Abstract

The purpose of this study is the legal protection of land rights holders that are designated as abandoned land. The problem in this research is how is the practice of determining abandoned land by the National Land Agency? and What is the form of legal protection for holders of land rights that are designated as abandoned land? The research method used is a normative juridical research method that is supported by library data. Based on the results of the analysis, BPN has to determine abandoned land. BPN has the authority to determine abandoned land in accordance with the theory of authority in the form of delegation from the government (President) to BPN as regulated in Article 17 PP No.11 of 2010. Land designated as abandoned land by BPN does not receive protection in the form of compensation compensation because it is not regulated in Government Regulation Number 11 of 2010 concerning Control and Utilization of Abandoned Lands because the legal relationship of abandoned land owners, their rights to the land are abolished, their legal relations are terminated and confirmed to be land directly controlled by the state and then to the former Rightsholders are given back the part of the land that is really cultivated, used and utilized in accordance with the decision to grant rights. In order to obtain land rights that have been designated as abandoned land, the right holder can apply for land rights in accordance with the provisions of statutory regulations. Before deciding and determining land that is indicated as abandoned land, it must be done with the correct mechanism and procedure.

Abstract

Law enforcement of fisheries crimes through the mechanism of drowning foreign vessels that commit fisheries crime has not run optimally because there is no public participation involved in supporting the eradication of IUU Fishing and there are still differences in views on the sinking of ships and the burning of foreign ships between PSDKP, Polri and TNI AL related to sufficient preliminary evidence. This is not in line with Lawrence M. Friedman's theory which emphasizes that law enforcement depends on the substance of the law, legal structure / legal institutions and legal culture. The legal consequences of law enforcement in the field of fisheries through the mechanism of sinking foreign vessels that commit fisheries crime in Indonesian waters if linked to UNCLOS 1982, so far there have been no negative consequences experienced by Indonesia due to these strict actions, this is because internationally IUU fishing has been become a common enemy and the decisive action of the sinking of the vessel is the implementation of the rule of law of the Republic of Indonesia. Abstract

Tujuan penelitian adalah untuk mengetahui seberapa besar masyarakat memahami mengenai penerapan Perda No 4 tahun 2020 tentang perlindungan perempuan dan anak korban kekerasan di kota tidore kepulauan, hambatan mengatasi Perda No 4 tahun 2020 tentang perlindungan perempuan dan anak korban kekerasan di Kota Tidore Kepulauan khususnya bagi masyarakat yang kurang paham tentang Peraturan Daerah (Perda). Tempat pelaksanaan penelitian dilaksanakan di kota Tidore Kepulauan meliputi Polres Kota Tidore Kepulauan, Kejaksaan Negeri Tidore dan Dinas Pengendalian Penduduk, Keluarga Berencana, Pemberdayaan Perempuan dan Anak. Metode dalam penelitian adalah Normatif Empiris meliputi Kepustakaan, observasi dan wawancara. Konsepsi perlindungan anak yang utuh, menyeluruh dan komprehensif, undang-undang meletakkan kewajiban memberikan perlindungan kepada anak berdasarkan asas non diskriminatif, asas kepentingan yang terbaik bagi anak, asas hak untuk hidup, kelangsungan hidup dan perkembangan, dan asas penghargaan terhadap pendapat anak. Peraturan daerah Nomor 4 tahun 2020 untuk menjamin suatu upaya untuk melindungi hak setiap orang (perempuan dan anak) dari tindak kekerasan. Faktor masih kurangnya sosialisasi Perda No 4 tahun 2020 oleh Dinas Pemberdayaan Perempuan dan Anak sehingga masyarakat belum paham mengenai aturan tersebut.

Abstract

This research focuses on the problem of legal protection of the rights of suspects in the investigation process (a case study at the Tidore Islands Police). The purpose of this research is to find out the legal protection for the rights of suspects in the investigation process and the obstacles faced by investigators in implementing legal protection for the rights of suspects in the investigation process. This type of research is qualitative research using an empirical juridical approach. Methods of data collection by observation, interviews, and documentation. The results of the study indicate that the legal protection of the rights of suspects in the Tidore Islands Police has not been effective because its application is not optimal. There are still suspects' rights that are violated by investigators in the investigation process, namely the suspect's right to be free to provide information (Article 52 of the Criminal Procedure Code), the suspect's right to obtain legal counsel (Article 54 of the Criminal Procedure Code), the suspect's right to contact legal advisors (Article 57 point (1) of the Criminal Procedure Code) ), and the right of the suspect to be visited by clergy (Article 63 of the Criminal Procedure Code). In implementing legal protection of these rights, during the investigation process when examining suspects, investigators experienced obstacles including uncooperative suspects, suspects who lied in giving statements, convoluted suspects during interrogation, and difficulty finding two pieces of valid evidence.
