Abstract

National Development in implementing social security is carried out in the framework of complete human development and to create a society that is prosperous, just, prosperous, and equitable, both physically and spiritually based on Pancasila and the 1945 Constitution. This is regulated in Article 28H paragraph (3) which states that: "Every person has the right to social security which enables his complete development as a dignified human being." All workers should receive protection, both formal and informal, in this case, official parking attendants work for a living which is very vulnerable to the risk of work accidents. This research discusses how the implementation of the fulfillment of labor social security rights for official parking attendants in the Banyumas Regency and what are the obstacles in the fulfillment of the employment social security rights for official parking attendants in Banyumas Regency. The method used in this research, namely the normative juridical method, is carried out through a literature study which examines mainly secondary data in the form of laws and regulations, agreements/contracts, or other legal documents, as well as research results, assessment results, and other references. As for the implementation of the fulfillment of labor social security rights for official parking attendants in Banyumas Regency, namely the parking attendants' obligations to follow the BPJS Ketenagakerjaan so that social security is fulfilled for official parking attendants covered by the Transportation Agency. And what is an obstacle in the fulfillment of the employment social security rights for official parking attendants in Banyumas Regency is the low level of education which affects the level of awareness of workers in paying BPJS contributions, even though the Banyumas Regency Transportation Office requires every worker to participate in the social security program.Keywords: Labor Social Security, Parking Attendants, Department of Transportation

Abstract

Waralaba didasarkan pada suatu perjanjian yang disebut perjanjian waralaba. Bentuk perjanjian waralaba ini melibatkan minimal dua pihak yaitu Pemberi Waralaba dan Penerima Waralaba. Hubungan antara Pemberi Waralaba dan Penerima Waralaba merupakan suatu hubungan timbal balik sehingga harus ada keseimbangan hak dan kewajiban antara Pemberi Waralaba dan Penerima Waralaba. Waralaba yang baru dikenal di akhir tahun 1990 di Indonesia sehingga harus dipahami dengan jelas karateristik yurudis perjanjiannya untuk memberikan kepastian ataupun perlindungan hukum bagi kedua belah pihak. Abstract

Kasus fraud yang merugikan nasabah sudah sering terjadi dalam dunia perbankan di Indonesia, sehingga penulis ingin mengetahui bagaimana tanggung jawab bank secara perdata, terkait dengan tindakan fraud karyawannya yang sering muncul dan banyak merugikan nasabah. Selain itu juga ingin mengetahui bagaimana perlindungan hukum terhadap nasabah yang dirugikan, karena selama ini perlindungan terhadap nasabah masih sangat lemah. Hasil penelitian menyimpulkan bahwa, tanggungjawab perdata bank terhadap tindakan fraud karyawan yang merugikan nasabah adalah tanggung jawab langsung. Adapun dasar dari tanggung jawab langsung adalah Pasal 1365 KUHPerdata. Pertanggungjawaban ini terjadi jika perbuatan melawan hukum atau fraud dilakukan oleh pihak bank itu sendiri. Kemudian tanggung jawab tidak langsung, yaitu tanggung jawab berdasarkan pasal 1367 ayat (3) KUHPerdata. Tanggung jawab ini adalah apabila perbuatatan fraud atau perbuatan melawan hukum tersebut dilakukan oleh karyawan bank dan telah memenuhi unsur-unsur pasal tersebut. Perlindungan terhadap nasabah ada dua yaitu, perlindungan kontraktual dan non-kontraktual. Pelindungan kontraktual yaitu perlindungan yang berasal dari isi perjanjian yang telah sepakati, dan perlindungan non-kontraktual yaitu perlindungan yang berasal dari peraturan Perundang-undangan (Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan dan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Abstract

AbstractThe purpose of this study is to analyze the appropriate employment policies for companies in overcoming the problems of workers who have been laid off or laid off due to the COVID-19 pandemic in the Banyumas Regency. This research method is descriptive with a normative juridical research approach, known as a literature approach, and an empirical juridical process is carried out by looking at the reality in practice in the field analyzed qualitatively. The results show that the right employment policy for companies in overcoming the problems of workers who are laid off due to the Covid-19 pandemic refers to the provisions of Article 151 paragraph (2) of Law No. 13 of 2003, namely that layoffs must be negotiated by employers and trade unions. If it does not result in an agreement, the entrepreneur can only carry out a discharge after determining the industrial relations dispute settlement institution. For laid-off workers, refer to Item f of the Circular of the Minister of Manpower No. SE-907/MEN/PHI-PPHI/X/2004. The government, companies, took steps, and labor unions in dealing with laid-off workers, especially in the tourism, entertainment, hotel, restaurant, and industrial sectors, firstly, bipartite or tripartite negotiations to make agreements such as work systems, wages, safety In terms of work and working time, the Manpower Office and MSMEs have held various skills training activities, and provided tax relief incentives for entrepreneurs, relaxation of bank credit, and social incentives for laid-off workers.Keywords: Employment Policy, Termination of Employment, Layoff.AbstrakTujuan dari penelitian ini adalah untuk menganalisis kebijakan ketenagakerjaan yang tepat bagi   perusahaan dalam mengatasi permasalahan pekerja yang di PHK atau dirumahkan akibat pandemi covid 19 di Kabupaten Banyumas. Metode Penelitian ini bersifat deskriptif  dengan pendekatan penelitian yuridis  normatif  atau dikenal dengan pendekatan kepustakaan dan pendekatan yuridis empiris yang dilakukan dengan melihat kenyataan yang ada  dalam praktik di  lapangan yang dianalisis secara kualitatif.  Hasil penelitian menunjukan bahwa Kebijakan Ketenagakerjaan yang Tepat Bagi Perusahaan Dalam Mengatasi Permasalahan Pekerja yang di PHK  ataupun   “Dirumahkan”  Akibat Pandemi Covid 19  merujuk pada ketentuan Pasal 151 ayat (2) UU No 13 Tahun 2003 yakni PHK wajib dirundingkan oleh pengusaha dan serikat pekerja/pekerja. Apabila tidak menghasilkan persetujuan, pengusaha hanya dapat melakukan PHK setelah memperolah penetapan dari lembaga penyelesaian perselisihan hubungan industrial. Untuk pekerja yang dirumahkan  merujuk  pada Butir f Surat Edaran Menaker No. SE-907/MEN/PHI-PPHI/X/2004. Langkah-langkah  yang Dilakukan Pemerintah , Perusahaan dan Serikat Pekerja dalam mengatasi pekerja yang di PHK/dirumahkan terutama di sektor pariwisata, hiburan, hotel, rumah makan, dan industri, pertama  perundingan baik bipartit atau tripartit untuk melakukan kesepakatan seperti sistem kerja, upah, keselamatan kerja dan waktu kerja ,pihak Dinaker dan UMKM  telah menggelar berbagai kegiatan pelatihan keterampilan,dan pemberian insentif keringanan pajak bagi pengusaha, relaksasi kredit perbankan, dan insentif sosial untuk pekerja yang di PHK/dirumahkan.Kata kunci: Kebijakan Ketenagakerjaan, Pemutusan Hubungan Kerja, Dirumahkan

