Abstract

This study aims to criticize the application of sharia principles at the operational level of sharia insurance companies which are conventional insurance units, namely the Allianz Life Indonesia Insurance. The study was conducted using primary data, both observations and use of records and reports owned by the company. Data obtained and analyzed by descriptive method with a qualitative approach. The results obtained from this study are that the operational mechanism of Allianz Life Indonesia's insurance in general is in accordance with Islamic principles, but it needs some further research on the tabarru of premium payments on allisya protection products, which payments begin on the 13th month, while based on national fatwas Tabarru Islamic Premium Payment is carried out since the first month of membership.

Abstract

Praktek wakalah dan hiwalah merupakan hal yang juga sering terjadi dalam kegiatanmu’amalah yang dilakukan oleh banyak orang baik yang beragama Islam maupun nonIslam. Namun khusus bagi kalangan kaum muslimin praktek dua hal tersebut harusdisesuaikan dengan tuntutan syariah. Kedua hal itu berhubungan dengan kegiatanekonomi, sehingga diperlukan bagaimana penerapannya dalam kegiatan ekonomi Islam.Dalam tulisan ini, selain tentang definisi atau pengertian dasar tentang wakalah danhiwalah akan dikupas juga berbagai persoalan dan permasalahan yang terjadi dilapangan. Penyelesaian permasalahan tersebut, selain merujuk pada apa yang terjadi dizaman Rasulullah SAW, merujuk pula pada fatwa ulama, khususnya ulama Indonesiayang tergabung dalam Majelis Ulama Indonesia (MUI), dalam hal ini yang lebihberwenang menanganinya adalah Dewan Syariah Nasional (DSN).Metodologi yang digunakannya adalah kualitatif. Dengan mengambil studi naskah dandokumen berbagai sumber, selanjutnya dihubungkan dengan fenomena yang terjadi dimasyarakat, sehingga ada upaya action research dalam penulisan ini.

Abstract

This study aims to unravel Taqiyuddin An-Nabhani's thoughts on the concept of ownership in Islam. The research method used is a literature study, namely the source of data obtained from the results of a review of the literature in accordance with the problem. Meanwhile, in data collection, the writer uses analytical descriptive method by collecting data and reviewing and reviewing various sources of writing that have relevance to this research for further analysis. The concept of ownership in Islam according to Taqiyuddin An-Nabhani's view has a different concept from other economic systems. According to the Islamic economic system, property ownership in terms of quantity (quantity) is not limited but is limited by certain ways (quality) in obtaining property (there are halal and haram rules). In the Capitalist Economic System, the amount (quantity) of individual property ownership and the way to obtain it (quality) is not limited, that is, it is permissible in any way as long as it does not interfere with the freedom of others. In the socialist economic system, there is no private property. There is only state property which is distributed equally to all individuals in society. In contrast to the Islamic economic system, which has the view that there is individual ownership (private property), public ownership (public property) and state property (state property). According to the Islamic Economic System, the general type of ownership in particular should not be converted into state ownership or individual ownership.

Abstract

Collection of zakat, infaq and social funds is one of the social functions that exist in sharia cooperatives. Efforts that can be made to implement social functions in sharia cooperatives must of course have a good collection, so that they are distributed in accordance with what is prescribed by Islam and all people in need can feel the maximum benefits from sharia cooperatives. In addition, the surrounding community can entrust or set aside some of their more opinion for zakat, infaq and social funds which will be redistributed by sharia cooperatives to people who are entitled to receive them with full trust. With that, the purpose of this study is to find out the description of the collection strategy and the opportunities and challenges in collecting zakat, infaq, and social funds in KBMT Dana Akhirat Arjasari Banjaran Bandung. The research method used is a case study with descriptive data analysis with a qualitative approach which can be obtained through informants and documents with data collection techniques through observation, interviews, and literature studies to be able to describe the collection and opportunities as well as challenges in collecting zakat, infaq and social funds. The results of the research on the analysis of strategies for collecting zakat, infaq and social funds that were carried out were in accordance with Islamic law but still optimized from internal parties and still did not have a special division of baitul maal in the management of zakat, infaq and social funds. Furthermore, in facing challenges in collecting zakat, infaq and social funds, the BMT Dana Akhirat Arjasari Cooperative must maximize its opportunities and strengths, such as having many members with various professions, establishing good relations with village officials, mosque and pesantren administrators, the amount of funds Zakat, infaq and social funds are quite large every year, there are educational scholarships for children of members who excel, establish good relations with DISKOP and UKM Kab. Bandung by DEKOPINDA.

Abstract

Islamic banking is a financial institution that has a very important role in advancing the Indonesian economy as well as responding to the community's need to use a banking system based on sharia principles. However, sometimes there are many perceptions that Islamic banking is the same as conventional banking. Islamic banking has fundamental differences with conventional banking, namely regarding legal aspects, organizational structure, financed business activities and work environment. Sharia banking operations are based on sharia principles, namely the principle of profit sharing, the principle of buying and selling and leasing by running a business through mudharabah, musyarokah, murabbahah and ijaroh contracts. While conventional banking provides services in payment traffic with the principle of setting interest for both deposit and loan products (credit) and applying various fees in the form of nominal and certain percentages.
