Abstract

Pekerja atau buruh merupakan salah satu aset penting untuk kelangsungan hidup perusahaan. Dalam hubungan industrial terdapat adanya hubungan kerja antara pekerja atau buruh dengan perusahaan. PT Musi Hutan Persada (PT MHP) menemukan pekerja atau buruh yang bernama Ir. Chandralika, telah melakukan tindakan sebagai Manager HRD pada PT Koperasi Wana Lestari (PT KWL) tanpa sepengetahuan atau ijin dari pimpinan perusahaan. Sehingga yang bersangkutan diberikan sanksi SP III sampai dengan proses PHK, karena dianggap telah bekerja di dua perusahaan. Penelitian ini menggunakan metode yuridis normatif dengan meneliti bahan pustaka dan berfokus pada semua peraturan perundang-undangan, doktrin dari para pakar hukum, maupun putusan pengadilan. Hasil penelitian ini menjelaskan perlu adanya dasar pertimbangan hakim kasasi atau legal reasoning terhadap kepastian hukum atas status hukum dan legalitas hubungan kerja antara pekerja atau buruh atas nama Ir. Chandralika dengan PT KWL. Implikasi hukum yang timbul akibat putusan hakim kasasi yaitu proses PHK dan kompensasi PHK, dimana kompensasi PHK yang diberikan kepada pekerja atau buruh telah tepat dan sesuai dengan Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan, dan diatas dari Peraturan Pemerintah Nomor 35 tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat dan PHK.

Abstract

This paper explains, Corruption comes from the Latin Corruption from the verb corrumpere means rotten, damaged, shaken, overthrown, bribed. According to Transparency International, it is the behavior of public servants, both politicians/politicians and civil servants, who illegally and illegally enrich themselves or their families by abusing the public power entrusted to them. The research method used is empirical legal research or sociological research that prioritizes field data (field research) which is evaluative in nature with the aim of assessing the implementation of a legal regulation. The formulation of the problem is the factors that influence law enforcement against civil servants involved in corruption cases of the Complete Systematic Land Program (PTSL) in Palembang City. The conclusion is that the factors that influence the prosecution of officials involved in corruption cases of the Complete Systematic Land Program (PTSL) in Palembang City, namely the legal regulation factor itself, due to the absence of supporting instruments in the form of laws and regulations that implement the criminal act of corruption is not running properly.

Abstract

This paper explains that health is a basic right and investment for the welfare of society. This study examines the law and problems encountered in the implementation of physiotherapy services for BPJS patients in advanced referral facilities, in accordance with Minister of Health Regulation No. 28/2014. The results show that the regulation only covers medical rehabilitation by specialist doctors, so not all physiotherapy services can be implemented properly. Other obstacles include administrative bureaucracy and difficulties for the community to access physiotherapy services directly. This study supports the improvement of health services and the reduction of administrative barriers in the BPJS system.
