Abstract

Authority, protection, legal certainty and justice are absolute requirements for a country which is based on law. All judges should endeavor to harmonize justice based on the provisions of law (legal justice), justice based on morality (moral justice) and justice based on the will of the people (social justice). Supreme Court as the highest of all courts in the country should be filled with Justices who act as the reformer of law to realize clean court. The great authorities and duties the justices have require a high degree of responsibility in order that the decisions issued are for the sake of  justice and in the Name of God Almighty. This denotes  that  law enforcement,  truth and justice must be accounted  for either  to  human  or God. Supreme Court Justices are expected to integrate the three concept of justices in order that harmonization of legal responsibility and social satisfaction which is built on morality based on goodness and badness as the standard can be realized. As the Reformer of law,  Supreme Court Justice should be able and have   the courage to make breakthrough which is not against the law and social justice and the morality itself.

Abstract

This article aims to provide knowledge and understanding on the functions of the state law enforcement agencies in Indonesia. Differences of powers and functions of law enforcement agencies such as the Supreme Court, Attorney General’s Office and the Constitutional Court needs to be understood in depth. Furthermore, given the problems in all courts all over the world which is, among others, the slow settlement of cases, this article describes and analyses the role of Supreme Court Justices in resolving cassation and review cases before and after the issuance of the decree of the Chief Justice Number 119/KMA/SK/VII/2013 regarding the determination of the Day of Deliberation and Pronouncement and Number 214/KMA/SK/XII/2104 concerning Time Period for the Handling of Cases at the Supreme Court. However, when Constitutional Court pronounced Ruling Number 34/PUU-XI/2013 a problem arises in which the products of the two state judicial bodies seem to be inconsistent, especially in the framework for the resolution of criminal cases. On the one hand, the Supreme Court wants the creation of a judicial process that is simple, speedy, and low cost through the strengthening of the two products above, but on the    other hand the Constitutional Court through its award extend the time span of litigation process for the settlement of review cases which can be done repeatedly. Thus, in order to provide legal certainty, the Supreme Court issued Supreme Court Circular Number 7 Year 2014 which essentially affirms that the petition for review in criminal cases is limited only one time based on other legal basis namely Judicial Authority Act and Supreme Court Act.

Abstract

Penulis tertarik mengkaji judul ini karena antara praktik dan aturan terdapat kesenjangan yang sangat tajam terutama dalam Pasal 310 dan Pasal 311 Undang-undang Republik Indonesia Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Kedua pasal tersebut mengarahkan pada faktor pengemudi sebagai penyebab terjadinya kecelakaan, padahal banyak sekali perkara kecelakaan lalu lintas yang penyebab kecelakaan di akibatkan oleh pengguna jalan lain yaitu pejalan kaki yang menyebrang jalan tanpa memperhatikan keselamatan dan mengganggu fungsi jalan sehingga terjadilah kecelakaan, sedangkan aparat penegak hukum karena sulit menetapkan saksi dan bukti dan aturan Pasal 310 dan 311 Undang Undang Republik Indonesia Tentang Lalu Lintas Angkutan Jalan menekankan pengemudi kendaraan bermotor merupakan objek yang akan dikriminalisasikan, Dari latar belakang tersebut, penulis merumuskan identifikasi masalahnya adalah Apakah pidana bagi pejalan kaki dalam perkara kecelakaan lalu lintas berdasarkan Undang-undang Republik Indonesia Nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan ? dan Bagaimanakah penerapan Unsur Efektivitas Penegakan Hukum terhadap Pejalan Kaki dalam Perkara Kecelakaan Lalu lintas menurut Menurut Undang-undang Republik Indonesia Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan ? Penyidik kepolisian dalam melakukan investigasi alat bukti perkara kecelakaan lalu lintas dengan objek terperiksa pedestrian lalai dalam kondisi menyeberang jalan, menurut norma tentang penetapan dan pembatalan, tindakan pedestrian yang kelalaian dalam menyeberang jalan yang bebas dari sistem moralitas dan norma sejenis lainnya. Hal ini membedakan antara hukum pidana dengan norma etika berlalu lintas dianggap sebagai pelanggaran, baik itu melanggar norma berprilaku (etika) atau norma kebiasaan berlalu lintas di suatu daerah. Ketika pedestrian lalai maka, kelalaian tersebut bukan merupakan suatu perbuatan pidana (straafbaarfeit), melainkan berada dalam ranah etika kebiasaan yang tidak mengindahkan atau mengutamakan keselamatan berlalu lintas. Penerapan unsur efektivitas penegakan hukum terhadap pejalan kaki dalam perkara kecelakaan lalu lintas dapat dilakukan kepolisian, namun terkendala dalam proses investigasi dalam mencari alat bukti, terutama barang bukti, saksi dapat diperoleh

Abstract

Law enforcement does not engage in a vaccum space, yet it is related tovariables of socio-political condition, mental of the law enforcers, criminal lawprocedures, law ideology, NGOs, and legal awareness of the society. Moreover,fighting corruption through law enforcement demands collective awareness asstakeholders to actively participate in national efforts to prevent and eradicatecorruption. Measures taken on the prevention must be built in socio-political climateand national collective culture which enforce zero tolerance to any forms of corruption, including bribery, gratification, trading influence, illicit enrichment, corporate corruption, political corruption, collusion, and nepotism.

Abstract

The handling of corruption cases in practice turns out to require a very large cost, each law enforcement institution has different standards both on the Police, KPK and Attorney General. The high cost of handling cases of corruption has caused discussion among legal practitioners, so there is a discourse not to follow up on the legal process of alleged criminal acts of corruption with a small state loss value as a form of implementation of restoraive justice, but in Article 4 of the Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption Acts as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendment to Law Number 31 of 1999 concerning Eradication of Corruption (Corruption Eradication Law) states that the return of state financial losses or the country's economy does not eliminate criminal conviction. The author in the preparation of this thesis uses a method with a normative juridical approach because the target of this study is the law or norm through a historical approach, interpretation of the law and comparison of the legal system. This research is analytical descriptive, where in analyzing existing problems more using the bibliography approach, so in this study do not use statistical calculations. After conducting the study, the authors conclude that the regulation of restorative justice in corruption in Indonesia does not yet have a strong legal umbrella, because it is still an internal law enforcement agency and is considered to be in conflict with Article 4 of the Anti-Corruption Eradication Law if it is associated with recovering state financial losses. The constraints on the application of restorative justice in criminal acts of corruption associated with the recovery of state financial losses is still being controversially addressed because the application of restorative justice is considered to only apply to real victims or individuals or groups of people and cannot be applied to criminal acts whose victims are the state or national development interests so to be mediated is impossible.

Abstract

Health development is essentially an effort carried out by all components of the Indonesian nation that aims to increase awareness, willingness, and ability to live healthy for everyone in order to realize the highest degree of public health, as an investment for the development of socially productive human resources and economical. Once the importance of health services for the community, so that it is included as one of the basic human rights. Apart from being a basic human right, good health services are an indicator of the progress of a nation, because there is a link between the progress of a nation and the health status. In the 2015-2025 Long Term Development Plan, as stipulated in Law Number 17 of 2007, the health sector is included as one of the long-term development directions to realize a competitive nation by building quality human resources, one of which is health development.
