Abstract

This study is an attempt to re-question the base arguments forsustainable developmentproposal with regardto environmental management. This attempt is important considering intensive deploymemt of cost and benefit calculations in every environmental management policy, which rooted in the utilitarian philosophical tradition. This research runs in the area of political philosophyandemploys methodical components includingdescription, interpretation, critical analysis, and verstehen. The current research suggests that the emergence of sustainable development as a concept of environment management goes along with modernity with all issues that it brings. The proposal of sustainable developments can be categorized into constructive postmodernismapproach. The main purpose of this proposal is to create a condition of balance between the needs of the present generation and the adequacy of the needs of the future generations. However, the concept appears to raise a new concern considering the meaning of “sustainability”has become contestation with strong tendency to economicconsideration which reduces the calculation of cost-benefits into cash-value calculations. This reductionis tendency leads to a dilemma considering the aspiration of shiftinganthropocentrism to ecocentrismunderlying behind concept of sustainable development will ironically produce a new forms of anthropocentrism.

Abstract

Penelitian ini bertujuan untuk melakukan analisis kritis atas problem intrinsik gagasan pembangunan berkelanjutan di Indonesia, khususnya terkait dengan politik pengelolaan lingkungan di Indonesia pasca reformasi.  Hal ini didasarkan pada fakta bahwa tingkat kerusakan lingkungan, khususnya sumber daya alam di Indonesia, masih sangat tinggi. Penelitian ini merupakan penelitian pustaka yang menggunakan filsafat politik sebagai metode analisis. Unsur-unsur metodis yang digunakan dalam penelitian ini adalah interpretasi, induksi-deduksi, refleksi, idealisasi, dan heuristika. Berdasarkan analisis yang telah dilakukan dapat disimpulkan bahwa adopsi gagasan pembangunan berkelanjutan di Indonesia masih berada dalam  pusaran paradigma antroposentrisme dan utilitarianisme. Hal ini menyebabkan munculnya berbagai persoalan intrinsik dalam aktualisasi konsep pembangunan berkelanjutan di Indonesia. Persoalan tersebut antara lain berupa karut marutnya aturan perundangan terkait pola pengelolaan lingkungan hidup, politik anggaran yang eksploitatif, lemahnya penegakan hukum, serta dominasi oligarki dalam pengelolaan sumberdaya. Keempat hal tersebut secara kumulatif masih terus terjadi dalam praktik politik pengelolaan lingkungan di Indonesia. Hal ini menunjukkan bahwa pembangunan berkelanjutan akhirnya sekedar menjadi jargon politik. Untuk keluar dari persoalan intrinsik tersebut harus ada re-orientasi pola pembangunan di Indonesia. Orientasi pembangunan tidak boleh hanya mengejar pertumbuhan ekonomi, melainkan harus lebih fokus pada upaya mewujudkan kemanusiaan yang adil dan beradab. Hal ini dikarenakan keterjebakan pada pertumbuhan ekonomi pada kenyataan justru membuat situasi semakin melampaui batas pertumbuhan yang memicu krisis ekologi dalam jangka panjang.

Abstract

Compliance with the law is generally understood as a necessity so that violation of the law means punishment. In contrast to the usual type of law violation, civil disobedience is often chosen by citizens as a means to voice the aspirations of the community when formally existing channels are deemed unable to work anymore. In the context of modern democratic society, this is interesting to study considering that citizens' obedience to the law is essential and is a logical consequence of the justification of the state through the mechanism of social contracts. Therefore, the civil disobedience movement will raise problems in the context of state legitimacy. This is the focus of the study in this research. The method used in this research is philosophical hermeneutics with methodical elements of interpretation, coherence, holistic, idealization, heuristics, and description. The results of the study indicate that the civil disobedience movement is an attempt by citizens to pressure the government to review moral standards which will later be applied to society through legal mechanisms. In this context, the emphasis is that the law should not only be seen as a formal rule (quid iuris) that must be obeyed by all citizens, but the law must reflect social justice (quid ius). When substantively the existing legal rules are believed to have violated the principles of community justice, civil disobedience is better understood as a moral obligation, not just a right, so that the consequences of punishment can be ignored. The spirit of resistance brought by the civil disobedience movement will always be anchored in the moral awareness of the function of justice in law. Civil disobedience becomes the moral face of lawlessness that has radical transformative power to reshuffle existing institutions or socio-political order. This is an inevitability in the constitutional democratic process that continues to undergo change, refinement, and never final.
