Abstract

Penelitian ini bertujuan untuk: (1) mengetahui dan mengkaji permasalahanindependensi Kurator dalam melaksanakan tugas membereskan harta pailit terhadapmunculnya gugatan dari debitor pailit, (2) mengetahui dan mengkaji tolok ukur menentukanindependensi Kurator dalam melaksanakan tugasnya membereskan dan mengurus hartapailit serta, dan (3) perlidungan hukum terhadap Kurator dalam melaksanakan tugasnya.Penelitian ini merupakan penelitian hukum normatif empiris. Data yang digunakan dalampenelitian ini berasal dari data primer dan data sekunder. Data primer diperoleh melaluiwawancara dengan alat pedoman wawancara, sedangkan data sekunder diperoleh melaluimetode dokumentasi dengan alat studi dokumentasi dan analisis data dilakukan secarakualitatif. Hasil penelitian menunjukkan, bahwa gugatan terhadap Kurator yang dilakukanoleh debitor maupun kreditor pada dasarnya dari beberapa kasus yang dialami Kurator,hanya bertujuan untuk menghambat proses pemberesan harta pailit, akibatnya biayakepailitan membengkak, terutama dalam hal biaya pengamanan aset yang harus ditanggungKurator dan waktu untuk membereskan menjadi lebih lama, kemudian tidak ada ketentuanmengenai tolok ukur/parameter independensi Kurator, sehingga sulit mengidentifikasiKurator independen atau tidak dalam melaksanakan tugasnya, dan Undang Undang Nomor37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang tidakmemberikan secara tertulis mengenai perlidungan hukum terhadap profesi Kurator dalammelaksanakan tugasnya. Kesimpulan penelitian adalah: (1) independensi Kurator bukanpenyebab utama munculnya gugatan oleh debitor maupun kreditor, (2) independensi Kuratorsulit diindentifikasi, dan (3) perlindungan hukum terhadap Kurator telah diatur dalam UUD1945 dan kode etik AKPI sebagai salah satu organisasi Kurator. Berdasarkan kesimpulantersebut, maka disarankan: (1) perlu diatur ketentuan mengenai sanksi dari munculnyagugatan yang dilakukan oleh debitor maupun kreditor terhadap Kurator yang bertujuanmenghambat proses pemberesan; (2) perlu diatur ketentuan mengenai tolok ukur/parameterindependensi Kurator; dan (3) tidak perlu dibuatkan aturan khusus mengenai perlidunganhukum terhadap profesi Kurator.

Abstract

The principles of legal assurance, justice and expediency are properly stipulated in the provisions of the Act Number 37 Year 2004.  The legal assurance is seen by the rapidity of the settlement and the expeditious evidentiary procedure. The justice is reflected in equality principle in the proceeding. Then, the expediency is conceived from the imposition of bankruptcy as the last resort (ultimum remidium ) and the application of open to public-trial. Nevertheless, in certain case laws from the Commercial Court, the principles were not applied harmoniously.  The legal assurance appears to be more emphasized than the other principles. Take for example the bankruptcy case of PT Telekomu-nikasi Phones (District-Commercial Court of Central Jakarta Number: 48/Bankruptcy/2012/PN Nia-ga.Jkt.Pst) that has been reviewed and nullified by the Supreme Court Number: 704K/Pdt.Sus/ 2012).Key words:  legal certainty, justice, expediency, bankruptcy decision.

