Abstract

General Election as a means to realize the ideal of democracy does    not merely aim to determine who will get the position in the parliament but it also should represent the sovereignty of the people. In the 2009 General Election, however, parliamentary threshold was prevailed and implemented. This regulation is included on Article 202 The General Election Act number 10/2008 which stated that political party of General Election participant must fulfil at least an amount of 2.5% of total valid national vote to be included in the representation determination of the House of Representative.A number of Indonesian peoples objected the rule. This is because parliamentary threshold deemed to be potentially demolished the political right of the people. Besides, the implementation of parliamentary threshold in bottom level considered to have some potential horizontal conflict because, for example, if someone voted as a selected candidate but they do not fulfil the parliamentary threshold, this particular candidate cannot obtain a seat in the parliament. This can be seen in the petition of judicial review to the Constitution Court regarding this parliamentary threshold regulation.It can be concluded  that  the  relevance  of  parliamentary  threshold to democratic General Election execution can not be separated from the mechanism and reasons in determining the the amount of threshold numbers in said rule. Requirement for determining the threshold is not merely based on a reason to strengthen presidential system chosen by the Indonesian people. In this case, the people’s voice should not be represented merely by the parliamentary number having position in the House of Representative. If this happens, then there will be some concerns of the emergence of political interest to strengthen the position of a particular political party in the  parliament.

Abstract

The research stems from Decision Number 224 PK/PID.SUS/2018 which grants the application for judicial review (hereinafter abbreviated as PK) by a suspected narcotics abuser with a novum (new evidence) in the form of previous judges' decisions. In this case, this study aims to conceptualize how the regulation of PK legal remedies in criminal cases should be. This research is a normative legal research, the approach used is a case approach, a comparative approach, and a conceptual approach, with a literature study research technique. After knowing the arguments for the admissibility of submitting a PK in the form of a District Court Decision, the author makes several comparisons with the Criminal Procedure Code (America and France), and concludes based on this comparison that the use of the basis for submitting a PK should be regulated clearly and firmly in the Criminal Procedure Code, because the two countries in its criminal procedural law it expressly states that the submission of a PK must be based on new facts and evidence which, if presented at the previous trial, has the potential to reduce or even abort the prosecution's charge

Abstract

Dalam kultur hukum di peradilan saat ini, hakim memiliki kebebasan dalam melaksanakan aktivisme yudisial, termasuk berselisih pendapat dengan hakim lainnya yang membentuk putusan. Tidak sedikit putusan yang diambil tanpa aklamasi, karena terdapat hakim yang mengajukan dissenting opinion. Tulisan ini menguraikan mengenai dissenting opinion sebagai alternatif referensi bagi hakim, khususnya hakim konstitusi, dalam melakukan pembaharuan hukum. Hal ini diperlukan agar dissenting opinion sebagai narasi hukum alternatif dapat memperkaya dan memberikan dorongan perkembangan hukum di masa depan. Hasil penelitian menunjukan bahwa dissenting opinion merupakan produk penafsiran hakim konstitusi yang keberadaannya memberikan jaminan bahwa suatu putusan lahir dari perdebatan yang futuristik. Kendati tidak memiliki kekuatan hukum, dissenting opinion dapat dijadikan sebagai alternatif referensi bagi hakim konstitusi dalam memeriksa perkara yang relatif sama. Hal ini dikarenakan persoalan konstitusionalitas merupakan isu yang terus berkembang, bahkan seringkali menjadi acuan dalam pembaharuan hukum yang signifikan, sehingga hakim konstitusi harus menggali hukum dari berbagai perspektif yang relevan, termasuk di dalamnya menjadikan dissenting opinion sebagai alternatif referensi. Telaah ini diharapkan mampu menjadi kompas yang dapat menunjukan arah pembaharuan hukum kedepannya.

