Abstract

Tidak dapat dipungkiri bahwa dalam kehidupan bermasyarakat sering terjadi permasalahan atau sengketa. Permasalahan dalam kehidupan masyarakat banyak terjadi pada berbagai lini di kehidupan masyarakat yaitu kegiatan ekonomi dan bisnis. Yang umumnya menjadi akar dari munculnya permasalahan atau sengketa adalah perbedaan terhadap pendapat, benturan dari kepentingan, hingga rasa takut dirugikan. Penyelesaian sengketa pada dunia bisnis umumnya dilaksanakan dengan menggunakan cara litigasi atau penyelesaian sengketa melalui pengadilan. Namun disamping penyelesaian sengketa melalui proses pengadilan, terdapat pula penyelesaian sengketa melalui non litigasi atau di luar pengadilan. Penyelesaian melalui non litigasi atau di luar pengadilan ialah penyelesaian sengketa yang dilakukan menggunakan cara-cara yang ada di luar pengadilan atau menggunakan lembaga alternatif penyelesaian sengketa. Pasal 1 Undang-Undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa menyebutkan bahwa Arbitrase adalah cara untuk menyelesaikan suatu permasalahan perdata diluar peradilan umum yang didasarkan oleh perjanjian arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa.

Abstract

Marwah modal ventura merupakan penyertaan modal ke dalam suatu perusahaan pasangan usaha dengan tujuan untuk pengembangan suatu penemuan baru; pengembangan perusahaan yang pada tahap awal usahanya mengalami kesulitan dana; membantu perusahaan yang berada pada tahap pengembangan; membantu perusahaan yang berada dalam tahap kemunduran usaha; pengembangan proyek penelitian dan rekayasa; pengembangan pelbagai penggunaan teknologi baru dan alih teknologi baik dari dalam maupun luar negeri; membantu pengalihan pemilikan perusahaan. Peran modal ventura sangat unik oleh karena sistem modal ventura memiliki multidimensi, yaitu sebagai lembaga finansial, corporate institution, karena adanya penyertaan modal, dan sebagai lembaga penolong pengusaha lemah. Metode Penelitian bersifat deskriptif analitis danpendekatan yuridis normatif, dengan menggunakan bahan kajian  berupa  peraturan perundang-undangan yang berlaku di Indonesia, dengan cara melakukan studi kepustakaan (library reseach) atas peranan  modal ventura sebagai salah satu sumber pembiayaan bagi UMKM. Hasil telaahan dapat dikemukakan bahwa lembaga pembiayaan modal ventura memiliki payung hukum yang jelas dalam hukum positif di Indonesia serta memiliki peran strategis sebagai alternatif sumber pembiayaan bagi UMKM dalam menunjang pembangunan perekonomian nasional Indonesia.

Abstract

The Republic of Indonesia is a State of Law. This concept of the state of law has been declared since Indonesia's independence and is included in the 1945Constitution of the Republic of Indonesia. As a state of law, every aspect of community life is regulated by law, including community activities related to traffic and road transport. UU 22/2009 was issued to provide a legal basis for community activities related to road traffic and transportation. UU 22/2009 also regulates the enforcement of traffic violations and road transport (LLAJ) through the e-ticketing system. The philosophy of the enactment of this e-ticket, is because there are many obstacles to the enforcement through manual ticketing, including the corrupt behavior of law enforcers. Based on this, the problem can be identified, namely the effectiveness of e- ticketing in suppressing traffic violations and what factors can affect the law enforcement of traffic violations through the use ofe-ticketing.This research uses a normative juridical approach, with the research specification is descriptive analytical and using primary and secondary data using data analysis on normative qualitative datas.The results of this study are the violation of road traffic violations using the E- ticketing system or mechanism has not been effective in suppressing violations of traffic and road transport under UU 22/2009 in the West Java Regional Police jurisdiction. This is because after theen force ment of Traffic and Road Transportation violations through the E-ticketing system was officially implemented on December16, 2016, the level of violations in the West Java Regional Police area has increasedand factors affecting the effectivity or ineffectivity of the enforcement of traffic violations and Road Transport through the E-Ticketing system, is influenced by its own regulatory factors (UU 22/2009), although formed in accordance with the principles of the legislation, but the value of sanctions has not been maximized. The law enforcement factors that are not yet consistent and consistent in enforcing the law, the factor of facilities or facilities, are ideally able to support e-ticketing, but the education factor on skills and adaptation to technology for officers can influence the effectiveness of e-ticketing. Community factors, because there are still some people who are undisciplined and are not afraid of sanctions for violations, because they think they can be resolved peacefully, and community cultural factors, related to social thought and social forces that determine how the law is used, avoided, or misused.

Abstract

Health development is essentially an effort carried out by all components of the Indonesian nation that aims to increase awareness, willingness, and ability to live healthy for everyone in order to realize the highest degree of public health, as an investment for the development of socially productive human resources and economical. Once the importance of health services for the community, so that it is included as one of the basic human rights. Apart from being a basic human right, good health services are an indicator of the progress of a nation, because there is a link between the progress of a nation and the health status. In the 2015-2025 Long Term Development Plan, as stipulated in Law Number 17 of 2007, the health sector is included as one of the long-term development directions to realize a competitive nation by building quality human resources, one of which is health development.