Abstract

AbstractThe research aim to evaluate the role of ad hoc judges in the settlement of industrial relation disputes, as well as to explore further what are the obstacles which may occur in the course of performing their duties. The research is a normative-empiric legal research. The data research comes from secondary data derived from literature studies and primary data from field researches. The data analyzed by qualitatively. The results of this research will show that ad hoc judges are appointed by the Supreme court and assigned to cases by the President of the court of Industrial Relations. Since its establishment, there has only been two appointments of ad hoc judges (one from the enterpreneur and the other from the labor union), and the court has tried and decided upon 104 cases (2006-2011). The most paramount obstacle turns out to be the lack of knowledge of the ad hoc judges in civil procedural laws while trying and deciding cases before them.Keywords: court of Industrial Relations, Ad hoc JudgeAbstrakPenelitian ini bertujuan untuk mengevaluasi peran hakim ad hoc dan untuk mengkaji hambatan-hambatan yang dialami hakim ad hoc dalam penyelesaian perselisihan hubungan industrial di Pengadilan Hubungan Industrial (PHI). Penelitian ini merupakan penelitian hukum empiris bersumber pada data sekunder dan data primer melalui penelitian kepustakaan dan penelitian lapangan Data dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa hakim ad hoc diangkat oleh Mahkamah Agung dan ditunjuk dalam suatu perkara oleh Ketua PHI. Sejak didirikan PHI yogyakarta hanya terdapat dua hakim ad hoc yang masing-masing merupakan perwakilan dari pengusaha dan pekerja. Sebanyak 104 perkara diperiksa dan diputus oleh PHI yogyakarta antara 2006-2011. Hambatan utama yaitu kurangnya pengetahuan dan pemahaman hakim ad hoc tentang hukum acara perdata yang menghambat ketika para hakim ad hoc ini harus memeriksa dan memutus perkara.Kata kunci:  Pengadilan hubungan industrial, Hakim ad hoc

Abstract

This study aimed to identify and analyze (1) the regulation regarding the deadline for applications of bankruptcy, (2) the practice of the deadline regulation, and (3) the legal consequences when they do not heed the deadline. This research is a normative legal research supported by interviews with informants. The data were collected through documentation method with document study tool, while the data from the informants were collected through interviews by using interview manual tool. The secondary data were analyzed by content analysis with statute approach, while the analysis of the interview data was conducted through a qualitative analysis. The results and discussion show that the Bankruptcy and PKPU Act applies because the previous bankruptcy regulation was not effective because it did not regulate the deadline for settling bankruptcy, so that it’s  a long period of time. The regulation of deadline for bankruptcy settlement in 2015 was largely complied with the provisions of law. 87% of the verdicts (14 out of 16 verdicts) were made within less than 60 days, while 13% (2 verdicts) were made beyond the time period specified by law. The Bankruptcy and PKPU Act does not regulate any legal sanctions/effects in relation to the deadline for judges who handle bankruptcy petitions, however, the common sanctioning relates to the assessment of the judges’ performance.

Abstract

Right to seek adjudication of conflicts qualifies as human rights. However, we find that whenever the economical value of a dispute is insignificant in comparison towards court’s fees, this rights tend to be infringed. Judicial reform with a sole interest of a faithful recognition of human rights is needed.

Abstract

ABSTRAKDalam hukum acara perdata, terdapat beberapa ketentuan dan asas yang harus diperhatikan dan ditaati oleh hakim dalam menjatuhkan putusan. Tulisan ini merupakan bagian dari laporan penelitian yang berupa kajian terhadap putusan-putusan pengadilan di wilayah provinsi Daerah Istimewa Yogyakarta (DIY), yang meliputi putusan pengadilan negeri dan pengadilan tinggi dalam perkara sengketa tanah yang mengandung gugatan “monetary remedy” dan “equitable remedy”. Sengketa tanah dapat disebut sengketa yang sangat sensitif dan sifatnya multi-isu karena merupakan sengketa sosial (social dispute) yang bersinggungan dengan persoalan budaya, sosio-struktural, strategis dan ekonomis. Banyaknya hambatan dan kesulitan dalam pelaksanaan putusan sengketa tanah merupakan latar belakang mengapa perlu dikaji penerapan hukum formil (acara) dalam putusan pengadilan negeri (PN) dan pengadilan tinggi (PT) yang menjadi objek kajian. Dalam kajian ini, akan diketahui persoalan-persoalan dalam penerapan hukum acara yang dapat ditemukan di dalam putusan tersebut serta melihat apakah terdapat disparitas (perbedaan) mengenai tingkat ketaatan dan kepatuhan hakim judex facti dalam menerapkan ketentuan hukum formil. Kata kunci: disparitas, monetary remedy, equitable remedy.ABSTRACTIn the Code of Civil Procedure, there are some rules and principles to which the judge adhere and observe and in making a decision. This paper is part of a research report studying the decisions of several District Courts and High Court in the Special Region of Yogyakarta Province regarding a case of land dispute which contains the lawsuit of “the monetary remedy” and “equitable remedy”. Land dispute is a highly sensitive and multiissue for it is a social dispute that may relate to sociocultural and economic issues. The fact that many obstacles and difficulties in the implementation of the decision of the land dispute is the main background of why it is necessary to study the application of the procedural law in court decisions that become the object of the study. In this study, it will be elaborated the implementation issues of the procedural law which is found in the decision, then inferred whether there is a disparity in the level of adherence and compliance of the judex facti in implementing the provisions of Procedural Law.Keywords: disparity, monetary remedy, equitable remedy.

