Abstract

All seaweed farmer groups can naturally train their members. Even local governments have provided services for increasing the productivity of home industry of seaweed farmers as regional superior products, but there has been no IPR intervention action on superior products in order to provide protection and encourage the type of seaweed processing business to obtain IPR. Research uses this normative and empirical legal research. This means that legal material data is used in reviewing and tracing various rules regarding IPR in the productivity of Industrial Seaweed RT in Rote Ndao Regency. Research shows that branded processed seaweed food products are fostered and developed by local governments, but IPR intervention is not carried out by regional governments to protect and encourage each type of product to develop regional superior products. The legal impact on unbranded seaweed food products in Rote Ndao District is that the community does not yet feel secure by not having IPR from the types of products available.Keywords: IPR Intervention, Industrial Productivity RT, Seaweed

Abstract

Otoritas Jasa Keuangan adalah lembaga pengawas jasa keuangan yang mempunyai wewenang pengaturan, pengawasan, pemeriksaan dan penyidikan pada lembaga jasa keuangan termasuk pinjaman uang online oleh layanan pendanaan bersama berbasis teknologi informasi. penelitian ini bertujuan untuk mengetahui: (1) Bagaimana peran Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang online oleh layanan pendanaan bersama berbasis teknologi informasi (2) Upaya-upaya yang sudah dilakukan Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi. Penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan metode deskriptif analisis. Bahan hukum penelitian ini menggunakan bahan hukprimer, sekunder dan tersier. Hasil penelitian ini dapat disimpulkan: (1) Peran Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi adalah mengeluarkan regulasi untuk mengatur dan mengawasi. (2) Upaya-upaya yang sudah dilakukan Otoritas Jasa Keuangan dalam menangani penawaran pinjaman uang secara online oleh layanan pendanaan bersama berbasis teknologi informasi adalah melakukan edukasi,menghimbau masyarakat untuk selalu mengecek legalitas pinjaman online ketika menerima penawaran, mengeluarkan layanan baru guna meningkatkan perlindungan konsumen yaitu Consumer Support Technology (CST) berupa Chatbot CST dan Otoritas Jasa Keuangan bersama dengan 11 kementerian berkoordinasi membentuk Satgas Waspada Investasi (SWI) untuk memberantas pinjaman online ilegal yang meresahkan dan merugikan masyarakat.

Abstract

The Financial Services Authority is a financial services supervisory institution that has the authority to regulate, supervise, examine, and investigate financial services institutions including online money loans by information technology-based joint funding services. The formulation of this research problem: (1) What is the role of the Financial Services Authority in handling online money loan offers by information technology- based joint funding services? (2) what efforts have the Financial Services Authority made in handling online money loan offers by information technology-based joint funding services? The research used is normative legal research using the descriptive analysis method. This research uses primary, secondary, and tertiary legal materials. The results of this study can be concluded: (1) The role of the Financial Services Authority in handling online money loan offers by information technology-based joint funding services is to issue regulations to regulate and supervise. (2) The efforts that have been made by the Financial Services Authority in handling online money loan offers by information technology-based joint funding services are conducting education, urging the public to always check the legality of online loans when receiving offers, issuing new services to improve consumer protection, namely Consumer Support Technology (CST) in the form of Chatbot CST and the Financial Services Authority together with 11 ministries coordinating to form the Investment Alert Task Force (SWI) to eradicate illegal online loans that are troubling and detrimental to the community.

Abstract

Children have a number of rights such as getting an education, playing and socializing, having their primary needs fulfilled. His childhood must be filled with positive and useful activities for the child's life in the future. For example, playing and hanging out, following formal education and non-formal education. Thus, the child will become a human being with the ideal personality as expected. Children also have certain values ​​in the family, society, nation and state. For example, (1) children are descendants; (2) children help their parents in their old age; (3) children help complete development work programs in villages or sub-districts; (4) children as leaders in the future. In reality, not all children experience or live life as expected. The fact that is seen in society, there are quite a number of children working in the informal sector. The place where these children do their work is often very dangerous and has a very bad impact on the child's future. The child will be an uneducated person. For example, it is very difficult for them to get a decent job, or it is difficult for them to adjust to the norms that apply in society. Furthermore, this will cause many other social problems in society. If they associate with a bad environment, these children can become criminals or the dregs of society.

