Abstract

This study aimed to analyze gross human rights violations in Indonesia, the implementation of Law Number 26 of 2000 concerning the Ad Hoc Human Rights Court, and the challenges of ad hoc human rights courts in resolving gross human rights violations in Indonesia. This study applied normative and empirical legal research with a case study approach. The researcher collected data from primary and secondary data resources. Data collection techniques were carried out by reviewing, studying, and categorizing. The analysis procedure started with data inspection techniques, data marking, and drawing conclusions. The study results showed that the provision of gross human rights violations in Indonesia was adopted from the Rome Statute. However, the implementation of Law Number 26 of 2000 concerning the Ad Hoc Human Rights Court was still limited to the judicial process of the cases of Timor-Timur and Tanjung Priok. The challenges of ad hoc human rights courts include the less than optimal role of Law Number 26 of 2006, legal aspects of the legislation that were not accompanied by procedural law procedures, law enforcement officers who did not work optimally, as well as political, social, and cultural factors that weaken law enforcement at the national level.

Abstract

Kota Malang sebagai kota pelajar menarik berbagai pelajar dari berbagai daerah di Indonesia untuk melanjutkan pendidikan tinggi di kota tersebut. Tercatat 62 perguruan tinggi berdiri di kota tersebut. Daya tampung perguruan tinggi yang besar dan pembangunan kota yang diupayakan oleh Pemerintah Kota semakin meningkatkan daya tarik kota ini. Letak kota yang berada pada subkebudayaan arek yang inklusif dan toleran, serta sudah sejak lama menampung warga dari berbagai daerah di Indonesia, seharusnya memiliki korelasi positif bagi iklim mahasiswa pendatang. Namun pada kenyataannya, justru timbul berbagai gesekan sosial antara mahasiswa pendatang dengan warga lokal. Mahasiswa pendatang yang sering terlibat konflik adalah mahasiswa pendatang yang berasal dari Indonesia Timur. Artikel ini bertujuan untuk menganalisis strategi adaptasi budaya bagi komunitas mahasiswa Sumba di Kota Malang sebagai upaya pencegahan konflik di kalangan mahasiswa. Berdasarkan hasil penelitian, ditemukan fakta bahwa terdapat kegagalan mahasiswa pendatang dan warga lokal untuk membaur dalam latar kebudayaan Kota Malang yang heterogen. Mahasiswa Sumba hidup dengan norma-norma sebagaimana mereka hidup di daerah asalnya, sedangkan warga lokal terjebak pada stigma bahwa mahasiswa Sumba membawa efek negatif bagi lingkungan. Prasangka kultural tersebut harus ditanggulangi agar tidak terjadi konflik yang lebih besar di Kota Malang. Artikel ini merekomendasikan agar bagi mahasiswa pendatang diberikan orientasi terkait kebudayaan setempat untuk meminimalisir stres akulturatif yang dialami mahasiswa dan konflik yang akan terjadi

Abstract

The lack of teachers' ability to apply the Pancasila character can contribute to the fading of Pancasila culture abroad, especially for the families of Indonesian Immigrant Workers in Malaysia. This research aims to explore the understanding of the character of Pancasila among parents in the Indonesian-Malaysian literacy context. A quantitative research approach was used with a sample of 80 educators from the Kuala Lumpur Indonesian School and learning centers in Malaysia. The research instrument consists of a questionnaire with 15 items for the Teacher Empowerment Program variable and 14 items for Teacher Knowledge. Data analysis uses simple linear regression with validity, reliability, normality, heteroscedasticity, t test, and coefficient tests, which are processed using SPSS software. The research results found that the training program had a positive effect on teachers' knowledge about the character of Pancasila. The Teacher Empowerment Based Course Program has had a significant impact on teachers' understanding of the Indonesian-Malaysian Literacy Based Pancasila Character. After attending a course based on teacher empowerment, there was a significant increase in teachers' knowledge about the character of Pancasila based on Indonesian-Malaysian language literacy. This teacher empowerment-based course program provides educators with the opportunity to gain knowledge about Indonesian-Malaysian literacy. They can apply this knowledge through innovative and effective teaching methods. Future research could investigate further potential benefits beyond increasing teachers' knowledge after participating in this program.