Abstract

Article 2 paragraph (1) of the Act Number 37 of 2004 on Bankruptcy and Postponement of the Debt Payment Obligation does not stipulate the minimum amount of the debt for declaring a state of bankruptcy but only requires the existence of two debtors where one of the debts are found overdue. The Act that the only considerable condition has been ‘the unwillingness to pay the obligation” instead of the “incapability to pay” of the debtor. Also, the minimum amount of the debt must be determined in order to avoid another court decisions that awarded the request of bankruptcy whereas the debtor is actually capable to pay the obligation. Pasal 2 ayat (1) Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang tidak mengatur minimal jumlah utang untuk mengajukan permohonan pailit. Untuk mengajukan kepailitan hanya diperlukan dua orang kreditur dan salah satu utangnya tidak dibayar pada waktunya, sehingga hanya mendasarkan pada ketidakmauan (unwilling) dari si debitur dan bukan pada kemampuan (unable) debitur dalam membayar utang. Minimal jumlah utang ini perlu diatur sehingga kemudian tidak akan terjadi lagi putusan-putusan kepailitan terhadap debitur yang sebenarnya mampu dalam membayar utang.

Abstract

The legal aid clinics in Yogyakarta District Court are established with the involvement of six universities. This institution is designed to accommodate both individuals and collective justice seeker who cannot afford trial costs. Based on the research, it is concluded that the implementation of the program of legal aid in civil cases has not been observed optimally. Compared with the legal aid organizations that have long been providing legal assistance for poor people, the existence of legal aid post in the district court has not been widely known by the public. Pos bantuan hukum dibentuk di Pengadilan Negeri Yogyakarta dengan melibatkan enam lembaga bantuan hukum perguruan tinggi. Lembaga ini diperuntukkan bagi pencari keadilan baik perseorangan ataupun berkelompok yang secara ekonomis tidak mampu (miskin). Berdasarkan penelitian dapat disimpulkan bahwa pelaksanaan program bantuan hukum dalam perkara perdata belum terlaksana maksimal. Dibandingkan dengan lembaga bantuan hukum yang telah lama berkiprah memberikan bantuan hukum bagi masyarakat golongan tidak mampu di pengadilan maka pos bantuan hukum yang keberadaan di lingkungan pengadilan negeri ini belum banyak dikenal oleh masyarakat.

Abstract

Judges may write a dissenting opinion in court judgments. However, this practice seems to be rarely observed in both civil and criminal cases at Yogyakarta District Court and Sleman District Court. From 2004- 2010, only 4 out of 6.634 court judgments are rendered with dissenting opinions appended. Hakim dapat menulis pendapat yang berbeda dalam putusan pengadilan. Namun praktik penulisan perbedaan pendapat ini belum banyak diikuti di Pengadilan Negeri Yogyakarta dan Pengadilan Negeri Sleman. Perbedaan pendapat hanya terdapat dalam 4 putusan dari 6.634 putusan pengadilan selama tahun 2004 sampai 2010.

Abstract

Article 300 para. (2) of the 2004 Bankruptcy and Suspension of Payment Act gives room for the government to establish more commercial courts in other jurisdictions by taking into account the urgency and readiness of human resources. However, the establishment of more courts until now has never been carried out.  Pasal 300 ayat (2) Undang-undang Kepailitan dan Penundaan Kewajiban Pembayaran Utang memberi ruang bagi pemerintah untuk dapat membentuk pengadilan niaga di tempat lain dengan tetap memerhatikan kebutuhan dan kesiapan sumber daya yang ada. Meskipun demikian, sampai saat ini pembentukan pengadilan niaga di tempat lain belum terlaksana.