Abstract

From the outset, the Job Creation Bill was aimed at strengthening large-scale companies and investors. It is unfortunate because the formulation process was closed, rushed, including ignoring the principle of prudence in formulating changes to hundreds of articles of various laws without taking into account the social, economic, political and cultural impacts that will inevitably arise. Its formulation which involves business elites and pro-capital academics is also truly unfortunate. One of the legal issues highlighted is Law No. 32 of 2009 concerning Environmental Protection and Management (PPLH), especially related to Amdal (Analysis of Environmental Impacts). Where there is a legal issue that states this AMDAL is deleted. The purpose of this study is to examine the legal norms that contradict the constitutional rights of citizens as guaranteed in the 1945 Constitution in the formation of the Job Creation Law. The method used in this research is a qualitative method. The author uses a qualitative descriptive method in this research, as well as a literature study. The research in this paper is in the field of juridical-normative law. The results of the study Based on the various difficulties in the formation of the law, it seems that the Indonesian people have long felt as a developing country. The difficulties in the formation of this law are now more felt by the Indonesian people, who are currently facing various social problems based on multi-dimensional structural and cultural problems. In fact, the formation of this law now and in the future will continue to increase in response to the demands of the community along with the increasing complexity of the development and conditions of society. This can be seen from the demonstration against the Ratification of the Omnibus Law on Job Creation.

Abstract

The land is essentially the most basic need for everyone so that the presence of the State is to ensure that everyone can be legally protected by their land ownership rights. Many legal problems occur in obtaining recognition from the State of the legal status of one's land ownership. The purpose of this research is to analyze the settlement of disputes overlapping land rights certificates in Non litigation by the Land Office of Kupang Regency. This research method is qualitative, this research was conducted at the Land Office of Kupang Regency, East Nusa Tenggara Province. The population of this research is the Head of the Kupang Regency Land Office 1 person, the Head of Section at the Kupang Regency Land Office 3 people and the Community 2 people. The sample of this research uses a saturated sample technique, which will be the sample in this study are all members of the population. The result of this research is the effort to resolve the dispute over the overlapping certificate of land rights of the Land Office of Kupang Regency in mediation efforts between the two parties in accordance with the Operational Standards and Procedures (SOP) that have been established based on the Regulation of the Minister of Agrarian Affairs Number 21 of 2020 concerning Handling and Settlement of Land Cases, namely by Mediation by bringing both parties with the Head of the Land Office as mediator. While the legal consequences when the occurrence of multiple certificates will cause the certificate does not guarantee legal certainty. Because basically the ownership status of one plot of land there is only one ownership status. It can be concluded that the certificate is strong evidence as long as the other party does not prove otherwise.

Abstract

Desa Oebelo merupakan salah satu desa di Kecamatan Amanuban Selatan Kabupaten Timor Tengah Selatan (TTS). Lokasi desa ini berada di pinggir jalan negara yang menghubungkan Kota Kupang dengan Kabupaten TTS dan Kabupaten Malaka. Persoalan utama yang ditemukan Tim Pengabdian Kepada Masyarakat di desa Oebelo yakni belum adanya peraturan desa yang dapat mewajibkan warga desa untuk menertibkan ternaknya. Hal ini menimbulkan terjadinya kasus/keributan antar warga desa terkait hewan yang memakan/merusak tanaman produktif warga desa lainnya. Tim Pengabdian Kepada Masyarakat bermitra dengan Pemeritah Desa Oebelo dan menghasillan output 1 (satu) Draft Peraturan Desa tentang Penertiban Pemeliharaan Ternak yang akan membantu Pemerintah dan Mayarakat Desa menyelesaikan semua persoalan yang terjadi selama ini. Peraturan Desa ini akan direview kembali oleh Bagian Hukum Pemerintah Kabupaten TTS dan apabila tidak terdapat kesalahan maka akan disahkan langsung oleh Kepala Desa Oebelo sepengetahuan Camat Amanuban Selatan