Abstract

Desa dan warga desa sangat penting dalam penyelenggaraan pemilu kepala daerah. Desa menjadi lokasi praktik politik uang dalam bentuk jual-beli suara antara calon kepala daerah dan warga desa. Praktik politik uang di desa berbahaya karena dapat merusak integitas Pilkada. Penelitian ini merupakan penelitian sosio-legal dengan teknik pengumpulan data dilakukan dengan metode depth interview dan studi pustaka. Hasil penelitian menunjukkan bahwa faktor penyebab politik uang masih terjadi dipengaruhi oleh faktor budaya, kemiskinan, tingkat pendidikan, tingkat pemahaman hukum, tingkat pemahaman agama, lemahnya institusi pemerintahan, lemahnya institusi pengawasan dan lemahnya institusi partai dan kader politik. Oleh sebab itu, perlu dibangun Model Desa Anti Politik Uang dalam pilkada dengan Pelibatan dan pemanfaatan secara maksimal modal sosial dalam masyarakat untuk membentuk Gerakan Sosial Desa Anti Politik Uang.

Abstract

Omnibus can create legal certainty by directly regulating a bunch of facts that are intertwined in the legal system. This method is considered to be more effective than creating individual laws and regulations, which can lead to duplications and inconsistencies between regulations. Contrary to this ideal concept, the Indonesian Government's Comprehensive Law or Preparation Law must be conditionally overturned by the Constitutional Court by Constitutional Court Decision No. 91 / PUUXVIII / 2020. As the legislative body responsible for enacting the law, DPR has two years to fix the formal flaws in Undang Undang Cipta Kerja. This study uses the nature of the doctrine study, the conceptual approach, and the legal approach to describe the management aspects of Undang Undang Cipta Kerja as an omnibus method using Lon L. Fuller. This analysis provides an overview of the strengths and weaknesses of Undang Undang Cipta Kerja in terms of superior legal quality. Recognizing the weaknesses of publications that exist in the process of creating and implementing Undang Undang Cipta Kerja may be recommended to the government if it meets the formal improvement deadline required by the Constitutional Court to maintain omnibus law. Abstract

Omnibus Law dapat memberikan kepastian hukum dengan mengatur tentang beberapa kluster isu yang saling berkelidan dalam sebuah sistem hukum secara langsung. Metode ini dianggap lebih efektif daripada pembentukan Peraturan Perundang- Undangan secara terpisah yang mungkin akan menimbulkan tumpang tindih maupun inkonsistensi antar regulasi. Berbeda dengan konsep ideal tersebut, Omnibus Law atau Undang- Undang Cipta Kerja yang dibuat oleh Pemerintah Indonesia kemudian harus dibatalkan secara bersyarat oleh Mahkamah Konstitusi melalui Putusan MK Nomor 91/PUU-XVIII/2020. DPR selaku Lembaga legislative yang bertanggung jawab untuk membentuk Undang- Undang memiliki waktu 2 (dua) tahun guna memperbaiki cacat formil dari UU Cipta Kerja tersebut. Dengan menggunakan jenis penelitian doctrinal serta pendekatan koneptual dan pendekatan perundang- undangan, kajian ini akan menelaah sisi pengadministrasian UU Cipta Kerja sebagai Omnibus Law dengan menggunakan teori 8 Principles of Legality yang dikemukakan oleh Lon L. Fuller. Analisis tersebut akan memberikan gambaran mengenai kekuatan maupun kelemahan dari UU Cipta Kerja dari segi karakteristik hukum yang baik. Kesadaran akan adanya kelemahan dari segi publikasi yang ada dalam proses pembuatan serta pengimplementasian UU Cipta Kerja dapat menjadi rekomendasi bagi pemerintah ketika memenuhi tenggat waktu perbaikan formil yang disyaratkan oleh MK agar Omnibus Law tersebut dapat tetap berlaku serta memberikan manfaat positif bagi iklim investasi di Indonesia.

Abstract

This article aims to examine the form of legal protection and supervision and legal responsibilities related to the implementation of beauty clinic services as well as a description of the existing problems. Research results show that in practice many business actors do not do the things they should do because they are more concerned with material benefits, and less concerned with the dangers of the products they sell. It can be said if every class of consumers who perform treatment at a beauty clinic has the right to get legal protection if there are consequences of the treatment process that is detrimental to him. The rise of malpractice cases, the use of illegal and dangerous drugs, and incompetence of health workers to beauty clinic licenses has become a series of problems that must be addressed by the government through strengthening supervision aspects.

