Abstract

The transformation of economic opportunities in Indonesia from agriculturalto industrial sector, causes rural communities lost their opportunity towork. Industrial sector needs well-educated workers, while rural communitiescan not compete because they have poor education. That is why ruralcommunities prefer to work abroad and become Indonesian migrant workers(TKI). Different types of problem always follow ever since their departure tohost countries. One of the problem is improper procedure or illegal migrant.One of case studies that depict this situation is migrant workers smuggling inthe border area of Entikong, West Kalimantan. The purpose of this researchis to examine the role of West Kalimantan Government in terms of addressingand handling the illegal migrants smuggling at the border area ofEntikong. This research employs concepts such as paradiplomacy,transnational crimes and international cooperation. The method used isqualitative using descriptive analysis through literature studies and deepinterviews. This research finds that the role of West Kalimantan Governmentas an actor of international relations by implementing previous centralgovernment policies as result of the cooperation between Indonesia andMalaysia. The local government has been conducting various strategiesranging from deportation to repatriation of the Indonesian illegal migrants.

Abstract

Money laundering is an act of crime that can destabilize theeconomical condition of a country. Vienna Convention in 1988,which examine about drugs, is the basis of discussion on anti-moneylaundering regime. International response for the fighting againstmoney laundering is by establishing FATF. FATF has severalrecommendations which are admitted as the international standards.In its framework, FATF have a black list system that providesoverview on the countries that do not take part in the fight againstmoney laundering. Indonesia is not a member of FATF, but waslisted in FATF’s black list system in 2000. This research aims to findout the causes of FATF recommendation implementation byIndonesia. Descriptive type of research is applied in this research todescribe the process that Indonesia has gone through in fightingagainst money laundering by implementing FATF recommendation.The result of this research shows Indonesia’s serious effort incombating money laundering.

Abstract

Women trafficking is one of international crimes which keeps increasing by thenumber of the cases and also the victims. One of the examples is trafficking inwomen that happens in China and Myanmar. In order to tackle the crime, bothcountries enacted a cooperation in 2007, considering that the crime takesplace across both national borders. Thus the purpose of this research is to givean explanation regarding this phenomenon over the period 2008 – 2013. Inorder to identify the linkage between the two variables, Kenneth Waltz’s theoryof international cooperation is applied as well as the concept of security whichencompasses ‘high politics’ and ‘low politics’ (Kenneth Waltz and Ripsman).This research results in a conclusion that the increase of trafficking in womencases during that period was due to lack of efforts and implementation ofcooperation which were of both countries. Moreover, the issue of trafficking inwomen being put into the ‘low politics’ sector instead of ‘high politics’ resultedin low urgency which also affected this phenomenon.

Abstract

Illicit trafficking of Small Arms and Light Weapons (SALW) is animportant issue as it can be the source of the emerging conflicts andtransnational crimes. Indonesia is one of the destination countries of thiscrime. This issue can be a threat for human rights, security, and thedevelopment of the country. Transnational crime theory, liberalinstitutionalism,and international regime, are used in this research.Those theories explain that cooperation and international regime areneeded by Indonesia to solve the Illicit trafficking of SALW. Therefore,Indonesia has adopted UNPoA as a standard to implement the preventionof Illicit trafficking of SALW’s problem in national, regional, and globallevel. However, in 2007-2008, Illicit trafficking of SALW issue inIndonesia decreased after facing a previous significant increase. Thisresearch aims to know Indonesia’s capability to prevent Illicit traffickingof SALW through UNPoA implementation. Descriptive-Analysis type ofresearch is used to describe the history of Illicit trafficking of SALW inIndonesia, then to analyse Indonesia’s efforts through UNPoA byidentifying the obstacles and the stimulant. The results of this researchshows that Indonesia has been good enough to prevent Illicit traffickingof SALW. However, there had been some factors as geographic,economic, socio-culture, law, and foreign policy, that detained the effortsto prevent Illicit trafficking of SALW.