Abstract

The tendency of a person to commit a criminal act of motorcycle theft repeatedly evidenced by the number of recidivists in the crime of motor theft shows that prison is not a good enough solution to overcome crime. Restorative justice is a settlement system created by the Attorney General's Office through Perja Number 15 of 2020 by stopping the prosecution of cases. The problems discussed in this study are 1) How is the application of the concept of restorative justice as the development of the criminal system in Indonesia? 2) How is the settlement of cases at the prosecutorial level against the crime of motor theft by the public prosecutor based on a restorative justice approach? The approach method used is normative juridical and the research specifications are descriptive analytical by analyzing the applicable laws and regulations with facts in the field. Data analysis using qualitative normative methods. The results showed that: 1) The application of the concept of restorative justice, namely prioritizing the return of all circumstances as an alternative to solving criminal cases that are retaliatory (absolute theory) Restorative justice is present as the development of the criminal system in Indonesia, namely a system that emphasizes improvements in losses caused by or related to criminal acts. 2) The settlement of cases at the district attorney's level against the crime of motor theft by the public prosecutor based on the restorative justice approach is carried out by taking into account the general requirements for the application of restorative justice to the prosecutor's environment as Perja No. 15 of 2020.

Abstract

Jasa Konstruksi adalah layanan jasa konsultansi konstruksi dan/atau pekerjaan konstruksi. Pihak-pihak yang terkait, yaitu Pengguna Jasa dan Penyedia Jasa. Pengguna Jasa adalah pemilik atau pemberi pekerjaan yang menggunakan layanan Jasa Konstruksi. Penyedia Jasa adalah pemberi layanan Jasa Konstruksi. Hubungan kontraktual antara Pengguna Jasa dan Penyedia Jasa tidak selamnya harmonis. Dalam hal terjadi sengketa antar para pihak, Undang-Undang No.2 Tahun 2017 tentang Jasa Konstruksi mengedepankan prinsip dasar musyawarah untuk mencapai kemufakatan. Dalam hal musyawarah para pihak tidak dapat mencapai suatu kemufakatan, para pihak menempuh tahapan upaya penyelesaian sengketa yang tercantum dalam Kontrak Kerja Konstruksi. Dalam hal upaya penyelesaian sengketa tidak tercantum dalam Kontrak Kerja Konstruksi, para pihak yang bersengketa membuat suatu persetujuan tertulis mengenai tata cara penyelesaian sengketa yang akan dipilih. Tahapan upaya penyelesaian sengketa sebagaimana dimaksud, meliputi: mediasi; konsiliasi;dan arbitrase. Dalam praktek Pengguna Jasa dan Penyedia Jasa belum memahami dengan baik mengenai bagaimanakah upaya penyelesaian sengketa di luar pengadilan sebagaimana dimaksud dalam Undang-Undang Jasa Konstruksi tersebut. Tulisan ini bermaksud untuk menjelaskan tentang prosedur atau tahapan dalam mengajukan penyelesaian sengketa jasa konstruksi di luar pengadilan, dengan menggunakan metode kajian yuridis normatif dan analisis kualitatif serta studi kepustakaan (library research). Berdasarkan hasil kajian dapat dikemukakan bahwa penyelesaian sengketa jasa konstruksi dapat dilakukan di luar pengadilan, yaitu melalui tahapan upaya musyawarah, mediasi, konsiliasii dan arbitrase, sesuai dengan Undang-Undang No.2 Tahun 2017 tentang Jasa Konstruksi, Undang-Undang No.48 Tahun 2009 tentang Kekuasaan Kehakiman dan Undang-Undang No.30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa.

Abstract

Although now the contract is mandatory in Indonesian according to Law no. 24 of 2009, notaries still have to understand notary deeds in foreign languages. In fact, if necessary, be able to make notary deeds using foreign languages. This is necessary to improve the qualifications as a legal apparatus in the field of notarization and land affairs. Moreover, there are quite a lot of notaries in Bandung Regency. Based on data from the Bandung Regency Regional Revenue and Financial Management Service (Dispenda), as of June 2020, there were 418 PPAT (Land Deed Maker Officials) and based on the Notary Portal of Bandung Regency as of June 2020 there were 397 notaries. In accordance with Law no. 2 of 2014 concerning Amendments to Law no. 30 of 2004 concerning the Position of Notary (UUJN), the notary is authorized to make authentic deeds regarding all actions, agreements, and provisions required by laws and regulations and/or those desired by those with an interest to be stated in an authentic deed, guaranteeing the certainty of the date of making the deed, keep the deed, provide a copy and an excerpt of the deed. From the inventory of problems, many notaries do not understand the legal consequences when a notary makes a contract or agreement in the form of a notary deed in a foreign language. It should be noted that a contract or agreement made in the form of a notary deed in a foreign language has certain legal consequences, namely the notary deed is not an authentic deed, but as an underhand deed. In addition, the notary deed has the potential to be filed for cancellation or declared null and void through the state judiciary. The solution is, socialization or legal counseling has been held to notaries regarding the legal umbrella or legal basis for the mandatory use of the Indonesian language in contracts or agreements, either under hand or in the form of a notary deed.

Abstract

Arbitration is a mechanism for resolving civil disputes outside traditional courts, governed by a written arbitration agreement between the disputing parties. Limited to commercial and specific disputes like banking, an arbitration tribunal, consisting of arbitrators, hears and decides these matters. In Indonesia, Law Number 30 of 1999 states that the appointment of two arbitrators grants them authority to select a third. Meanwhile, Russian laws, such as Federal Law No. 382-FZ and Law No. 5338-1, empower the Nomination Committee of Permanent Arbitration to appoint a third arbitrator from an approved list. This article employs a normative juridical method with a comparative law approach to scrutinize the selection and appointment of a third arbitrator according to Indonesian and Russian law. Qualitative analysis reveals that, under certain circumstances, all three arbitrators may be appointed by the Nomination Committee or even the general jurisdiction court, as outlined in the Russian International Commercial Arbitration Court's regulations. The article underscores the importance of providing legal certainty to disputing parties, empowering arbitrators, and avoiding conflicts that could impede dispute resolution. By shedding light on the appointment process, this research aims to contribute to the efficacy of arbitration as a judicious alternative for resolving disputes.
