Abstract

Hak Kekayaan Intelektual (HKI) atau Intellectual Property Right (IPR) akan menjadi isu global, khususnya di kalangan negara-negara yang selama ini melakukan perdagangan produk berbasis Hak Kekayaan Intelektual karena Hak Kekayaan Intelektual menjadi bagian yang sangat penting dalam proses perdagangan internasional maupun domestik, karena setiap barang dan jasa sebagai produk perdagangan selalu melekat suatu nama atau entitas tertentu yang membedakan antara satu produk dengan produk yang lainnya. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum yuridis normatif yaitu bahan hukum, disamping itu juga digunakan bahan hukum primer sebagai pendukung bahan hukum sekunder dan untuk analisa bahan hukum dilakukan dengan metoda analisis yuridis kualitatif.Hasil penelitian dan pembahasan mendapatkan beberapa kesimpulan yaitu pertama, dalam mewujudkan perlindungan hukum di Indonesia atas Merek Terdaftar dan Merek Terkenal berdasarkan asas first to file harus mendapat perlindungan hukum yang sama di Indonesia dan yang kedua adalah sebagai penemuan hukum atas penyelesaian sengketa merek yaitu perlu adanya rekonstruksi norma hukum yang belumdiatur dalam UU MIG yaitu pada penjelasan pasal 20 yang telah diubah dengan UU No 11 Tahun 2020 tentang Cipta Kerja tentang kriteria daya pembeda, kemudian pada penjelasan pasal 21 ayat 1b tentang kriteria merek terkenal dan perubahan pasal 21 tentang merek yang ditolak jika sama jenis barang dan/ atau jasa dengan merek terkenal.

Abstract

This study aims to find out and analyze how Law No. 8 can provide legal protection for E-Commers consumers on the Marketplace and to find out and analyze how the legal protection for E-Commers consumers on the Marketplace in the future. The type of research used is normative legal research. So that it focuses on an inventory of positive law, legal principles and doctrines, legal findings in cases in concerto, legal systematics, levels of legal synchronization, legal comparisons, and legal history. This study uses the type of qualitative analysis, which is a study that aims to describe the nature of a particular individual, condition, symptom or group, or to determine the frequency of a symptom, describing the problems that occur related to research. The results show that (1) Legal protection for E-commerce consumers in e-commerce transaction activities on the marketplace is basically an electronic contract engagement activity carried out by two or more parties between business actors and consumers in buying and selling goods and/or services as well as in the form of payment transactions. So that in the process the agreement made is a standard agreement that has a tendency of great risk to consumers.

Abstract

Merek merupakan identitas suatu produk barang dan/ atau jasa yang mempunyai nilai komersial dan berharga. Mempunyai komersial karena menjadi identitas produk yang diperjual belikan dan berharga karena mempunyai nilai yang dapat dinilai sebagai asset suatu perusahaan, dapat mempunyai nilai jual dan dapat diletakkan sebagai jaminan. Di Indonesia, merek secara yuridis diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis (UU MIG). Perlindungan hak merek yang terdaftar secara formal (first to file) selain merek terkenal. Adapun salah satu alasan pendaftaran merek ditolak menurut UU MIG yang diubah dengan UU No 11 tentang Cipta kerja (UUCiptaker) disebutkan dalam pasal 20 butir e menyebutkan bahwa merek tersebut tidak memiliki daya pembeda sedangkan pada pasal 21 ayat 1 a,b dan c menyebutkan bahwa merek ditolak karena mempunyai persamaan pada pokoknya atau keseluruhannya dengan merek terdaftar milik pihak lain atau dimohonkan lebih dahulu oleh pihak lain untuk barang dan/atau jasa sejenis dan merek ditolak karena mempunyai persamaan pada pokoknya atau keseluruhannya dengan merek terkenal milik pihak lain untuk barang dan/atau jasa sejenis demikian juga untuk barang dan/ atau jasa tidak sejenis. Metode penelitian ini menggunakan metode yang digunakan didalam penulisan makalah ini adalah metode normatif dengan pendekatan perundang-undangan (The Statute Approach) artinya pendekatan yang dilakukan dengan menelah semua undang-undang dan regulasi yang bersangkut-paut sesuai hukum yang ditangani. Kesimpulan yang diperoleh adalah Indonesia telah menandatangani Perjanjian Paris dan TRIPs dimana konsep dan paradigma pengaturan persamaan pada pokoknya atau keseluruhannya tentang merek dan merek terkenal yang berlaku saat ini di Indonesia dan konvensi Internasional untuk barang/ atau jasa sejenis dan tidak sejenis harus diberlakukan oleh semua negara anggota termasuk Indonesia dan politik hukum Indonesia tentang merek perlu diadakan perubahan baik dari segi subtansi dengan memasukkan untur-unsur penolakan adalah: a. status sebagai merek terkenal; b. mempunyai persamaan pada pokoknya atau keseluruhannya; c. dapat menyebabkan kesesatan dan/ atau kekeliruan; d. dapat menyebabkan kerugian; e. diperdagangkan oleh penggunaan merek tersebut.

Abstract

This article aims to identify publications on the teacher leadership theme comprehensively. The publication data is from articles, reviews, and English and comes from the Scopus database from 1993 to 2022. The keyword used in the data search is "teacher leadership." The investigation found 753 documents later used as the basis for conducting Bibliometric studies.   This Bibliometric analysis method uses Vosviewer software. All data is classified by trend; country; organization; source; author, relationship between authors; and teacher leadership research hotspots which were then analyzed using the Vosviewer software. The main findings of the study include: the trend of teacher leadership publication continues to increase, and the future direction of teacher leadership research will concern two domains, namely: new word/phrase domains connected to teacher leadership, such as COVID, leadership style, self-efficacy, diversity, school principal, evidence,  professional learning, community; and domain teacher leadership research processes or methods such as mix-method, instrument, questionnaire, and data processing. The findings of this study can be used as one of the materials for making decisions related to improving teacher leadership publications.

Abstract

The purpose of this research is to overcome dual identities or brands that have similarities in principle or in whole for similar and/or dissimilar goods or services that go side by side where the ownership rights are obtained through trademark registration or through a decision from the Supreme Court which is protected by law. as the identity of the goods and/or services being traded. The research method used is normative juridical. The formulation of the problems in this study are: 1. How is the regulation of trademarks that are rejected for registration that have similarities in principle or as a whole; 2. How to set a registered mark with a second identity. The findings of this research are based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications (MIG) where trademarks are denied registration on the grounds of equality in principle and/or in whole for similar goods or not similar to other marks registered in bad faith belonging to other parties and the need for a second identity of a registered mark and/or a well-known mark in dealing with marks that are similar in principle and/or in whole that run side by side and required legal protection for registered marks to obtain legal certainty and there needs to be a scientific study of the proposed identities of the two brands.

Abstract

This research aims to assess how investigation and law enforcement are used to uncover cases of fraud committed via electronic media. This research was conducted at the Depok Metro Police. This research applies qualitative methods in its process with a focus on empirical research. Data collection was carried out through primary data sources and secondary data. Primary data was collected through interviews with investigators, while secondary information was obtained through the use of books and scientific publications. journals. The research results show that investigators at the Depok Metro Police face several obstacles in tracking fraud perpetrators via electronic media. These obstacles include difficulties in tracking criminals because they often use fake identities, obstacles in accessing perpetrators' account identity information because of the bank's bureaucratic process which takes quite a long time, as well as the lack of a special unit that handles fraud cases using electronic media and a lack of adequate equipment. to carry out searches for criminals using electronic media.
