Abstract

This article attempts to identify the strategic role of cash waqf as an alternative financial instrument in the economic development of Indonesia in the field of social, religious, educational, and health, as well as to identify the problems faced by the social institution that has existed in Indonesia in the management of cash waqf. After the economic crisis hit Indonesia in 1998, the existence of cash waqf becomes very strategic and is deemed appropriate to give the mutual fund model that very potential in real sector to empower and strengthen the social economy Indonesia. However, cash waqf as one of the most potential sources of funds which have not been used optimally in Indonesia. This is due to a large number of waqfs are managed in a traditional consumer. On the other hand, Islamic finance institutions which manage the Waqf money haven't been able to manifest cash waqf benefits for socio-economic empowerment. At the end of the discussion, this article emphasizes the importance of the cash waqf funds mobilization of society through the creation of waqf bank to expand the potential of cash waqf in improving the social and economic welfare of society in Indonesia.

Abstract

This research is conducted to analyze the implementation of Law no. 50 of 2009 on Religious Court. Based on Supreme Court Regulation (PERMA) Nu. 14 the Year 2016 on Procedures of dispute completion in sharia economic, PERMA Nu. 1 the Year 2014 on Mediation of dispute completion process between sharia financial institution and breach of contract at the Religious Court of Magelang. This research uses the descriptive qualitative method with an empirical juridical approach that is by comparing the rules that have been established with the reality. The result of this research indicates that the Religious Court of Magelang in the process of dispute completion of sharia economic has been in accordance with the mandate of Law Nu. 50 the Year 2009, PERMA Nu. 14 the Year 2016, and PERMA No.1 Year 2014. Until early 2018 the Religious Court of Magelang has been handled 20 cases of dispute breach in sharia economic with the result of 17 cases revoked; 1 case granted, 1 case crossed out, and 1 case still running. The cases handled by the Religious Courts of Magelang are majority dealing with trade with markup (murabah}ah) of the breach of contract with the reason of problematic financing.

Abstract

This article aims to evaluate the utilization of Muhammadiyah waqf assets in Magelang Regency and to analyze the supporting and inhibiting factors in utilizing the assets. This research is expected to become a framework or model for nazhir waqf, which in this case are Muhammadiyah Leaders in Magelang Regency, either from regional/regency level, branch/district level, village, and Muhammadiyah business, in managing and utilizing the waqf assets. The data for this research was collected by in-depth interview, observation on the waqf assets and documentation study, which was then analyzed qualitatively. The result showed that Muhammadiyah leaders of Magelang regency were able to collect waqf assets in form cash of Rp. 156.000.000, - and 415 plots of land spread over 21 sub districts in Magelang regency. The collected assets then were used in developing the field of worship by 20.75%, health by 3.6% and education by 49.55% and social by 26.13%.  The utilization of waqf assets had not been aimed at productive sector in the community’s economy and most of them were led to consumptive sector. It was caused by the lack of socialization of nazhir waqf to the community and the community’s perspective that considers waqf was only in consumptive form.

Abstract

Abstract: As a potential financial instrument, waqf has played an essential role in resolving the social problems of the society (ummah). Although Indonesia has long applied the existence of waqf, it has not had an impact on providing an optimal contribution to the welfare of the people. Several studies identified patterns of administration in the management of waqf. The purpose of this study aims to identify and explore the model of empowerment of Mahammadiyah waqf land in Magelang and its challenges in the development of the ummah. The study method used to collect data was descriptive qualitative and interviews, which covered the areas administered by the Mahammadiyah. About 78% of these areas are empowered in the form of educational and worship facilities. However, it was observed that empowerment of the land in Magelang was not optimized due to lack of financial resources, unproductivity, and the presence of incompetent and professional Nazhirs. The solution to these problems is through collaboration with financial institutions in collecting cash equivalents, land specifications, formulating a special legal framework for empowering Muhammadiyah waqf, and training for the development of the capacity of the areas.Abstrak: Sebagai instrumen finansial yang potensial, wakaf memiliki peran penting dalam menyelesaikan permasalahan sosial masyarakat (ummah). Meski keberadaan wakaf sudah lama diterapkan di Indonesia, namun belum berdampak pada memberikan kontribusi yang optimal bagi kesejahteraan masyarakat. Beberapa penelitian mengidentifikasi pola administrasi dalam pengelolaan wakaf. Tujuan penelitian ini adalah untuk mengidentifikasi dan mendalami model pemberdayaan lahan wakaf mahammadiyah di Magelang dan tantangannya dalam perkembangan umat. Metode penelitian yang digunakan untuk mengumpulkan data adalah deskriptif kualitatif dan wawancara meliputi wilayah-wilayah yang dikelola Mahammadiyah. Sekitar 78% dari wilayah tersebut diberdayakan dalam bentuk sarana pendidikan dan ibadah. Namun, teramati bahwa pemberdayaan tanah di Magelang belum optimal karena kurangnya sumber daya finansial, tidak produktif, dan adanya Nazhir yang tidak kompeten dan profesional. Solusi dari permasalahan tersebut adalah melalui kerjasama dengan lembaga keuangan dalam pengumpulan setara kas, spesifikasi tanah, penyusunan kerangka hukum khusus pemberdayaan wakaf Muhammadiyah, dan pelatihan pengembangan kapasitas daerah.

Abstract

Waqf institutions in some Muslim countries including Indonesia face obstacles in providing funds to manage their waqf lands. This paper aims to propose an alternative developing model for Muhammadiyah waqf institutions to meet the financing and management constraints using the concepts of waqf land categorisation using Islamic investment models. In this conceptual paper, the theory is used to propose a model for developing waqf Muhammadiyah in Indonesia. This study identified inefficiencies in managing Muhammadiyah waqf in Indonesia due to financial problems and the lack of ability of waqf institutions in developing assets. The authors have developed an investment model as a source of waqf land financing for Muhammadiyah waqf institutions in Indonesia. This model is expected to be a solution for empowering undeveloped and unproductive Muhammadiyah waqf lands and can be applied by Muhammadiyah waqf institutions in Indonesia. In the development of this study, Muhammadiyah waqf institutions, Islamic financial institutions, and policymakers will find alternatives in developing productive waqf for the ummah. The findings of this study will provide Muhammadiyah waqf institution with an Investment model to develop their waqf. Through this study, waqf will be useful in resolving the problems of poverty, unemployment, social inequality, improving education and health facilities, and improving the Indonesian economy. This model is different from the management of existing Muhammadiyah waqf, which is carried out consumptively. Then, waqf land that has been categorized is transformed into productive assets such as agricultural products and commercial business projects. The proposed investment model is to help Muhammadiyah waqf institutions to develop waqf land. The investment model is used to make Muhammadiyah waqf land more productive and play a role in social welfare.