Abstract

In 2002, Indonesia was shocked by bomb explosion in Bali which causedmore than 200 casualties. Indonesian Government started to be aware withthe lethal danger of terrorism, establishing Government Regulations in Lieuof Law No. 1 Year 2002 on Combating Criminal Acts of Terrorism(Peraturan Pemerintah Pengganti Undang-undang Nomor 1 Tahun 2002tentang Pemberantasan Tindak Pidana Terorisme) and establishing Counter-Terrorism Coordinating Desk (DKPT) which is now BNPT (Badan NasionalPemberantasan Terorisme). The Bali Bombing case also received the UnitedStates’s attention and so they offered Indonesia cooperation in combatingterrorism. The cooperation between Indonesia and the United States isactualized with the implementation of counter terrorism. This research willexplain the process of the implementation of Indonesia-United Statescooperation on counter terrorism in Indonesia. On the process of thecooperation, there are supporting and inhibiting factors that affect theconsummation of Indonesia-United States cooperation on counter terrorism.This research uses qualitative method with explanative analysis. The researchshows that the cooperation between Indonesia-United States helps Indonesiapreventing terrorism acts. The prevention form on terrorism mostly done bythe Special Detachment 88 (Densus 88), which successfully combat theterrorists and raid the terrorists’s quarters. The reliable investigation andraid skills came from United States' training provided by the FBI to the bestIndonesian police forces.

Abstract

For several years, Indonesia has become the source, transit, anddestination country for human trafficking. According to IOM,Indonesia is South-East Asia’s second largest country for humantrafficking case after Thailand. To fight human trafficking inIndonesia, INP, as part of law enforcement body in Indonesia, hascooperated with IOM and givenspecial attention to this issue. Thisresearch aims to analyse thesupporting andobstructing factors to suchcooperation, considering the fluctuative number of human traffickingcase in Indonesia between 2007-2013. This research employs theoryof transnational crime, human rights, and liberal institusionalism todescribtively analysedata collected through interview as well as otherrelated literatures. The result shows that there are obstructing factorssuch as coordination, internal problem of INP, and time management,which hinder this cooperation from achieving its optimum outcome.

Abstract

This study aims to determine the effect of IPP enforcement efforts undertakenby the United States in order to increase IPP level in United State’s tradingpartner countries. In addition, this study provides an overview of the economicbenefits to countries that enforce the IPP regime effectively. The method usedin this study is quantitative method using software piracy as indicator tomeasure the strength of IPP in every partner countries. The results from thisresearch indicates that the United States trade cooperation through US FTAscheme has significant effect towards the increase of IPP, compared withcoercion through the Special report 301. The increase of IPP is evidenced bythe decrease of software piracy level after US FTA ratification. This study alsofinds significant relationship between the increase of IPP level on the influx offoreign direct investment in the United States’s trading partner countries, as afigure of economic benefit received by those countries for enforcing IPPregime under US FTA scheme.

Abstract

High population density in Indonesia constricts the job opportunitiesfor Indonesian and gives impacts such as poverty and unemployment.These constricted job opportunities make the people in Indonesia seekfor a job abroad to fulfill their needs. The transmission of Indonesianlabour to Saudi Arabia is increasing every year, triggering the labourissues in Indonesia, such as many forms of harassment that entirelyconducive for human trafficking. This research aims to find outIndonesia’s efforts to prevent trafficking in person of Indonesianlabour in Saudi Arabia through the National Agency for ThePlacement and Protection of Indonesian Labour, as one of the bodiesdirectly responsible to president. To answer the problem, the theory ofinternational migration, the theory of human trafficking, humanrights, and theory of cooperation in the paradigm of liberalism, areused in this research. This research uses qualitative method withdescriptive-analytical type by using literature reviews and interviewsresearch technique. The result shows that the efforts done by theBNP2TKI in preventing trafficking in person of Indonesian labour arenot optimal yet, where there are still many weaknesses and constraintsin preventing human trafficking.

Abstract

The flow of asylum seekers caused by the many conflicts that arose in theMiddle East and around Asia since about 2001 led Australia to start behavingantipathy to them. Those asylum seekers usually called boat people. Then, itbecomes a reason for Australia to apply restrictive asylum policies. One of thepolicy is called 'turn back the boats' namely by bringing back the boat peoplewho indicated from Indonesia back to Indonesia. This causes asylum seekersexploded in Indonesia region and impacted negative causes. Indonesia wasforced to accept these asylum seekers even though it is detrimental and was notan obligation for Indonesia. This paper intends to analyze the dilemma ofIndonesia to address the Australian policy and asylum-seekers issue usingrationalist and constructivist theory. On the one hand, Indonesia in accordancewith the rationalist view, refuse the asylums and Australia’s policy because ofthe cost-benefit considerations and it is not the obligation for Indonesia.However, on the other hand, Indonesia recessive condition forced to accept theboat people and it is consistent with the constructivist view. But apparently,constructivist still has not succeeded explaining this somehow-unique caseconsidering that Indonesia has no commitment in conducting the reception ofthe asylum seekers.
