Abstract

State-Owned Enterprises (SOEs) adalah badan usaha yang seluruh atau sebagian besar modalnya merupakan milik negara melalui penyertaan secara langsung yang berasal dari kekayaan negara yang dipisahkan. Tidak hanya mengejar keuntungan, SOEs juga memiliki kewajiban melayani tujuan sosial seperti menyelenggarakan kemanfaatan umum. SOEs tidak hanya beroperasi di dalam negeri tapi juga terus melakukan ekspansi dan merambah proyek-proyek investasi luar negeri. Terkait Foreign Direct Investment (FDI) terdapat risiko terjadi perselisihan antara investor asing dengan host state. Ketika terjadi sengketa, host state kerap berdalih dengan mengatakan bahwa SOEs mewakili negara sehingga SOEs tidak memiliki keabsahan untuk mengajukan gugatan ke lembaga arbitrase untuk menyelesaikan sengketa investasi antara investor dan host state. Penelitian ini menggunakan metode penelitian hukum normatif dengan tipe penelitian doktrinal. Penelitian ini membahas ruang lingkup ISDS itu sendiri sehingga diketahui hambatan dan solusi agar tidak timbul kerancuan terhadap status SOEs dalam ISDS.

Abstract

This article aims to examine the law on the transfer of waqf assets. According to its provisions, waqf assets must be managed according to the objectives set by the waqf provider (wakif) at the time the property is handed over. However, in practice, it is not uncommon for waqf assets to be converted to different functions from their original purpose, giving rise to legal questions that need to be answered. In that context, this study seeks to provide answers. This study uses a literature approach by referring to the texts of the Qur'an, Hadith, the opinions of scholars contained in the books of fiqh, and positive law regarding waqf in Indonesia. The results of the study indicate that the law of origin of waqf does not allow the transfer of functions or transfers, such as being traded, made into individual property, and so on. However, in the condition that the waqf property is no longer useful due to certain factors, then it may be transferred with consideration of the principle of benefit. In fact, in the prevailing regulations in Indonesia, this transfer of function is positioned within the framework of community economic empowerment.

Abstract

Online learning is an alternative learning system, especially when face-to-face learning cannot be held. This study aims to analyse the perceptions of high school teachers in the city of Sungaipuh about the online learning system and find out the problems of teachers in implementing it. This research is quantitative research with a descriptive approach. The population of this study were high school teachers and equivalent schools in Sungaipuh with a sample of 182 people. Data was collected through surveys using open and closed questionnaires. The questionnaires were distributed in December 2021 via Google Form. Data were analysed descriptively by presenting tables. The results of the study showed that the implementation of online learning in high schools in Sungaipuh City is still considered ineffective due to several problems faced, including the readiness of educators in organizing learning as well as the quality and quantity of supporting facilities. Limited digital resources, such as internet networks, are the most dominant difficulties faced by teachers in carrying out online learning.
