Abstract

Indonesia started to apply the National Health Insurance System on January 1, 2014, and the legal entityformed to administer this program is the Healthcare and Social Security Agency. Funding for the Healthcareand Social Security Agency at primary clinic uses the capitation system where the funds are mostly used forservices and operations. The use of capitation funds at the primary clinic is fully managed by itself based onthe agreement. This actually creates the potential for fraud because of the lack of regulations on using thecapitation funds. Fraud at the primary clinic does not really appear on the surface like a fraud in hospitals. Itcan be in the form of insufficient resources, facilities and service discrimination. Many studies have showna link between capitation funds and health services. A primary clinic needs to have an audit team to evaluatewhether the use of capitation funds is following the expected targets and needs.

Abstract

The division of Korea into North and South Korea began with the victory of the Allied Powers in World War II, which ended 35 years of Japanese occupation of Korea. The maritime boundaries of the West Sea and East Sea of Korea are not clearly regulated in the Armistice Agreement of 1953. In particular, maritime restrictions on the Yellow Sea are seen as important in relation to the management of the region's large fishery resources. In 1953 the UN Command unilaterally declared the NLL (Northern Limit Line) along the five western islands, as the de facto maritime border in the Yellow Sea. North Korea, which is an NLL farmer, threatens a conflict of legality so that there is a continuous conflict so that efforts are needed to help the conflict between the two countries. Abstract

The financial management in the coastal villages based on the principle of public participation is regulated in Act Number 6 of 2014 on the Village. The regulating is intended that rural communities can participate and play the role and can directly involve in financial management, including the supervision on financial allocations. The selected coastal villages in Gresik are Pangkah Kulon village, Banyu Urip village and Campurejo village; the villages are in two sub-districts (kecamatan), Ujung Pangkah and Panceng. This research is an empirical research with the steps which refer to the principle of PAR (Participatory Action Research). The research advances show that the location of the research and the regulations have been identified; the informants have been determined; and the data on Village Fund Allocation and the model of village financial management of which each village makes have been collected. As a result of the research, the model of financial management in Pangkah Kulon village, Banyu Urip village and Campurejo village is not maximally in accordance with the steps that should be as in the regulations, particularly in the Regulation of the Minister of Home Affairs Number 113 of 2014 on Village Financial Management. The used format is not uniform.

Abstract

Indonesia changes the name of the sea in its Exclusive Economic Zone, which initially changed the name of the South China Sea to North Natuna Sea. The change in the name of the North Natuna Sea in Indonesia was protested by the Chinese government, given the abundant natural resources that made other countries especially China want to seize this region. Not only that, the North Natuna Sea is also one of the legal conflicts. The Indonesian government must increase awareness in terms of security and national defense in protecting sovereignty, especially in the North Natuna Sea. This study uses a normative juridical method and uses a legislative approach, a case approach, and a conceptual approach in this case literature study of library materials so that it can be called library legal research. The impact of the change in the name of the North Natuna Sea internally, the change in the map of Indonesia in the North Natuna Sea because this change can be implemented without external parties. External impact, Indonesia received recognition from other countries that the name of the Indonesian sea has changed its name. And efforts made by Indonesia to secure the stability of the North Natuna Sea.

Abstract

People smuggling is a growing global crime that exposes thousands of migrants to unacceptable risks and challenges the integrity of international borders. In the last two decades, globalization and conflicts have seen an increase international migration flows. People smuggling is not a new phenomenon in Indonesia. It has developed steadily over the last 10 years in response to the increased demands of asylum seekers and refugees attempting to reach Australia by boat. Among the convicted people smuggling organizers are a number of rejected asylum seekers who stayed on in Indonesia for years. Some smugglers are former refugees but now hold Australian citizenship, granted to them after regular resettlement. Indonesia recorded nine boat accidents involving 728 asylum seekers in 2012, while in the following year the number rose to 23 involving 615 victims. Operation Sovereign Borders and they turn-back-theboats policy from Australia, from December 2013 to March 2014, there were seven occurrences of boats being turned back to Indonesian waters. The result of research show that first, Indonesian government need regional cooperation to handling treated people smuggling in Indonesian waters. Regional cooperation would be a win-win solution for both countries. And second, the regional cooperation should be in line with prevailing Indonesian legislation.