Abstract

Abstrak Tujuan dari penulisan ini adalah untuk mengetahui kebijakan Sistem Aplikasi Pelayanan Kepegawaian On  Line (SAPK On Line) untuk mewujudkan E-Government di Pemerintah Kabupaten Karanganyar studi kasus di Pemerintah Kabupaten Karanganyar. Metode penelitian yang digunakan adalah metode penelitian kualitatif jenis penelitian empiris. Kebijakan SAPK On Line di Badan Kepegawaian dan Pemberdayaan Sumber Daya Manusia (BKPSDM) Kabupaten Karanganyar belum sepenuhnya dilaksanakan karena input  data  Pegawai  Negeri  Sipil  masih  menggunakan  Sistem  Informasi  Manajemen  Kepegawaian (SIMPEG) yang bersifat   dengan format   yang tidak dapat dikonversi ke dalam format SAPK On Line. Sehingga database PNS yang masuk tidak sinkron antara SAPK On Line dengan SIMPEG apabila ada PNS yang mengajukan kenaikan pangkat dan kenaikan gaji. Terutama dalam hal kenaikan pangkat, ketidak sinkronan database PNS tersebut berakibat tertundanya proses kenaikan pangkatnya. Hal inilah yang menghambat terwujudnya E-Government yang ideal di lingkungan Pemerintah Kabupaten kertas, sedang tujuan dari SAPK On Line yaitu paper less atau mengurangi jumlah kertas dalam setiap pelayanan kepegawaian.Kata Kunci : SAPK On Line, E-Government, Kabupaten Karanganyar

Abstract

AbstractThis article aims to analyze the implementation of government regulation No. 18 of 2016 on the regional apparatus against the effectiveness of the performance of employees in the local secretariat of the regional parliament (DPRD) in the district Ngawi. The research is research law that is evaluative with the empirical approach and sociological approach.The theory used for the analysis in this research is the theory of Lawrence M. Friedman with its three legal structures, from the analysis it is known that the performance of the employees in the local secretariat environment The ngawi district representative board is quite good but needs many new innovations and improvements in some aspects, in both the legal aspect in the legal structuretheory of friedman found that only in the aspect of the element of law culture which is not appropriate to the implementation of Government Regulation No. 18 of 2016 on the Regional Devices in Ngawi District is less able to improve the effectiveness of the performance of the Secretariat staff of Ngawi Regency DPRD. The competence of employees who moved from the merger of other agencies and agencies in accordance with Government Regulation No. 18 of 2016 is not in accordance with the needs of the Secretariat of Ngawi Regency DPRD, while in the other two aspects are appropriate.Keywords: implementation of government regulation; effectiveness; law culture.AbstrakArtikel ini bertujuan untuk menganalisis implementasi peraturan pemerintah Nomor 18 tahun 2016 tentang perangkat daerah terhadap efektivitas kinerja pegawai di lingkungan sekretariat daerah dewan perwakilan rakyat daerah (DPRD) di kabupaten ngawi. Berdasarkan bentuknya penelitian ini termasuk dalam evaluatif, yaitu “suatu bentuk penelitian yang dimaksudkan untuk menilai suatu program kerja. Teori yang dipakai untuk analisis dalam penelitian ini adalah teori dari Lawrence M. Friedman dengan tiga struktur hukumnya, dari analisis diketahui bahwa kinerja para pegawai di lingkungan sekretariat daerah Dewan perwakilan daerah kabupaten ngawi cukup baik namun perlu banyak inovasi baru dan peningkatan dibeberapa aspek, di kedua aspek hukum dalam teori struktur hukum dari friedman didapatkan bahwa hanya dalam aspek dari unsur kultur hukum saja yang tidak sesuai implementasi Peraturan Pemerintah Nomor 18 Tahun 2016 tentang Perangkat Daerah di Kabupaten Ngawi kurang mampu meningkatkan efektivitas kinerja pegawai Sekretariat DPRD Kabupaten Ngawi. Kompetensi pegawai yang pindah dari adanya penggabungan Dinas dan Badan lain sesuai dengan Peraturan Pemerintah Nomor 18 Tahun 2016tidak sesuai dengan kebutuhan Sekretariat DPRD Kabupaten Ngawi, sementara dalam kedua aspek lainnya sesuai.Kata kunci: implementasi peraturan pemerintah; efektivitas; kultur hukum.
