Abstract

Incestor incestuous sexual relations are acts that are prohibited by law, including customary law and Islamic law. The prohibition of incest in the legal context is categorized as a crime that damages the basic social order of society. This study aims to explore how sanctions are applied to incest perpetrators in the context of Mandailing customary law and Islamic criminal law. This research adopts a qualitative approach in its research methodology. Data was collected using interview techniques extracted from sources in the field. This study concludes that the legal sanction for perpetrators of incest according to Mandailing customary law is by expelling the perpetrator of the crime of incest from his village. According to Islamic criminal law, the sanction imposed on married perpetrators of incest crimes is the death penalty, and unmarried perpetrators are punished by flogging and exile. Compared to Islamic law, the sanctions for implementing customary law in Mandailing can be considered lighter. It is hoped that this study will provide an overview of the variations in decision-making regarding the crime of incest under different laws. This study is also expected to contribute to the development of legal discourse in society, especially customary law on the one hand and Islamic legal perspectives on the other.

Abstract

This study aims to find out ihdad for women who are still in the iddah period of death by their husbands in the digital era. For women whose husbands die, they still actively use social media, of course this will contradict the classical rule that during the iddah period of four months and ten days, the wife expresses her grief by not wearing makeup, not blinking her eyes, not wearing perfume and not leaving the house except on certain business. Even though in fact she does not leave the house nowadays, by uploading photos or videos on social media pages, more people will see. The question is how to use social media when women are in the ihdad period. This research is qualitative with a normative study approach, which is research that is directed and focused on collecting library materials, which have to do with the problem of ihdad. The results of this study conclude that women who are left dead by their husbands are not allowed to use social media social media as a medium to express feelings, share daily activities, upload photos or videos of themselves for four months and ten days, to avoid negative things and can cause lust for men. Abstract

The purpose of this research is to find out how child support is fulfilled based on the decisions of the Banda Aceh Syar'iyah Court, the factors that are taken into consideration by judges regarding child support after divorce. This research is normative legal research. By using two approaches, namely the statutory approach and the case approach, this research examines the decisions of 5 (five) judges from the Sharia Court. The research results show that in general the judges make child support decisions in the form of monthly support only, without including the child's health and education costs. Factors that influence the judge's consideration in deciding the type of child support are judicial considerations. Unfortunately, most of the judges' considerations are only based on the provisions for providing postdivorce child support from the marriage law. By ignoring child protection laws and the compilation of Islamic law, which in fact also provides provisions for fulfilling child support after divorce which provides more protection for children in terms of meeting needs from various aspects. This study recommends that the judicial authority make decisions regarding the fulfillment of child support after divorce more progressively by considering aspects that provide protection for children. Apart from that, the juridical basis of protection laws and KHI can also be adopted for the benefit of children. Keywords: Child Support, Judge's Decision, Child Protection

Abstract

Underhand marriage or nikah siri has been an issue that has arisen in line with the enactment of Law No. 1/1974 on marriage in Indonesia. Nikah siri refers to a marriage that is not valid according to the applicable law, conducted outside the provisions of the Indonesian marriage law. Marriage, as a social institution, is a means to legitimize sexual relations between husband and wife and to ensure the continuation of human existence. However, nikah siri, which often takes place without parental or government notification, has significant negative legal implications for the parties involved, including non-recognition of the legal status of the wife, disenfranchisement from inheritance or property, and the absence of a formal mechanism for separation. Islamic law stipulates that a marriage is valid if it fulfills its pillars and conditions and no prohibitions are preventing it. In the context of positive law, every marriage must be recorded by applicable laws and regulations. However, the issue of marriage recognition through itsbat nikah in Islamic law creates complexity and the need for clear restrictions on its application. Therefore, official registration by authorized officials is important to maintain order in marriage and provide legal protection for the parties involved.

