Abstract

A fundamental change in terms of structuring government apparatus particularly position filling of pratama high leadership in local agencies openly aimed to realize good governance. This paper examines the application of open systems in position filling of pratama high leadership of regional secretary in Cianjur and the government's readiness of Cianjur regency in the implementation of position filling of pratama high leadership (regional secretary). This research applied normative juridical approach by descriptive analysis while the analysis of data used triangulation method. The results of this study are the position filling of pratama high leadership (regional secretary) in Cianjur already introduced an open and competitive system by forming a selection committee to establish and coordinate with the State Civil Administrative Commission in the implementation of the administration and the competence of official candidates. In filling the position of high leadership, a regulation of sanctions and rewards for position of pratama high leadership related to the performance is required.Keywords: position of Pratama high leadership, open system, good governance

Abstract

Cianjur as one of districts where migrant workers origin should have Local Government’s concern in terms of legal protection for both workers (TKI) and their families to achieve the family resilience and welfare. This paper examines how the protection model of TKI and their families and how its implementation. This research uses normative juridical type by case approach. This is a descriptive research by applying triangulation method. The research result shows that the model of protection for TKI and families in Cianjur district is activity programs for economic empowerment among TKI families. These programs are implemented through forming Bina Keluarga (BK-TKI)/migrant workers family programs at District level, BK-TKI at sub-district level and BK-TKI at village level. Therefore, the Migrant workers and families issue should be comprehensively and structurally conducted between government and society.Keywords: Migrant Workers Family Program, Protection Model, Economic Empowerment.

Abstract

Pembinaan hubungan industrial sebagai bagian dari pembangunan ketenagakerjaan harus diarahkan untuk terus mewujudkan hubungan industrial yang harmonis, dinamis, dan berkeadilan. Peran serikat Pekerja sangat penting sekali dalam upaya penyelesaian perselisihan hubungan industrial khususnya perselisihan pemutusan hubungan kerja. Serikat pekerja/serikat buruh berfungsi sebagai sarana untuk memperjuangkan, melindungi dan membela kepentingan dan meningkatkan kesejahtreaan pekerja dan keluarganya.Kata Kunci : Hubungan industrial, serikat pekerja, pemutusan hubungan kerja.

Abstract

Trafficking in persons is a modern form of slavery. The eradication of human trafficking has been on the agenda in law enforcement because of its effects can interfere with social welfare. One form of trafficking in persons who lately is rampant child trafficking. The problems that can be studied is how the perspective of Human Rights in providing protection to children who are victims of trafficking and whether the implementation of legal protection for child victims of trafficking in Cianjur is in line with the concept of human rights. This study uses normative juridical approach and specification of descriptive analysis. Results from this study is the protection of child victims of trafficking in persons has been referred to the concept of human rights which the regional government make policies on prevention of trafficking, rehabilitation, counseling and empowerment of victims of human trafficking. Keywords: human rights, legal protection, trafficking

Abstract

A doctors liable criminally to do an abortion without any permission orexplanation before an abortion to the pregnant or the family. A doctor’s Criminalliability that does an abortion as a medical indication without any permissionfrom the pregnant mother or the family is considered as a subjection to criminalpenalties if the abortion is not done under emergency situation. Otherwise, doctoris not liable to the law. The writing uses juridical normative approach andobserved using primary, secondary and tertiary literature. The technique ofcollecting data is obtained by researching the literature. After observing, theliterature is analyzed by qualitative method. The result of this research is that anabortion case as a medical indication without any permission from the pregnantmother or the family is subject to criminal penalties, civil liability andadministrative sanctions. It is stipulated in criminal code and civil code, so thatabortion is absolutely prohibited.Keywords: Abortions, Responsibility Doctors, Without Permission Mother orFamily.

Abstract

Sistem hukum hubungan industrial Pancasila berupaya menempatkan pekerja/buruh dengan pengusaha termasuk didalamnya pemerintah dalam kedudukan yang proporsional. Eksistensi atau keberadaan pekerja dalam hubungan industrial harus dilindungi oleh pengusaha dengan diperlakukan sebagai mitra kerja. Untuk itu, pelaksanaan hubungan industrial sebaiknya merujuk ke dalam sistem demokrasi ekonomi Pancasila, yakni suatu sistem demokrasi ekonomi sebagai hasil pengejawantahan dari konsep integralistik Pancasila.Legal Protection of the Workers in the Implementation of Industrial Relations AbstractThe legal system of industrial relations based on Pancasila attempts to place workers or laborers with employers, including the government, in a proportional position. The existence or presence of workers in industrial relations should be protected by the employer, in which workers are to be treated as a partner. Abstract

Each formation of local regulations must meet philosophical, sociological, and juridical elements. This aims to form local regulations that can keep up with the community developments and can be applied effectively. The problems under the study were the requirements and efforts related to responsive local regulations. The study employed a normative-juridical approach. Specifically, This study used descriptive-analytical research. The findings revealed the local regulations must have clear philosophical, sociological, and juridical values to create a responsive regulation to community development. In addition, this study also concluded that this matter also gave the community an opportunity to take part in forming local regulations. Meanwhile, the efforts can also be done by establishing local regulations based on applicable laws and regulations. Besides, this should also be accompanied by academic texts and public hearing to gather public opinion on the discussion of draft local regulations

Abstract

Women are vulnerable to discrimination or violence from other parties. Accordingly, the government needs to make various efforts to protect women's rights and to prevent violence. The study aims to examine the factors and the government's prevention efforts to violence against women. The study employed the normative-juridical method. The study found some factors causing violence against women, such as an individual, partner, socio-cultural, and economic factors. Meanwhile, the governments' efforts cover increasing cooperation with National Commission on Violence against Women and other stakeholders, disseminating various laws and regulations on women's legal protection, advocacy, and women empowerment.
