Abstract

Trafficking in persons is a modern trading of human slavery. Trafficking in persons is also one of the worst forms of violation of human dignity that results in trauma to the victims. To that end, there should be a comprehensive treatment for victims.The problems that can be studied is whether a model that can be applied in the treatment of victims of trafficking in Cianjur and disseminating technical how models Handling of Victims of Trafficking in Persons (Trafficking) in Cianjur.This study uses normative juridical approach and specification of descriptive analysis. The results of this study are alternative models to handle victims of trafficking in Cianjur is a service model based on inter-institutional and economic empowerment through planting camelina sativa with socialization techniques involving local government, private sector, community leaders and students through legal counseling and advocacy. Keywords: human trafficking, the victim handling model, socialization

Abstract

Trafficking in persons is a modern form of slavery. The eradication of human trafficking has been on the agenda in law enforcement because of its effects can interfere with social welfare. One form of trafficking in persons who lately is rampant child trafficking. The problems that can be studied is how the perspective of Human Rights in providing protection to children who are victims of trafficking and whether the implementation of legal protection for child victims of trafficking in Cianjur is in line with the concept of human rights. This study uses normative juridical approach and specification of descriptive analysis. Results from this study is the protection of child victims of trafficking in persons has been referred to the concept of human rights which the regional government make policies on prevention of trafficking, rehabilitation, counseling and empowerment of victims of human trafficking. Keywords: human rights, legal protection, trafficking

Abstract

Kondisi Overcrowding penjara merupakan konsekwensi dari tingginya suplay para narapidana dan tahanan sebagai mata rantai system pemidanaan di Indonesia, over kapasitas jumlah penghuni lapas mencapai 107 % denganpertumbuhahnkenaikan narapidana 22.000 per tahun beresiko terhadap fasilitas yang tidak memadai, tingginya biaya operasional lapas juga sangat memungkinkan adanya potensi pelanggaran terhadap hak-hak dasar para narapidana dan tahanan sebagai manusia.Tujuan dari artikel ini yaitu untuk menganalisis alternartif sanksi pidana dengan gan tirugi (diyat) untuk meminimalisir permasalahan overcrowding penjara di Indonesia. Kesimpulan dari artikel ini yaitu perlu dikembangkan sebuah konsep pemidahaan yang sesuai dengan tujuan pemidanaan sebagai “law abiding citizens” melalui perubahan paradigma “menghukum dan pembalasan” dengan mengembalikan harga diri para narapidana dengan memperlakukan dan menganggap para narapidana sebagai manusia yang berpotens iuntuk menjadi manusia baik, selain itu juga perlu dikembangkan sanksi pidana gantirugi (diyat) pada kasus-kasus tertentu sebagai pengganti dari sanksi pidana kurungan yang selama ini ada di dalam KUHP dan peraturan perundang-undangan lainnya.

Abstract

Trafficking is a violation of human dignity that is contrary to human rights and legislation. One of the victims of the crime of trafficking in the district of Cianjur is an underage child. An Integrated Service Center for Women and Children Protection (P2TP2A) of Cianjur district in collaboration with the Faculty of Law of Suryakancana University conducting an even in preventing the human trafficking crime. One of the efforts to overcome the trafficking is by socializing the law No. 21 of 2007 on the Eradication of Trafficking for the counseling teacher and student in order to get a better understanding of the meaning, way, form, effects, prevention and sanction the crime of trafficking.

Abstract

This study discusses efforts to protect children who have been victims of sexual abuse with the modus operandi of sexual transformation in Cianjur Regency. The purpose of this study is to determine the protective measures taken by relevant parties and the factors that influence the success of protection. The method used is descriptive qualitative with data collection techniques in the form of in-depth interviews and participatory observation. The study subjects include child victims, families, police, courts, and child protection agencies. The results show that protection for children who are victims of sexual abuse with the modus operandi of sexual transformation is still less than optimal due to factors such as lack of public knowledge, insufficient trained personnel, lack of support from families and society, as well as administrative and legal issues. Therefore, serious and integrated efforts are needed to protect children who are victims of sexual abuse with the modus operandi of sexual transformation by increasing public knowledge, training relevant personnel, providing moral and psychological support, and evaluating existing policies and regulations.