Abstract

 The role of the Food and Drug Supervisory Agency (BPOM) in carrying out its duties, functions and authority is solely to protect the rights of every consumer. The supervision carried out by BPOM is Pre-Market (preliminary supervision carried out before a product is circulated in the community) and Post Market supervision (supervision carried out after the product is circulated in the community). The supervision that has been carried out is still not running optimally and it is not possible to know the distribution of traditional medicinal products containing medicinal chemicals. The purpose of this study was to determine the role of the Food and Drug Administration in dealing with the distribution of traditional medicines containing chemicals. This research is a normative juridical research by obtaining data from books, journals, research results and related laws and regulations. The results of the study show various statutory regulations, government regulations and regional regulations. In order to supervise the distribution of traditional medicines containing medicinal chemicals, the food and drug supervisory agency should be tightened and carry out routine checks in every district or city.Keywords: Food and Drug Supervisory Agency (BPOM), Traditional Medicine, Medicinal Chemistry

Abstract

Most of the Wonosobo area is a mountainous area, therefore the livelihoods of the Wonosobo people are still mostly working in agriculture. In Kejajar District, Wonosobo Regency, farmers/cultivators usually enter into lease agreements with landowners. To use the agricultural land is done orally based on trust and has been passed down from generation to generation by the people of Kejajar District, Wonosobo Regency. This becomes unclear if there is a dispute between the landowner and the cultivator. So this research was conducted to find out how the process of implementing the lease of agricultural land. The research method used in this study is a normative juridical approach, which is carried out through a literature study that examines secondary data in the form of legislation and other legal documents, as well as research results, study results, and other references. The normative juridical method can be supplemented by interviews. The people of Kejajar District still use agricultural land production sharing agreements using customary law, which is only done verbally and based on mutual trust between the two parties, even though the government has provided a legal umbrella related to the agricultural land product sharing system, namely Law Number 2 of 1960 concerning Agricultural Product Sharing. Most of the people of the Kejajar Subdistrict, Wonosobo Regency are also not aware of the existence of Law Number 2 of 1960 concerning Agricultural Product Sharing. The factors that occur in the implementation of agricultural land production sharing agreements in Kejajar District, Wonosobo Regency are due to the large number of farmers who do not own land, agricultural land that has been neglected for a long time, landowners who do not have much time to take care of the land because they are busy trading.Keywords: Profit sharing, Agricultural land, Leases

Abstract

The rise of fraud with various modes has worried the public a lot, especially fraud by electronic means. The modus operandi of the perpetrators of the crime varies, ranging from online buying and selling, lottery winners, claiming to be officers, to news reports of relatives who have had an accident and need money to pay for the treatment process. After the victim is deceived, the perpetrator will ask the victim to transfer a certain amount of money to a certain bank account that has been determined by the perpetrator. After the victim transfers a certain amount of money, the perpetrator immediately transfers or withdraws all the money in his account. The purpose of the establishment of OJK is that all activities in the financial services sector can be carried out in an orderly, fair, transparent and accountable manner. Then be able to realize a financial system that grows in a sustainable and stable manner and is able to protect the interests of consumers and the public. In order for the public to get protection from the abuse of crime from parties who are not responsible for bank accounts used as a repository for the proceeds of crime, strict supervision and regulation is necessary. This is one of the duties and roles of OJK in providing protection to the public. One of the powers possessed by OJK is banking supervision. In the existing provisions, banks are required to apply the principle of know your customer or CDD (coctumer due dilligent), namely the principle of knowing your customer. So that in the event that the perpetrator of a crime uses his account as a means of crime, law enforcement officers can immediately make arrests and legal proceedings, because the customer has been known and recognized by the bank.Keywords: Financial Services Authority, Know Your Customer/Customer Due Dilligent Principle, Bank account.
