Abstract

Berdasarkan Kitab Undang-undang Hukum Perdata Buku Ketiga, perjanjian jual-beli yang dibuat melalui media elektronik dapat dianggap sah dan mengikat apabila memenuhi syarat subyektif dan syarat obyektif, pemenuhan atas syarat tersebut berakibat pada perjanjian yang telah disepakati oleh para pihak. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimanakah kekuatan mengikat dalam Perjanjian Jual-beli yang dibuat melalui media elektronik berdasarkan Kitab Undang-undang Hukum Perdata dan Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik? (2) Apakah kendala yang dihadapi sehingga salah satu pihak melakukan wanprestasi dalam perjanjian jual-beli melalui media elektronik berdasarkan Kitab Undang-undang Hukum Perdata dan Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik? Penelitian ini merupakan penelitian hukum normatif. Jenis dan sumber data yang digunakan dalam penelitian ini adalah jenis data sekunder. Pendekatan penelitian yang digunakan adalah perundang-undangan. Teknik pegumpulan data yang digunakan yaitu studi kepustakaan berupa peraturan perundang-undangan, buku-buku, jurnal, artikel dan lain-lainnya. Hasil penelitian ini menunjuKan bahwa: (1) Kekuatan mengikat dalam perjanjian jual-beli yang dibuat melalui media elektronik ditentukan dari kesepakatan kedua belah pihak terhadap syarat-syarat dalam perjanjian tersebut, Perjanjian juga mengikat bagi para pihak mengenai hak dan kewajibannya, sehingga pemenuhan syarat sahnya suatu perjanjian mutlak untuk dipenuhi. Hal ini kelak apabila dikemudian hari terjadi suatu permasalahan atau sengketa (wanprestasi) maka penyelesaiannya dapat didasarkan pada perjanjian yang sudah disepakati. (2) Kendala terbesar dalam sistem perjanjian e-commerce adalah tanpa adanya tatap muka secara langsung, maka wanprestasi ini akan sangat mudah terjadi meskipun pada awalnya terdapat kesepakatan yang telah disetujui oleh kedua belah pihak.

Abstract

The purpose of this research is to analyze the implementation of Complete Systematic Land Registration (PTSL) and the inhibiting factors based on the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 6 of 2018 concerning (PTSL) in Bajawa City. This research is an empirical legal research conducted at the Ngada Regency Land Office. Data collection techniques using interview techniques and literature / document studies. The data used are primary data, secondary data and tertiary data. This research was conducted in Bajawa City, Ngada Regency, East Nusa Tenggara. The results of data management were analyzed descriptively using qualitative methods. Based on the results of the research and discussion, it can be seen that the Implementation of the Complete Systematic Land Registration (PTSL) Programme in Bajawa City, Ngada Regency, has been running well in the two Villages/Kelurahan Lebijaga and Desa/Kelurahan Bajawa both seen from the achievement of the 2022 programme target. The inhibiting factor in the Ngada Regency Land Office is that work performance is still not optimal due to the lack of apparatus. Facilities and infrastructure are also still lacking, especially for two-wheeled vehicles and four-wheeled vehicles as well as office equipment such as computers and laptops.

Abstract

Land in the juridical sense is the surface of the earth, land rights are rights to a certain portion of the earth's surface, which is limited, has two dimensions with length and width. No human being or any group of people can be separated from land. Land can be used for development, both in infrastructure such as roads, irrigation, telecommunications and in the fields of agriculture, animal husbandry, mining, housing so that currently land has very high economic value. This will of course trigger land disputes. One of the factors that causes land disputes is the large number of lands owned by residents who do not yet have land certificates, and also in the process of issuing land certificates, the principle of caution in examining juridical and technical data is not implemented properly. Based on the background above, the problem formulation is put forward as follows: (1) Has the Nagekeo Regency Land Office in issuing land title certificates paid attention to the precautionary principle? (2) Does the land title certificate issued provide legal certainty and act as strong evidence? This research was carried out at the Nagekeo District Land Office. This research is empirical legal research, which is carried out by looking at the realities that exist in field practice. Based on the results of the research that has been carried out, it was found that: (1) To find out the application of the precautionary principle in issuing land title certificates, it can be seen from the land services provided by the Nagekeo Regency Land Office, which refers to the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 1 of 2010 concerning Service Standards and Land Regulation. The procedure for issuing activity certificates includes checking juridical data and checking technical data. (2) The land title certificate issued guarantees legal certainty and is strong evidence but is not the only evidence so that the certificate issued can still be challenged.