Abstract

Malacca Strait is globally recognized as a strait for international shipping as mentioned in UNCLOS 1982 and is under the sovereignty of three states; Indonesia, Malaysia, and Singapore. Seeing the position of Malacca Strait that becomes the most crowded lane of international trade and oil, it often raises problems in navigation. In addition, many rocks, corals and strong waves may increase the potential of ship wrecking, sinking, and crashes. In regard to the safety issue of shipping lane in Malacca Strait, it becomes the responsibility of the coastal states and thus, they should organize an integrated safety management among them, particularly in Malacca Strait. They are Indonesia, Malaysia, and Singapore. The safety assurance of shipping in Malacca Strait may increase the global economy as international oil trading and distribution is wellconducted, and finally it may increase the economy of the coastal states in Malacca Strait.

Abstract

South China Sea (SCS) dispute has been running for so long. The claimant states keeps endeavoring various resolutions to settle that dispute, either through reconcilement by their own choice or under several compulsory procedures provided by UNCLOS 1982 (Convention). Considering the content of UNCLOS 1982, one of the claimant states, Philippines, brought the dispute to PCA unilaterally against China which objected the jurisdiction along with its final award through official government statements and verbal notes. China was found violating International Law based on the principle of Pacta Sunt Servanda. Nine Dash Lines claimed based on Historic Rights are still retained by China. The procedures should lead to a permanent resolution by International Community to avoid any possible armed conflicts, including the likelihood that Historic Rights turned into Customary International Law.

Abstract

Usaha perikanan di Desa Campurejo, Kecamatan Panceng, Kabupaten Gresik sebenarnya sudah bertumbuh cukup baik. Namun, usaha-usaha perikanan ini belum dikelola secara maksimal berkaitan dengan legalitas badan usahanya. Badan usaha yang berbadan hukum kini menjadi tuntutan yang harus dipenuhi agar usaha nelayan di Desa Campurejo mendapatkan hak, kewajiban dan perlindungan hukum dari pemerintah. Apalagi pemerintah baru saja menetapkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang memberikan kemudahan bagi masyarakat untuk berusaha. Tujuan dari kegiatan ini bagi pemerintah desa adalah meningkatkan pelayanan di Desa dalam hal pemberian kelengkapan perizinan. Bagi nelayan di Desa Campurejo kegiatan ini diharapkan: Pertama, menumbuhkan motivasi bagi nelayan untuk melengkapi badan usahanya sesuai dengan hukum yang berlaku. Kedua, meningkatkan kapasitas dan pengetahuan untuk melakukan proses perizinan secara mandiri atas legalitas badan usahanya. Sasaran dari kegiatan ini adalah para nelayan, baik nelayan pemilik alat produksi dan buruh nelayan. Metode yang digunakan adalah metode ceramah, dengan menggunakan video and power point. Hasil pengabdian ini adalah peningkatan pengetahuan dan pemahaman nelayan di Desa Campurejo agar mempunyai kesadaran untuk membentuk badan usaha berbadan hukum. Sistem perizinan badan usaha melalui sistem Online Single Submission sangat membantu para nelayan untuk melakukan perizinan berusaha.

Abstract

Dokter dapat memberikan sebagian otoritasnya kepada tenaga kesehatan lain seperti bidan atau perawat dalam bentuk delegasi wewenang. Hal ini dimungkinkan secara hukum dan tentu saja delegasi wewenang ini diberikan dalam batasan tertentu. Bahkan dalam keadaan tertentu, tenaga kesehatan dapat memberikan tindakan medis meski tanpa delegasi wewenang. Payung hukum yang dapat dijadikan rujukan antara lain Pasal 73 ayat (3) Undang-undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran. Peraturan ini memberikan kesempatan bagi bidan untuk melakukan prosedur medis jika memenuhi ketentuan perundang-undangan. Peraturan Menteri Kesehatan Nomor 21 Tahun 2021 menyatakan bahwa persalinan harus dilakukan di fasilitas pelayanan kesehatan dan penolong terdiri dari dokter dan bidan. Pelayanan kesehatan oleh bidan atas delegasi wewenang dari dokter juga dapat menimbulkan malpraktek, sehingga pasien dapat menggugat secara pidana atau perdata. Oleh karena itu, perlu adanya akuntabilitas hukum bagi dokter dan bidan jika tidak memenuhi standar, dengan melihat unsur-unsur tanggung jawab pidana, perdata, dan administratif.
