Abstract

Pembicaraan tentang korupsi seakan tidak ada putus-putusnya. Fenomena ini memang sangat menarik untuk dikaji, apalagi dalam situasi seperti sekarang ini, dimana ada indikasi yang mencerminkan ketidakpercayaan rakyat terhadap pemerintah dan penyelenggara negara.Pelaku tindak pidana korupsi dapat dikenai pidana penjara dan atau denda diantaranya diatur dalam Pasal 5 UU Nomor 20  Tahun  2001 Tentang Pemberantasan Tindak Pidana Korupsi. Praktek yang terjadi, bahwa kejahatan korupsi dilakukan tidak sekali saja melainkan secara berlanjut. Dan tidak dilakukan oleh seorang diri. Jika terjadi hal yang demikian, maka pengaturan yang terdapat dalam Pasal 64 ayat (1) KUHP. Metode penelitian menggunakan metode penelitian hukum yuridis normatif yaitu mengacu pada norma-norma hukum. Penelitian ini bersifat deskriptif analitis. Data yang digunakan adalah data sekunder. terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Perbuatan melawan hukum yang diatur dalam Pasal 5 Undang-Undang Nomor 20 tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi Jo. Pasal 64 ayat (1) KUHP Terhadap Tindak Pidana Korupsi adalah  memberi atau menjanjikan sesuatu kepada Pegawai Negeri atau penyelenggara negara tersebut berbuat atau tidak berbuat sesuatu dalam jabatannya Formulasi perbuatan pidana.

Abstract

This research examines the use of hazardous chemicals as food additives, such as formalin and borax, which have the potential to endanger consumer safety. The District Court Decision Number 100/Pid.B/2022/PN Lgs. regarding the case of the perpetrator, Miswardi Bin Usman, who was found to have used prohibited substances in food production, raises questions about legal regulations, criminal liability, and the enforcement of criminal law. The research method employed is normative legal research with a focus on literature analysis, particularly the Decision Number 100/Pid.B/2022/PN Lgs. The research results indicate that the decision raises concerns regarding legal justice, particularly concerning the accountability of the defendant under Article 136 of the Food Law. The judge's decision appears to impose sanctions that are considered too lenient. The research concludes that the judge, as a law enforcement officer, does not seem to fully reflect the principles of a rule of law as mandated by the 1945 Constitution. The decision raises doubts about the effectiveness of law enforcement regarding the use of hazardous chemicals in food. Therefore, a reconsideration of the handling of similar cases is necessary to ensure justice and consumer safety in line with the country's goals as a rule of law

Abstract

Based on article 42 of Law Number 30 of 2002, KPK is given authority to coordinate and control investigation and prosecution of criminal cases of corruption carried out jointly by persons subject to the General and Military Court. However, KPK encounters problems in investigating TNI members together with civilians, as happened in the Basarnas case. This normative legal research uses statute approach and conceptual approach, in order to provide a view for harmonization of regulations related to the KPK's connectivity authority. The results show that it is necessary to change the definition of "military criminal offenses" in Military Court Bill, statutory regulations related to organizational structure of KPK and origin of institutions where KPK Investigators/Prosecutors come from, which can only be filled by National Police, Prosecutors, and Special Civil Servant. It is necessary for KPK to have a special Deputy for handling connectivity cases and Investigators who come from military.