Abstract

This study examines the effectiveness of the implementation of Presidential Regulation (Perpres) No. 72 of 2021 concerning the handling of stunting in Mandailing Natal Regency through the Maqashid Syariah approach. Maqashid Syariah, which includes five main objectives, namely the protection of religion (Hifz al-Din), soul (Hifz al-Nafs), intellect (Hifz al-Aql), offspring (Hifz al-Nasl), and property (Hifz al-Mal), provides a holistic framework that integrates moral and spiritual aspects in public health and welfare efforts. This study aims to assess how the application of Maqashid Sharia values can strengthen the effectiveness of stunting management programs in the area. The research methodology used includes a literature study, interviews with religious leaders, government officials, and communities, field observations, and secondary data analysis. The results showed that the integration of Maqashid Syariah principles in the stunting handling program contributed significantly in several aspects: Hifz al-Din (Religious Protection): Religious education that educates about the importance of nutrition and health through schools and madrasas increases public awareness about religious responsibilities in maintaining children's health. Hifz al-Nafs (Protection of the Soul): Health programs supported by posyandu services in mosques and other places of worship facilitate community access to health check-ups and proper nutrition. Hifz al-Aql (Protection of Intellect): Providing good nutrition education to pregnant and lactating mothers and young families helps in the cognitive development of children, preventing the long-term impact of stunting on children's learning ability. Hifz al-Nasl (Protection of Offspring): Religious activities that support reproductive health and family planning help in maintaining maternal and child health, reducing the risk of stunting in the next generation. Hifz al-Mal (Protection of Property): Family economic empowerment programs integrated with stunting response efforts help increase family income, enabling them to provide nutritious food for their children. The conclusion of this study is that the application of Maqashid Sharia in the implementation of Presidential Regulation No 72 of 2021 in Mandailing Natal Regency is effective in supporting the handling of stunting. This holistic approach that combines physical, mental and spiritual aspects not only helps reduce stunting rates but also strengthens the community's social welfare and resilience. The practical implications of this research include developing an integrated education curriculum, utilizing places of worship as health centers, and empowering religious institutions and local communities in public health programs.

Abstract

This research examines the concept of legal reasoning of judges in Islamic law related to legal decisions for drug addicts in the Mandailing Natal District Court. Legal reasoning in Islamic law involves interpreting the Quran, Hadith, Ijma, and Qiyas to reach a just decision. This research uses a qualitative approach with a case study method, analysis of decision documents, interviews with judges, and trial observation. The results showed that the judge combined the principles of Islamic law with Indonesian positive law. In the case of drug addicts, judges consider: Justice and Public Welfare: A verdict that not only punishes but also provides opportunities for rehabilitation. Interpretation of Islamic Law Sources: Referring to the Quran, Hadith, and scholarly opinions on punishment for drug addicts. Social Context and Positive Law: Ensuring the verdict is in line with national laws and local conditions. Rehabilitation and Protection of Human Rights: Support for the rehabilitation and recovery of addicts. In conclusion, the concept of judges' legal reasoning in Islamic law plays an important role in determining decisions that are fair, humane, and support the recovery and welfare of society. Practical implications include improving judges' understanding of Islamic legal reasoning and the integration of rehabilitative approaches in court decisions.

Abstract

This research examines the application of the Maqashid Syariah concept in an effort to prevent the negative impact of gold amalgamation activities on the people of Hutabargot Subdistrict, Mandailing Natal Regency. Maqashid Sharia, which consists of five main objectives-Hifz al-Din (protection of religion), Hifz al-Nafs (protection of the soul), Hifz al-Aql (protection of the intellect), Hifz al-Nasl (protection of offspring), and Hifz al-Mal (protection of property)-provides a comprehensive framework for addressing the environmental and health problems caused by gold mining practices. This research uses a qualitative approach with a case study method to analyze the impact of gold amalgamation on public health and the environment and how Maqashid Sharia can be applied as a solution. The results show that the application of Maqashid Sharia can mitigate the negative impacts of gold amalgamation through various measures, such as the application of environmentally friendly technology, strict regulations, and increased public awareness and education regarding safe and sustainable mining practices. In addition, active participation from the government, religious institutions and local communities is crucial in the implementation of this concept. The government needs to supervise and regulate mining practices more effectively, while religious institutions can help raise awareness of the importance of protecting health and the environment in accordance with Islamic teachings. Local communities should also be actively involved through education and training on responsible mining practices. Thus, the application of Maqashid Sharia is expected to create a balance between the economic benefits of gold mining and the protection of public health and environmental sustainability, thereby achieving long-term sustainability.

