out the prospects for setting criminal liability for acts committed by artificial intelligence. The method used in writing this article is a normative legal research method with a conceptual approach. The results of this study are that artificial intelligence is not a legal subject in criminal law, and criminal responsibility for crimes committed by artificial intelligence is borne by artificial intelligence makers and artificial intelligence users.
