Abstract

Abstract. Store X is one of the stores in Shopee e-commerce that sells a variety of health masks. In the practice of selling, Store X seldom to respond customers’ complaints. In Muamalah Fiqh, there is a theory named Khiyar, which means a right owned by the consumer to continue or cancel buying and selling. This research aims to know the practice of online buying and selling are done by Store X in Shopee, to know the review of Khiyar to the practice of buying and selling done by Store X in Shopee, and to know the review of Law Number 8 of 1999 concerning Consumer Protection towards the practice of Store X’s buying and selling in Shopee. The method used in this research was the qualitative method with an empirical law approach. The result of this research was the practice of Store X’s online buying and selling has appropriate to the steps done at Shopee e-commerce; however, several consumers were harmed because the goods were unsuitable or had defects in the goods. The review of Khiyar Muamalah Fiqh towards Store X’s practice did not carry out due to the absence of consumers' rights. The practice of Store X was the opposite with Law Number 8 of 1999 since the business owner of Store X did not give compensation to the consumers and did not give the goods following the agreement and the defects found in the goods. Abstrak. Toko X adalah salah satu toko di e-commerce shopee yang menjual berbagai macam masker kesehatan. Dalam praktik jual belinya toko X jarang merespon atas keluhan konsumen. Dalam Fikih Muamalah ada satu teori yaitu Khiyar, yaitu hak yang dimiliki pembeli untuk melanjutkan atau membatalkan jual beli. Tujuan penelitian untuk mengetahui praktik jual beli secara online yang dilakukan oleh Toko X di Shopee, mengetahui tinjauan khiyar terhadap praktik jual beli dilakukan oleh Toko X di Shopee, mengetahui tinjauan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terhadap praktik jual beli Toko X di Shopee. Metode penelitian yang digunakan yaitu penelitian kualitatif dengan pendekatan hukum empiris. Hasil dari penelitian ini adalah praktik jual beli toko X telah sesuai dengan langkah-langkah yang dilakukan pada e-commerce shopee, namun ada beberapa konsumen yang dirugikan akibat barangnya tidak sesuai atau cacat. Tinjauan Khiyar Fikih Muamalah pada praktik toko X tidak terlaksana, karena tidak adanya hak-hak konsumen. Praktik jual beli toko X bertolak belakang dengan Undang-Undang Nomor 8 Tahun 1999 karena pelaku usaha toko X tidak memberikan kompensasi terhadap konsumen, dan tidak memberi barang yang sesuai dengan perjanjian dan ditemukan cacat pada barang.