Abstract

Yurisprudensi merupakan salah satu sumber hukum formil selain Undang-Undang, kebiasaan, dan traktat. Yurisprudensi dapat berarti ajaran hukum yang diciptakan oleh peradilan dan dipertahankan secara terus menerus oleh peradilan. Menurut A. Ridwan Halim, Yurisprudensi adalah suatu putusan hakim atas suatu perkara yang belum ada pengaturannya dalam Undang-Undang yang untuk selanjutnya menjadi pedoman bagi hakim-hakim lainnya yang mengadili kasus kasus serupa. Terdapat banyak kasus-kasus dilapangan dalam ranah pengadilan agama salah satunya tentang pembatalan nikah, dijumpai adanya yurisprudensi pembatalan nikah pada putusan 411K/AG/1998, dimana pada penelitian ini bertujuan untuk untuk mempelajari tentang bagaimana pembatalan perkawinan dalam undang-undang No. 1 Tahun 1974 dan KHI, bagaimana pertimbangan hakim dalam putusan No. 411 K/AG/1998. Selain itu, penelitian ini harapannya dapat menjadi pengembangan ilmu hokum dalam bidang hokum perkawinan yang berkaitan dengan masalah pembatalan nikah.

Abstract

Penelitian ini bertujuan menjelaskan pertimbangan hukum Mahkamah Agung dalam mengabulkan Putusan Nomor 777 K/Ag/2019 tentang Pengangkatan Anak, serta tinjauan yuridis atas pembatalan putusan tingkat pertama. Berdasarkan Peraturan Pemerintah Nomor 54 tahun 2007, usia calon orang tua angkat harus antara 30 hingga 55 tahun. Namun, Mahkamah Syar'iyah Banda Aceh menolak permohonan orang tua tunggal berusia 59 tahun untuk mengangkat anak. Permohonan ini kemudian dikabulkan oleh Mahkamah Agung di tingkat kasasi. Penelitian ini menggunakan metode kualitatif deskriptif analisis, terdiri dari data primer dan sekunder. Hasil penelitian menunjukkan bahwa Mahkamah Agung mengabulkan permohonan dengan mempertimbangkan keuntungan dan kemaslahatan anak, meski bertentangan dengan peraturan yang ada (contra legem). Putusan ini menciptakan yurisprudensi yang dapat menjadi acuan bagi hakim dalam kasus serupa. Mahkamah Agung mengeluarkan putusan dengan pertimbangan anak.

Abstract

This study explores how fiqh muamalah principles can realise justice and maṣlaḥah in e-commerce practices, focusing on the understanding and behavior of consumers and producers in Malaysia and Indonesia. The research investigates how these Islamic legal principles are integrated and practised within the digital marketplace. The primary data sources include e-commerce users from Malaysia and Indonesia, specifically consumers and producers. Data were collected through in-depth interviews with various e-commerce users, including consumers and producers. The results reveal that producers generally have a higher awareness of justice and ma maṣlaḥah in e-commerce, though their application of these principles varies. Consumers' experiences are inconsistent, often influenced by their educational background and exposure to Islamic commerce teachings. Key challenges include the lack of standardized guidelines and divergent interpretations of fiqh muamalah principles. The study underscores the need for more structured education and regulatory frameworks to ensure these principles' effective and consistent integration into e-commerce practices. Recommendations include developing comprehensive training programs and establishing clear guidelines to bridge the gap between understanding and practice, thereby aligning e-commerce practices in Malaysia and Indonesia with fiqh muamalah principles.