Abstract

Dalam rangka usaha mencegah dan menanggulangi terjadinya kekerasan dalam rumah tangga Pemerintah telah mengeluarkan peraturan perundang-undangan yang terkait dengan kekerasan dalam rumah tangga yaitu, Undang-Undang No 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Berdasarkan hal tersebut perlu dilakukan peningkatan pengetahuan dan pemahaman kepada masyarakat terkait dengan undang-undangan tersebut. Kekerasan dalam rumah tangga (domestic violence) merupakan isu yang telah berabad-abad akibat konsep budaya patriakhi yang kini sudah menjadi isu global. Kekerasan dalam rumah tangga sebenarnya dapat menjadikan siapapun dalam keluarga sebagai korban. Permasalahan yang ditemukan oleh tim Pengabdian Kepada Masyarakat adalah kurangnya pemahaman masyarakat Desa Oelomin berkaitan dengan penerapan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Adapun solusi yang ditawarkan dalam Pengabdian Kepada Masyarakat ini adalah memberikan Sosialisasi Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga (Undang-Undang Nomor 23 Tahun 2004) di Desa Oelomin, Kecamatan Nekamese, Kabupaten Kupang.

Abstract

Child protection is part of the implementation of human rights values. This has the aim of protecting children's rights to live, grow, develop and participate optimally in society.However, in reality the rights of children are often neglected even though there is Law Number 35 of 2014 concerning Child Protection. This is due to the limited knowledge and understanding of the community regarding what to do when children get violence; and there are still many children's rights that are still neglected and protection must still be carried out in the interests of the child's future. So that socialization related to child protection laws is urgently needed to increase knowledge and understanding to the public regarding these laws.

Abstract

Wanprestasi dalam Perjanjian Hutang Piutang artinya tidak memenuhi sesuatu yang diwajibkan seperti telah ditetapkan dalam perikatan, tidak terpenuhinya kewajiban oleh debitur. Rumusan masalah: (1) Bagaimanakah penyelesaian wanprestasi dalam perjanjian hutang piutang? (2) Apakah pertimbangan hakim terhadap wanprestasi dalam perjanjian hutang piutang ( dalam putusan nomor 129/Pdt.G/2019/PN Kpg)? Penelitian ini merupakan penelitian normatif. Untuk mendapatkan hasil penelitian tersebut, maka penelitian ini akan dilakukan dengan studi kepustakaan yang meliputi buku, jurnal, dan sember-sumber tertulis lainnya. Data dianalisis secara deskriptif-kualitatif. Hasil penelitian ini dapat disimpulkan: (1) Penyelesaian Wanprestasi di pengadilan, diberlakukan penyelesaian berdasarkan hukum acara perdata sebagaimana penyelesaian perkara-perkara perdata lainnya. Hal ini berarti dalam proses penyelesaiannya dapat dikenakan ganti rugi maupun sita jaminan apabila memang diperlukan dilaksanakan sita sebagaimana yang diatur dalam Pasal 277 HIR. Penyelesaian melalui jalur pengadilan atau jalur litigasi ini dimulai dengan pengajuan gugatan pada pengadilan negeri sebagai pengadilan tingkat pertama yang memeriksa dan memutus perkara. Proses persidangan dimulai dari pembacaan gugatan, replik duplik, pemeriksaan alat bukti, kesimpulan hingga penjatuhan putusan oleh majelis hakim. (2) Pertimbangan hakim terhadap wanprestasi dalam perjanjian hutang piutang dalam kasus ini majelis hakim memutuskan untuk gugatan penggugat dinyatakan tidak dapat diterima niet onvantklijke verklaard, maka penggugat dihukum untuk membayar ongkos perkara. Saran dari penelitian ini adalah Bagi pihak Pengadilan Negeri Kelas 1A Kupang agar masalah hutang piutang yang terjadi di wilayah kota kupang diperhatikan agar bagi para pihak yang ingin membuat perjanjian bisa mengikuti dan menepati sebuah proses perjanjian yang dibuat. Dan untuk pihak tergugat atau debitur agar suatu perjanjian yang sudah dibuat dengan pihak kreditur atau penggugat agar ditepati, apabila dalam perjalanan ada kendala atau masalah segera melaporkan ke pihak berwajib. Diharapkan kepada pihak tergugat agar melakukan sebuah pembayarn kepada pihak penggugat yang sesuai dengan bunga yang sudah ditentukan berdasarkan dengan perjanjian yang sudah dibuat.