Abstract

The purpose of this writing is to determine the factors that cause land disputes and their implications for the rights of the parties in North Insana District, North Central Timor Regency and to determine the legal consequences for the rights of parties in land disputes in North Insana District, North Central Timor Regency. The benefit of this research is as information material to increase insight and knowledge regarding the title of the thesis which the author will research and will be useful for scientific material, especially land disputes in the civil law specialization. The method used in this research is an empirical legal research method. The results of this research show (1) The factor that caused the land dispute that occurred in North Insana District was the factor of personal conflict of interest, namely that the defendants grabbed the land, occupied and cultivated the land based on their personal interests without paying attention to the ownership of the land so that causing land disputes. (2) The consequence of the land dispute is that the owner suffers losses both material and immaterial, so that the defendant is given sanctions in the form of a fine. The conclusions of this research are (1) The factor that causes land disputes that occur in North Insana District is the factor of conflict of personal interest by taking over for personal gain. (2) The consequence of the land dispute is that the owner suffers losses, so that the dispute party receives sanctions in the form of fines to be given to the owner. The author's suggestion is that the Village Head as a mediator must bring the two parties together to make peace so that social relations between the two parties can return to running well.

Abstract

The purpose of this research is to analyse the legal consequences and countermeasures for late registration of a child's birth certificate in terms of Law No. 23/2006 on population administration. This research was conducted at the Civil Registration Office, Rote Ndao Regency. This research is an empirical legal research, which is conducted by looking at the reality that exists in field practice. This approach is also known as a sociological approach which is carried out directly to the field. Based on the results of the research conducted, it is found that: (1) The legal consequences of the delay in registering a Child Birth Certificate in terms of Law Number 23 of 2006 concerning Population Administration (Case Study of the Civil Registration Office of Rote Ndao Regency) are that the child does not get legal certainty about himself, does not have legal status as a child and the parents will have difficulties in fulfilling the child's needs in terms of public services. (2) Efforts to overcome the delay in registering a child's birth certificate at the Civil Registration Office of Rote Ndao Regency, namely providing oral policy in the form of convenience in the requirements for making birth certificates, as an effort to overcome obstacles related to the absence of legislation governing child birth certificates.

Abstract

The aim of this research is to find out the concepts of entitled authority and acting authority in civil law as well as the relevance and implications of regulating entitled authority and acting authority in civil law practice. The type of research used by the author is Normative Law research, the type of data used in this research is qualitative data. The data used in research is based on the relevance of the source data, namely primary and secondary data. The results of this research are that the results of the research show that Rightful Authority is defined as the authority of an individual or a legal entity to carry out a legal act in a community's social life which is considered valid because it constitutes his or her essence as a human being or individual or as a legal entity while the Authority to Act is defined as Special authority. The special authority referred to is authority that only applies to certain people and for certain legal actions, whereas the relevance and implications show that there is no relevance in regulating the authority to have rights and the authority to act in civil law. This is shown by cases that frequently occur. for example, early marriage.

Abstract

The purpose of this study is to analyze the juridical ownership of customary land rights based on the decision of civil case Number: 13/Pdt.G/2021/Pn End. The type of research used by the author is Normative Legal research. The sources of legal materials used in this research are primary, secondary and tertiary legal materials. The method of processing legal materials through 4 (four) stages, namely identification of legal materials, inventory of legal materials, verification of legal materials and interpretation of legal materials which are then analyzed descriptively qualitatively. Based on the research results, the Plaintiff was unable to prove that the disputed object was his property and vice versa the Defendants were unable to prove that the disputed object was customary land belonging to the Kila Da Tribe. This is because there are inconsistencies regarding the structure, hierarchy, and mechanism of worship in the Customary Law Community that differ in the evidence of the Plaintiff and the Defendants. The Plaintiffs and Defendants were also unable to prove recognition by executive agencies regarding ownership of the disputed object. In addition, the Plaintiff was unable to prove that he was a legitimate heir as stipulated in Article 832 of the Civil Code. Likewise, the Defendants were unable to prove that they were the legitimate heirs of Kila Da from Wednesday Kila's descendants. The author argues that the consideration of the Panel of Judges in giving a decision in this case was correct, by rejecting the Plaintiff's claim in its entirety. Because all the arguments of the lawsuit regarding ownership of rights to customary land, cannot be proven by the Plaintiff.

Abstract

This writing aims to examine the inheritance law system in Indonesia based on its regional nature which is closely related to the scope of human life. This writing uses a qualitative approach method with data collection measuring tools using observation and structured interviews. The sampling technique used in this writing is a saturated sample. The data source used is primary data from interviews with 17 informants who are Traditional Elders, Prospective Heirs and Heirs in one of the villages in Rote Ndao district. The results of the research concluded that the application of customary inheritance law in the patrilineal kinship system in Rote Ndao Regency has changed due to economic development. Obstacles to inheritance division disputes have experienced a change in the method of resolution, from a negotiation system to a deliberation/consensus system to reconcile the disputing parties implemented by the Village Traditional Institution and the Village Government
